The applicant shall prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to the PLANNING DIVISION,ATTN: CHERYL CAINES 503-718- 2437. 1. Prior to final plat, the applicant shall submit to the City of Tigard a canopy fee ($9,632.00) or plant trees per the approved Tree Canopy Site Plan and Supplemental Report to satisfy the 15% effective canopy requirement for Parcel 1. 2. If planting is chosen to satisfy the minimum effective canopy requirements on Parcel 1, then the applicant shall provide a tree establishment bond as outlined in the Urban Forestry Manual,Section 11,Part 2. 3. Prior to final plat the applicant shall submit to the City of Tigard the current Inventory Data Collection fee ($430.00) for urban forestry plan implementation. The applicant shall prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to PUBLIC WORKS,MIKE WHITE (503)718-2464. 4. A Public Facility Improvement (PFI) permit is required for this project to cover coordination with Clean Water Services and inspection of plantings/public improvements to satisfy CWS Design and Construction Standards. An application form and six (6) sets of detailed plans showing the requirements of CWS Service Provider Letter (SPL#13-000513) shall be submitted to the Public Works Depaituient. 5. The PFI permit plan submittal shall include the exact legal name, address and telephone number of the individual or corporate entity who will be designated as the "Permittee", and who will provide the financial assurance for the CWS required improvements. For example, specify if the entity is a corporation, limited partnership, LLC, etc. Also specify the state within which the entity is incorporated and provide the name of the corporate contact person. Failure to provide accurate information to the Public Works Department will delay processing of project documents. 6. The applicant shall assure for Clean Water Services required work within the sensitive area and vegetated corridor on forms supplied by the City of Tigard. 7. The applicant's finallat shall contain State Plane Coordinates on two monuments with a tie to the City's global positioning system (GPS) geodetic control network (GC 22) as recorded in Washington County survey records. These monuments shall be on the same line and shall be of the same precision as required for the subdivision plat boundary. Along with the coordinates, the plat shall contain the scale factor to convert ground measurements to grid measurements and the angle from north to grid north. These coordinates can be established by: • GPS tie networked to the City's GPS survey. • By random traverse using conventional surveying methods. 8. The applicant's final plat shall show all encumbrances including but not limited to an existing public sanitary sewer easement, existing public bikeway and pedestrian way easement, and required storm sewer, surface water, drainage and detention easement to City of Tigard (per CWS SPL#13-000513). 9. The applicant shall rename Parcel 2 to Tract 1 to satisfy conditions of approval of CWS SPL#13-0000513. 10. Final Plat Application Submission Requirements: A. Submit for City review four (4) paper copies of the final plat prepared by a land surveyor licensed to practice in Oregon,and necessary data or narrative. B. Attach a check in the amount of the current final plat review fee ($962.00 prior to July 1,2013). C. The final plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05),Washington County,and by the City of Tigard. D. Submit final plat to Washington County for review. F. THIS APPROVAL IS VALID IF EXERCISED: WITHIN- EIGHTEEN (18) MONTHS- OF-,THE EFFECTWE DATE OF THIS DECISION NOTED UNDER THE PROCESS AND APPEAL SECTION OFTHIS DECISION. SECTION III. BACKGROUND INFORMATION Site and Vicinity Information The 2.62 acre site is located on the west side of SW Grant Street, south of the intersection with Tigard Street. The site is zoned R-4.5 (Low Density Residential) with I-P (Industrial Park) zoning to the north and R-12 (Medium Density Residential) to the east across Grant Street. There is an assisted living facility and barn/greenhouse on the site that will stay after the partition. A portion of the site includes Fanno Creek,associated wetlands,and the 100-year floodplain. Property History: A search of City records shows a Conditional Use Permit (CUP2000-00003) to construct two (2), 15-bedroom elderly care homes with common parking and courtyards. A Sensitive Lands Review (SLR2000-00011) was approved at the same time to install a storm pipe within the 100-year floodplain. No other land use approvals were found affecting this parcel. Proposal Description The applicant is requesting a Minor Land Partition to divide one existing 2.62 acre site into two parcels. The proposed lots are 30,138 and 76,960 square feet in size. There is an existing care facility located on the site that will remain on Parcel 1 and an existing accessory structure and garden area located on Parcel 2 that will also be retained. Parcel 2 is made up of land within the 100-year floodplain. The applicant is requesting the partition to separate the floodplain area from the care facility in order to meet financing requirements. No development or construction is proposed with the partition. However, Clean Water Service standards require plantings and enhancement of the sensitive areas and vegetated corridor and that Parcel 2 be set aside as a tract for the purposes of maintaining storm sewer,surface water,drainage,and detention functions. SECTION IV. PUBLIC COMMENTS The Tigard Community Development Code requires that property owners within 500 feet of the subject site be notified of the proposal, and be given an opportunity for written comments and/or oral testimony prior to a decision being made. No comments were received in response to the notice. