DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL PRIOR TO BUILDING PERMIT SUBMITTAL THE FOLLOWING CONDITIONS MUST BE SATISFIED: 1. Prior to building permit submittal,the applicant must submit an address and commercial suite application and then receive confirmation that a new address has been created at 16200 SW Pacific Highway for the newly created tenant space. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The applicant is proposing to split the former Albertson's building at 16200 SW Pacific Highway, Suite Z into two tenant spaces. The west side (25,500 square feet) will be prepared for the proposed tenant, Planet Fitness,which is an indoor entertainment use.The east side(25,076 square feet)will remain vacant until a prospective tenant is found.The site is located south of SW Durham Road,west of SW 113t Ave, east of SW Pacific Highway, and north of SW Gabriel Street. This property is part of the Tigard Town Square Shopping center, but it is located on its own 3.9-acre tax lot (WCTM 2S115BA, Tax Lot 100). The subject tax lot contains an existing 50,576 square foot tenant space that was previously occupied by a sales-oriented retail use, as well as associated parking and landscaping. The property is located in the General Commercial (C-G) zone. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications D. Approval criteria.The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; The applicant is proposing exterior building maintenance to the building at 16200 SW Pacific Highway, Suite Z. Specifically,the applicant proposes to freshen up the signband by applying a new layer of stucco for the signage, clean and repaint the back of the building, and reseal the brick on the north facade. The described maintenance does not need any land use approval and is allowed in the Community Development Code (CDC). MMD2019-00012 Tigard Town Square Renovation Page 2 of 4 The applicant is also proposing a partition of the building at 16200 SW Pacific Highway, Suite Z and a change from a sales-oriented retail use to an indoor entertainment use.With a change of use,the potential issues are primarily related to the off-street parking requirement. A minor modification is required for this change of use because the application of a higher parking quantity is required according to Table CDC 18.410.3. There are currently 920 parking spaces that were approved by a previous land use decision for the Tigard Towne Square,therefore with the change of use, there are 318 additional parking spaces above the required minimum on site. Upon review of the applicant's plans and narrative,staff finds this proposal is in compliance with all other applicable requirements of this title.This criterion is met. MMD2019-00012 Tigard Town Square Renovation Page 3 of 4 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed;or c. A new or modified condition better accomplishes the purpose of the original condition. This criterion is not applicable because the proposal does not modify a condition of approval. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Tide. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A minor modification is a Type I procedure.As such, this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first. This decision is not appealable locally and is the final decision of the City. THIS DECISION IS FINAL ON APRIL 22ND, 2019, AND BECOMES EFFECTIVE ON APRIL 23RD, 2019.
