Dear Mr. Duenas:
Attached are sample results tables for samples collected to date associated with the Tigard Library project.
Sample number 12S was collected.from the southerly portion of the Library project. As you will find, this
sample exceeded the EPA background level revealing an arsenic concentration of 110 parts per million(ppm)
and was collected 34 inches below grade. It is our understanding from conversations with Hoffman
Construction this area is to be utilized as the driveway access to the site. According to Dan Vanbrabant of
Hoffman,the current elevations in this area are acceptable to Hoffman to refill the area and cap. However,this
area will also be impacted by the Widening Project and it is uncertain as to the impacts associated with the
utilities for this area. Based upon these results we have the following comments/recommendations:
I. Additional soil samples from this area should be collected to further characterize the extent of the
soils contamination in relation to the Hall.Blvd.Widening project and ODOT requirements.
2. The City of Tigard should communicate with the Hall Blvd. Widening Project to determine the
impact of utilities in this area.
3. The City of Tigard should decide if the area can be capped or if they would like Apex and Hoffman
to continue to "pot hole"the area to determine if levels decrease after 34 inches.
Please call us to further discuss this matter and to reach a conclusion as soon as possible. At this time
Hoffman has moved to other areas until this decision can be reached. I can be reached at the number below or

In an area near the new entry to the Library we excavated as specified to remove the
Arsenic contaminated soil and had a test come back slightly over the legal limits_ We
were directed to over excavate this area one additional foot in an attempt to get the levels
within the 7 ppm required. This over excavated area has been retested and the results
came back at 110 ppm(See Apex report dated 7-28-03 and map attached).
It appears there may be options other than removal as the elevation of the sample area is
more than 5 feet below the final grades for this project. We need direction from SOJ and
the City before we proceed any further with additional over excavation in this area. We
request a decision by the owner's meeting this week.

SOJ has consulted with Gus Duenas about the extent of arsenic contaminated soil removal.
The City's instructions are as follows:
a. Do not remove arsenic contaminated soil within the flood plain boundary (generally
north and east of the boundary line) except to the extent that the "Contract Documents"
(not the Apex Environmental Consulting Services report dated 5/13/03) specifically require
Work in this area.
b. At the south side of the project, do not remove arsenic contaminated soil to the south
and east of the "50' Buffer" line except to the extent that the "Contract Documents" (not
the Apex Environmental Consulting Services report dated 5/13/03) specifically require Work
in this area where utilities cross the buffer zone. L0.01 shows approximate limits of the
Work (except it does not delineate the required utility lines) .

Per our conversation, it appears the Apex drawing dated 5/20/03 shows more
Arsenic soil removal than desired by the Owner. Please have the Owner
provide revised instructions. For the sake of discussions with the low
earthwork bidder, we advised them to adjust their quote as follows:
a. Do not remove the Arsenic contaminated soil North of the Flood Plain line
on the North side of the building except to the extent that this area will
be disturbed by the Contractor.
b. At the South end of the project, do not remove Arsenic contaminated soil
to the east of the "50' Buffer" line except where your utilities cross the