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS Land Partitions (18.420): Approval Criteria (18.420.050) The proposed partition complies with all statutory and ordinance requirements and regulations; FINDING: The proposed partition complies or can be made to comply with all statutory and ordinance requirements and regulations as demonstrated by the analysis contained within this administrative decision and through the imposition of conditions of development approval. All necessary conditions must be satisfied prior to final plat. Therefore,this criterion is met. There are adequate public facilities available to serve the proposal; FINDING: The proposal is to partition the development site in order to separate the floodplain from the portion with the assisted living facility. Public facilities currently serving the development are adequate and no further service/capacity is necessary. This criterion is met. NOTICE OF DECISION MLP2013-00002/GRANT ELI I'h CARE PARTITION PAGE 3 OF 9 L � All proposed improvements meet City and applicable agency standards;and FINDING: As the streets and utilities already exist,no public improvements are required with this decision. This criterion is met. All proposed lots conform to the specific requirements below: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. FINDING: The average minimum lot width required for the R-4.5 zoning district is 50 feet. Parcel 1 has an average minimum lot width of 136 feet. To meet the conditions of the Clean Water Services Service Provider Letter, Parcel 2 will have a storm sewer, surface water, drainage, and detention easement over its entirety and be renamed as Tract 1. The tract will not contain a building envelope. This criterion is met. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the accessway may not be included in the lot area. FINDING: The minimum lot area requirement in the R-4.5 zoning district is 7,500 square feet for detached single-family units. The applicant states the two proposed parcels are 30,138 and 76,960 square feet respectively. No flag lots are being created.This criterion has been met. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement. FINDING: Parcel 1 has over 143 feet of frontage and Parcel 2 has over 364 feet of frontage on SW Grant Street. This criterion is met. Setbacks shall be as required by the applicable zoning district. FINDING: The only setbacks impacted by the proposal are the north side yard setback on Parcel 1 and the south side yard setback for Parcel 2. Side yard setbacks in the R-4.5 zone are five (5) feet. Based on the site plan provided, the existing assisted living facility will be 30 feet from the proposed side property line; and the greenhouse/barn will be eight (8) feet from the proposed side property line. This criterion is met. When the partitioned lot is a flag lot,the developer may determine the location of the front yard,provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. FINDING: There are no flag lots proposed with this application. This criterion does not apply. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. FINDING: There are no accessways proposed with this partition. This criterion is does not apply. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. FINDING: There are no accessways proposed with this partition. This criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. FINDING: A common drive is not proposed with this application. This criterion does not apply. NOTICE OF DECISION MLP2013-00002/GRANT ELITE CARE PARTITION PAGE 4 OF 9 Any access way shall comply with the standards set forth in Chapter 18.705,Access,Egress and Circulation. FINDING: The existing access was approved and constructed with the previous approval (CUP2000- 00003). The applicant is not proposing to modify the existing or construct a new access. This criterion is met. Where landfill and/or development is allowed within or adjacent to the one-hundred year floodplain, the city shall require consideration of the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. FINDING: A portion of the site is within the 100-year floodplain. A public easement for a pedestrian/bike path was recorded for the previous approval (CUP2000-00003). This criterion is met. