Jurisdictional Transfer No. 819 JURISDICTIONAL TRANSFER DOCUMENT Canterbury Lane Section Pacific Highway West No 1 Washington County City of Tigard Pursuant to ORS 373.010, the Oregon Transportation Commission is authorized and directed, whenever the route of any state highway passes through the corporate limits of any city, to select or designate the streets of the city over which the state highway shall be routed, or change such routing when in its opinion the interests of the motoring public will be better served. Pursuant to ORS Chapters 366.395 and 373.015, the State may transfer its interest to any of its property not needed by it for highway purposes to any other governmental body or political subdivision within the State of Oregon, subject to such restrictions, if any, imposed by deed or other legal instrument or otherwise imposed by State. Pursuant to OR5190.110 and ORS 366.576, the State may enter into any agreement with any city for the relocation of any highway. The Canterbury Lane section of the highway is not part of the highway system, but rather a connector road that, if classified, would function as a Local road. This transfer was part of a project initiated in 1988, Miscellaneous Contracts and Agreements No. 8741, which was subject to public comment through an interactive process with the affected city (Tigard), county and fire district, and approved by delegated authority of the Oregon Transportation Commission. The segment eliminated from the highway is described in the legal description and shown on the accompanying map, marked Exhibit A and Exhibit B respectively, attached hereto and by this reference, made a part hereof. This segment is needed for the service of persons living thereon or for a community served thereby. The Canterbury Lane Section of the Pacific Highway West, State Highway No. 1, in Washington County, Oregon, is no longer needed by the State of Oregon as a portion of the state highway system. Said portion, hereinafter described in the legal description and shown on the accompanying map, marked Exhibit A and Exhibit B respectively, attached hereto and by this reference, made a part hereof, has been duly eliminated as a portion of the Highway and the state highway system. All right, title, and interest of the State of Oregon in said portion described in the legal description and shown on the accompanying map, marked Exhibit A and Exhibit B respectively, attached hereto and by this reference, made a part hereof hereby passes to and vests in the City of Tigard as a portion of its city street system as long as needed for the service of persons living thereon or a community served thereby. Any right-of-way being conveyed in which state has any title shall be vested in City only so long as used for public road purposes. If said right-of-way is no longer used for public road purposes, it shall automatically revert to State. 2. The property described in the legal description marked Exhibit A is transferred subject to the rights of any utilities located within said property and further subject to the rights of the owners of said existing facilities if any there be, to operate, reconstruct, and maintain their utility facilities presently located within said property. 3. Because segment is either on the National Highway System (NHS) or was part of the federal aid primary system in existence on June 1, 1991, it continues to be subject to the requirements of 23 USC 131 and the Oregon Motorist Information Act, ORS 377.700 to 377.840 and 377.992, after transfer, and State retains authority to enforce those laws. In accordance with those laws, State is required to continue regulating outdoor advertising signs, which includes conducting surveillance along these highways. Oversight is the responsibility of the Outdoor Advertising Sign Program in the State Right of Way Program Management Unit. The Oregon Transportation Commission, by a duly adopted Delegation Order OTC—01; Delegation Order No. DIR-03, Paragraph No. A-21; Delegation Order No. HWY 04, Paragraph No. A-8; and Delegation Order No. TSB 04, Paragraph No. A-6, all dated December 1, 2010, authorize the State Right of Way Manager to sign this Jurisdictional Transfer Document for and on behalf of the Commission.