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. The applications for the partition and variance(s)/adjustment(s) will be processed concurrently. FINDING: The applicant has not requested a variance or adjustment with this proposal. This criterion does not apply. Residential Zoning Districts (18.510): Table 18.510.030.1 outlines uses permitted in residential zoning districts. FINDING: The existing use is an assisted living facility which was permitted through a conditional use permit(CUP2000-00003),and Group Living is a permitted use in the zone. No further development or new use is proposed with this application. This standard is met. N/A N/A Minimum Landscape Requirement - N/A N/A FINDING: As shown in the table above, the proposed parcels satisfy the applicable development standards of the R-4.5 zone. The partition only impacts side lot lines, and the existing structures exceed the five (5) foot minimum side yard setback. To meet the conditions of the Clean Water Services Service Provider Letter, Parcel 2 will have a storm sewer, surface water, drainage, and detention easement over its entirety and be renamed as Tract 1. The tract will not contain a building envelope; therefore, the minimum lot width standard does not apply. The development standards are satisfied. NOTICE OF DECISION MILP2013-00002/GRANT ELI I1.CARE PARTITION PAGE 5 OF 9 Urban Forestry Plan(18.790): Urban Forestry Plan Requirements (18.790.030) A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor (the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; Street trees were planted with the Grant Street Elite Care development. The applicant cannot demonstrate compliance with the tree canopy and soil volume requirements with existing or new street trees, so an Urban Forestry Plan prepared/approved by both a certified arborist and a risk assessor has been provided. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual(UFM); The existing development site is being partitioned into two parcels. No additional development or tree removal is proposed at this time. The tree preservation and removal standards do not apply. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and A Tree Canopy Site Plan was provided that identifies the canopy of existing and newly planted open grown trees on Parcel 1 and an existing stand of trees (Stand #1) on Parcel 2. According to the supplemental report, no tree growth limiting soils were found on the site; so no limiting soils are identified on the plan. The applicant's Urban Forestry Plan outlines two ways to meet the minimum effective canopy requirements (pay fee-in-lieu and planting trees). The applicant will be conditioned to implement one of the proposed methods. Both the certified arborist and certified tree risk assessor have signed the Urban Forestry site plan and attested that the plan meets the tree canopy site plan standards. 4. Meet the supplemental report standards in the Urban Forestry Manual. A supplemental report was prepared by the project arborist, Todd Prager. The report includes the required inventory data for the existing open grown trees and the existing stand of trees (UFM Section 10, Part 3, and Subsection D & E). Protection measures were not addressed as no development is proposed with this application. Soil characteristics for Parcel 1 are noted as well drained, amended top soils that were installed with the previous development. Parcel 2 has native soils that support the existing stand of primarily native trees. The arborist states that the trees appear to be healthy and that no soil amendments are needed for the site. The report includes a table that demonstrates the effective tree canopy in accordance with UFM Section 10, Part 3, and Subsection M). Because the site is zoned R-4.5, the required effective tree canopy is 40% for the entire site. Partitions in this zone also require a minimum 15% effective canopy for each lot. According to the supplemental report the effective canopy is as outlined below: Parcel 1 Parcel 2 Total Site Existing canopy 4% 190% 138% With Planted Trees 15% No change 140% The required canopy for the entire site is met; however, the minimum for Parcel 1 is not met. Parcel 1 has five existing trees. Tree #1 cannot be included due to condition. There are four small street trees (Bloodgood Japanese Maple) that are considered newly planted trees because they are less than 6-inch caliper. The project arborist has proposed the planting of four additional trees or a canopy fee-in-lieu to satisfy the minimum 15% effective canopy. The applicant has stated in the narrative the canopy fee will be paid in lieu of plantings. However, in follow-up conversations, the applicant has indicated that trees may be planted instead. Both proposed methods satisfy the minimum 15% canopy requirement; therefore the applicant is being conditioned to implement one of the proposed methods to meet the requirement. B. Tree canopy fee. If the supplemental report demonstrates that the applicable standard percent effective tree canopy cover will not be provided through any combination of tree planting or preservation for the overall development site (excluding streets) or that the 15% effective tree canopy cover will not be provided through any combination of tree planting or preservation for any individual lot or tract in the R-1, R-2, R- 3.5, R-4.5 and R-7 districts (when the overall development site meets or exceeds the standard percent NOTICE OF DECISION \ILP2013-00002/GRANT ELITE CARE PARTITION PAGE 6 OF 9 effective tree canopy cover), then the applicant shall provide the city a tree canopy fee according to the methodology outlined in the tree canopy fee calculation requirements in the Urban Forestry Manual. The supplemental report demonstrates that the 15% effective tree canopy cover will not be provided for Parcel 1. The applicant may choose to submit a tree canopy fee in lieu of planting. The canopy fee is based upon the following information using the requirements in the Urban Forestry Manual: Total Site 30,138 sq. ft. 15% Canopy 4,521 sq. ft. Existing Canopy 1,256 sq. ft. Difference 3,265 sq. ft. Fee per Sq. Ft. $2.95 Total Canopy Fee $9,632 FINDING: Based upon the facts above, the Urban Forestry Plan requirements have not been met but can be as conditioned. Urban Forestry Plan Implementation (18.790.060) C. Tree Establishment. The establishment of all trees shown to be planted in the tree canopy site plan (per 18.790.030 A.3) and supplemental report (per 18.790.030.A.4) of the previously approved urban forestry plan shall be guaranteed and required according to the tree establishment requirements in Section 11,part 2 of the Urban Forestry Manual. FINDING: The applicant originally proposed to pay the tree canopy fee in lieu of plantings; however in subsequent conversations, the applicant indicated that planting is still an option. The applicant's proposal does not address tree establishment. Therefore, the applicant is conditioned to provide a tree establishment bond that meets the requirements of the Urban Forestry Manual Section 11, Part 2. D. Urban forest inventory. Spatial and species specific data shall be collected according to the urban forestry inventory requirements in the Urban Forestry Manual for each open grown tree and area of stand grown trees in the tree canopy site plan (per Section 18.790.030.A.3) and supplemental report (per Section 18.790.030.A.4) of a previously approved urban forestry plan. Section 11, Part 3 of the Urban Forestry Manual states that prior to any ground disturbance work, the applicant shall provide a fee to cover the city's cost of collecting and processing the inventory data for the entire urban forestry plan. There are five existing trees on or adjacent to Parcel 1 and an existing stand on Parcel 2. The total tree inventory fee is $430.00 ($137 + $28(4) + $181). FINDING: Standards to implement the Urban Forestry Plan have not been satisfied but can be as conditioned. Impact Study (18.390) Section 18.360.090 states, "The Director shall make a finding with respect to each of the following criteria when approving, approving with conditions or denying an application:" Section 18.390.040 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large,public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication is not roughly proportional to the projected impacts of the development. Section 18.390.040 states that when a condition of approval requires the transfer to the public of an interest in real property,the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. Because no development is proposed with the application,there will be no effect on public facilities and services. ADDITIONAL CITY CONCERNS WITH FINAL PLAT: Survey Requirements: The applicant's final plat shall contain State Plane Coordinates [NAD 83 (91)] on two monuments with a tie to the City's global positioning system (GPS) geodetic control network (GC 22). These monuments shall be on the same line and shall be of the same precision as required for the subdivision plat boundary. Along with the coordinates, the plat shall contain the scale factor to convert ground measurements to grid measurements and the angle from north to grid north. These coordinates can be established by: • GPS tie networked to the City's GPS survey. • By random traverse using conventional surveying methods. In addition, the applicant's as-built drawings shall be tied to the GPS network. The applicant's engineer shall provide the City with an electronic file with points for each structure (manholes, catch basins,water valves, hydrants and other water system features) in the development, and their respective X and Y State Plane Coordinates, referenced to NAD 83 (91). SECTION VI. OTHER STAFF COMMENTS Tigard Public Works Department (Assistant Public Works Director, Brian Rager) was sent copies of the proposal and has no objection. SECTION VII. AGENCY COMMENTS Clean Water Services (CWS) has reviewed the proposal. Development within sensitive areas and vegetated corridors (including partitioning of land) must meet the requirements of CWS Design and Construction Standards (R&O 07-20). The applicant obtained a CWS Service Provider Letter (SPL#13-000513) for impact to the sensitive area and vegetated corridor, and a copy of the CWS SPL was submitted with the application. The applicant must comply with the conditions of the SPL. In addition, CWS submitted a comment letter (June 12, 2013) outlining the requirements to obtain a Storm Water Connection Permit Authorization. This authorization is required prior to any site work or partition plat recording. A copy of both CWS letters can be found in the land use file (MLP2013-00002). The City of Tigard and CWS have an intergovernmental agreement stating that the City will ensure implementation of CWS Design and Construction Standards; therefore this minor land partition approval is conditioned to satisfy CWS requirements. Tualatin Valley Fire and Rescue (TVF&R) has reviewed the proposal and has no objection to the proposed partition. Qwest Communications states that this location falls out of the Qwest service area. Conditional Use Introduction Elite Care at Fanno Creek has a conditional use permit that was approved in 2005-2006. The proposed lot partition meets all requirements for the original conditional use. The only item that will change is that the eastside set back will be different, but the existing building still meets the new set back requirements. Conditional Use Chapter 18.330 CONDITIONAL USE Sections: 18.330.010 Purpose 18.330.020 Approval Process 18.330.030 Approval Standards and Conditions of Approval 18.330.040 Additional Submission Requirements 18.330.050 Additional Development Standards for Conditional Use Types 18.330.010 Purpose Purpose.The purpose of this chapter is to provide standards and procedures under which a conditional use may be permitted,enlarged or altered if the site is appropriate and if other appropriate conditions of approval can be met.There are certain uses which due to the nature of the impacts on surrounding land uses and public facilities require a case-by-case review and analysis. 18.330.020 Approval Process A. Initial applications.A request for approval for a new conditional use shall be processed as a Type IIIHO procedure,as regulated by Chapter 18.390.050, using approval criteria contained in Section 18.330.030.A and subject to other requirements in this chapter. B. Major modification of approved or existing conditional use. 1.An applicant may request approval of modification to an approved plan by: a. Providing the Director with five copies of the proposed modified conditional use site plan;and b.A narrative addressing the proposed changes as listed in subsection B.2 below. Response:Please see project narrative 2.The Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: a. A change in land use; Response:No change to the existing land use is proposed. b. A 10% increase in dwelling unit density; Response: No change to dwelling density is being proposed. c.A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; Response: No changes proposed d.An increase in the floor area proposed for non-residential use by more than 10%where previously specified; Response: No changes proposed e.A reduction of more than 10%of the area reserved for common open space and/or usable open space; Response: There is a reduction in open space on a lot area standpoint. The usable open space is not being reduced more than 10%. The open space used by residents will not change due to both new lots will be under the same ownership and will not change in its function. f.A reduction of specified setback requirements by more than 20%;Conditional Use 18.330-2 Code Update: 10/09 Response: There is a reduction in side setback to the east property line. No reduction in all other setbacks. The new eastern set back meets code requirements g.An elimination of project amenities by more than 10%where previously specified provided such as: (1) Recreational facilities; (2)Screening;or (3) Landscaping provisions;and Response:no proposed changes h.A 10%increase in the approved density; Response:no proposed changes 3. Upon the Director determining that the proposed modification to the conditional use plan is a major modification,the applicant shall submit a new application in accordance with Section 18.390.050. C. Minor modification of approved or existing conditional use. 1.Any modification which is not within the description of a major modification as provided in Subsection B above shall be considered a minor modification. 2.An applicant may request approval of a minor modification by means of a Type I procedure,as regulated by Section 18.390.030, using approval criteria in Subsection C.3 below. 3.A minor modification shall be approved, approved with conditions, or denied following the Director's review based on the findings that: a.The proposed development is in compliance with all applicable requirements of this title;and b.The modification is not a major modification as defined in Subsection A above. Response: The proposed lot partition should have no effect on the conditional use permit other than one side set back which meets the set back requirement of code requirements. D. Phased development approval.As part of the approval process,the Hearings Officer shall approve a time schedule for developing a site in phases over a period of time of one year, but in no case shall the total time period for all phases be greater than three years without reapplying for conditional use review.The criteria for approving a phased conditional use review proposal is that all of the following are satisfied: 1.The public facilities shall be constructed in conjunction with or prior to each phase. 2.The development and occupancy of any phase shall not be dependent on the use of temporary public facilities. A temporary public facility is any facility not constructed to the applicable City or district standard. 3.The phased development shall not result in requiring the City or other property owners to construct public facilities that were required as part of the approved development proposal. E.Approval period. Conditional use approval by the Hearings Officer shall be effective for a period of 1-1/2 years from the date of approval.The conditional use approval by the Hearings Officer shall lapse if: 1.Substantial construction of the approved plan has not begun within a 1-1/2 year period;orConditional Use 18.330-3 Code Update: 10/09 2. Construction on the site is a departure from the approved plan. (Ord. 09-13) Response:No phases are being proposed 18.330.050 Additional Development Standards for Conditional Use Types A. Concurrent variance application(s).A conditional use permit shall not grant variances to the regulations otherwise prescribed by this title.A variance application(s) may be filed in conjunction with the conditional use application and both applications may be heard at the same hearing. B.Additional development standards.The additional dimensional requirements and approval standards for conditional use are as follows: b. Distance shall be measured in a straight line,without regard to intervening structures, objects or roads, from the closest point of the structure or portion of structure containing the use,to the closest portion of the residential zone or property line upon which a use specified in paragraph (a)above is listed; 15. Group Living: a. Minimum lot size shall be 5,000 square feet; Response:New proposed lot will be larger than 5,000 square feet c. Minimum setbacks shall be those in the applicable zone; Response:New proposed lot will meet applicable zoning setbacks d. Height limitation shall be that in the applicable zone; Response: New proposed lot will meet height limits e. Compliance with all state requirements shall be required;and Response:New proposed lot will meet all state requirements f. Off-street parking shall be in accordance with Chapter 18.765. Response: The new proposed lot will meet all off-street parking requirements as outlined in Chapter 18.765 Group living of 1.0/room and 1.0/2.5 beds. Currently, the existing project has 17 parking spaces and a bed count of 30. Introduction The proposed lot split meets all development standards of this code section. The only change to the existing site is the new proposed lot line. This only affects the side setbacks for the east property line of the existing building. The existing building on the property currently meets the zoning set back requirement. Chapter 18.510 RESIDENTIAL ZONING DISTRICTS Sections: 18.510.010 Purpose 18.510.020 List of Zoning Districts 18.510.030 Uses 18.510.040 Minimum and Maximum Densities 18.510.050 Development Standards 18.510.060 Accessory Structures 18.510.010 Purpose A.Preserve neighborhood livability. One of the major purposes of the regulations governing development in residential zoning districts is to protect the livability of existing and future residential neighborhoods,by encouraging primarily residential development with compatible nonresidential development— schools, churches,parks and recreation facilities, day care centers,neighborhood commercial uses and other services—at appropriate locations and at an appropriate scale. B. Encourage construction of affordable housing.Another purpose of these regulations is to create the environment in which construction of a full range of owner-occupied and rental housing at affordable prices is encouraged. This can be accomplished by providing residential zoning districts of varying densities and developing flexible design and development standards to encourage innovation and reduce housing costs. 18.510.020 List of Zoning Districts D.R-4.5: Low-Density Residential District. The R-4.5 zoning district is designed to accommodate detached single- family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. R-4 Low-Density Residential District Minimum Lot Size 7,500 sq.ft. Average Minimum Lot Width 50 ft. Minimum Setbacks Front yard 20 ft Side facing street on corner&through lots 15 ft. Side yard 5 ft. Rear yard 15 ft --t Distance between property line and front of garage 20 ft. Maximum Height 30 ft. Response: Both Proposed Parcels meet the approval criteria and the zoning requirements. Side yard 10 ft. Rear yard 15 ft Distance between property line and front of 60 ft. garage Maximum Height 30 ft. Parcel 2: Parcel two will not have any buildings on site. Therefore there are no challenges to the lot requirements. 18.510.040 Minimum and Maximum Densities A.Purpose.The purpose of this section is to establish minimum and maximum densities in each residential zoning district. To ensure the quality and density of development envisioned,the maximum density establishes the ceiling for development in each zoning district based on minimum lot size. To ensure that property develops at or near the density envisioned for the zone,the minimum density for each zoning district has been established at 80%of maximum density. B. Calculating minimum and maximum densities. The calculation of minimum and maximum densities is governed by the formulas in Chapter 18.715,Density Computations. C.Adjustments. Applicants may request an adjustment when,because of the size of the site or other constraint, it is not possible to accommodate the proportional minimum density as required by Section 18.715.020.0 and still comply with all of the development standards in the underlying zoning district,as contained in Table 18.510.2 below. Such an adjustment may be granted by means of a Type].procedure, as governed by Chapter 18.390,using approval criteria in Section 18.370.020.C.2. Response: There is no change to density with this application, and the project currently meets all density minimums. 18.510.050 Development Standards A. Compliance required.All development must comply with: 1. All of the applicable development standards contained in the underlying zoning district, except where the applicant has obtained variances or adjustments in accordance with Chapters 18.370; 2.All other applicable standards and requirements contained in this title. B. Development standards. Development standards in residential zoning districts are contained in Table 18.510.2. Response:The proposed lot split meets all development standards for the R-4 zoning. Introduction:The proposed development meets this code section requirement. The proposed --� development will not be adding any trees or buffering plants. Elite Care has a full time employee that is responsible for grooming and keeping all plants healthy. Chapter 18.745 LANDSCAPING AND SCREENING Sections: 18.745.010 Purpose 18.745.020 Applicability 18.745.030 General Provisions 18.745.040 Street Trees 18.745.010 Purpose A. Purpose. The purpose of this chapter is to establish standards for landscaping, buffering, and Screening of land use within Tigard in order to enhance the aesthetic environmental quality of the City: 1. By protecting existing street trees and requiring the planting of street trees in new developments; 2. By using plant materials as a unifying element; 3. By using planting materials to define spaces and articulate the uses of specific areas; and 4. By using trees and other landscaping materials to mitigate the effects of the sun, wind, noise and lack of privacy by the provision of buffering and screening. 18.745.020 Applicability A. Applicability. The provisions of this chapter shall apply to all development including the construction of new structures, remodeling of existing structures where the landscaping is nonconforming (Section18.760.040.C), and to a change of use which results in the need for increased on-site parking or loading requirements or which changes the access requirements. B. When site development review does not apply. Where the provisions of Chapter 18.360, its Development Review, do not apply, the Director shall approve, approve with conditions, or deny a plan submitted under the provisions of this chapter by means of a Type I procedure, as governed bySection 18.390.030, using the applicable standards in this chapter. C. Site plan requirements. The applicant shall submit a site plan. The Director shall provide the applicant with detailed information about this submission requirement. 18.745.030 General Provisions A. Obligation to maintain. Unless otherwise provided by the lease agreement,the owner, tenant and his agent, if any, shall be jointly and severally responsible for the maintenance of all landscaping and screening which shall be maintained in good condition so as to present a healthy, neat and orderly appearance, shall be replaced or repaired as necessary, and shall be kept free from refuse and debris. B. Pruning required. All plant growth in landscaped areas of developments shall be controlled by pruning, trimming or otherwise so that: Landscaping and Screening 18.745-2 Code Update: 03/10 1. It will not interfere with the maintenance or repair of any public utility; 2. It will not restrict pedestrian or vehicular access; and 3. It will not constitute a traffic hazard because of reduced visibility. C. Installation requirements. The installation of all landscaping shall be as follows: 1. All landscaping shall be installed according to accepted planting procedures; 2. The plant materials shall be of high grade, and shall meet the size and grading standards of the American Standards for Nurberg Stock(ANSI Z60, 1-1986, and any future revisions); and 3. Landscaping shall be installed in accordance with the provisions of this title. D. Certificate of occupancy. Certificates of occupancy shall not be issued unless the landscaping requirements have been met or other arrangements have been made and approved by the City such as the posting of a bond. E. Protection of existing vegetation. Existing vegetation on a site shall be protected as much as possible: 1. The developer shall provide methods for the protection of existing vegetation to remain during the construction process; and 2. The plants to be saved shall be noted on the landscape plans (e.g., areas not to be disturbed can be fenced, as in snow fencing which can be placed around individual trees). F. Care of landscaping along public rights-of-way. Appropriate methods for the care and maintenance of street trees and landscaping materials shall be provided by the owner of the property abutting the rights-of-way unless otherwise required for emergency conditions and the safety of the general public. G. Conditions of approval of existing vegetation. The review procedures and standards for required landscaping and screening shall be specified in the conditions of approval during development review and in no instance shall be less than that required for conventional development. g. On-premises utilities (e.g., water and gas meters) shall not be installed within existing treewell areas; h. Street trees shall not be planted closer than 20 feet to light standards; i. New light standards shall not be positioned closer than 20 feet to existing street trees except when public safety dictates, then they may be positioned no closer than 10 feet; j. Where there are overhead power lines, the street tree species selected shall be of a type which, at full maturity, will not interfere with the lines; k. Trees shall not be planted within two feet from the face of the curb; and 1. Trees shall not be planted within two feet of any pelinanent hard surface paving or walkway: (1) Space between the tree and the hard surface may be covered by a nonpeunanent hard surface such as grates, bricks on sand, paver blocks and cobblestones; and (2) Sidewalk cuts in concrete for tree planting shall be at least four by four feet to allow for air and water into the root area.Landscaping and Screening 18.745-4 Code Update: 03/10 D. Pruning requirements. Trees, as they grow, shall be pruned to provide at least eight feet of clearance above sidewalks and 13 feet above local street, 15 feet above collector street, and 18 feet above arterial street roadway surfaces. E. Cut and fill around existing trees. Existing trees may be used as street trees if no cutting or filling takes place within the drip-line of the tree unless an adjustment is approved by the Director by means of a Type I procedure, as governed by Section 18.390.030, using approval criteria in Section 18.370.020.C.4.a. F. Replacement of street trees. Existing street trees removed by development projects or other construction shall be replaced by the developer with those types of trees approved by the Director. The replacement trees shall be of a size and species similar to the trees that are being removed unless lesser sized alternatives are approved by the Director. G. Granting of adjustments. Adjustments to the street tree requirements may be granted by the Director by means of a Type I procedure, as regulated in Section 18.390.030, using approval criteria in Section 18.370.020.C.6.b. H. Location of trees near signalized intersections. The Director may allow trees closer to specified intersections which are signalized, provided the provisions of Chapter 18.795, Visual Clearance, are satisfied. APPLICATION SUBMITTAL PROCESS All APPLICATIONS MUST BE ACCEPTED BY A PLANNING DIVISION STAFF MEMBER of the Community Development Department at Tigard City Hall offices. The Planning Division and Engineering Department will perform a preliminary review of the application and will determine whether an application is complete within 30 days of the counter submittal. Staff will notify the applicant if additional information or additional copies of the submitted materials are required. The administrative decision or public hearing will typically occur approximately 45 to 60 days after an application is accepted as being complete by the Planning Division. Applications involving difficult or protracted issues or requiting review by other jurisdictions may take additional time to review. Written recommendations from the Planning staff are issued seven (7) days prior to the public hearing. A 10-day public appeal period follows all land use decisions. An appeal on this matter would be heard by the Tigard Hearing's Officer . A basic flow chart which illustrates the review process is available from the Planning Division upon request. Land use applications requiring a public hearing must have notice posted on-site by the applicant no less than 10 days prior to the public hearing. The Urban Forestry Plan must: • Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor(the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; The street trees canopies do not satisfy the canopy requirements;therefore the Urban Forestry Plan must be coordinated and approved by a landscape architect or certified arborist/risk assessor. The plan provided is not approved by either. Please provide aplan that is approved by either a landscape architect or certified arborist/risk assessor. • Meet the tree preservation and removal site plan standards in the Urban Forestry Manual; The plan does not meet the preservation/removal standards in the Urban Forestry Manual.
