FINDINCS OF FACT 1 . Vicinity Information Adjacent properties in all directions except north are zoned I-•H (heavy Industrial) anc' contain a variety of industrial uses. The parcel imwediately to the north is zoned I-P (Industrial Park) and has recently been occupied by the operations of Power Rents Inc. , an eri, ipa it rental fir:, Several adjacent parcels to the south contain other flex-space industrial buildings also owned by Spieker Partners. The subject site along with these other paccele will be jointly managed as the Nelson Business Park. SW 72nd Avenue abutting the site is a 44-foo vide paved major collector street whi.h includes curbs ani storm sewers, but no sidewalks on either side of the streets. 2. Site Information and Proposal Description The 11.27 acre parcel presently containe ..n industrial building occupied by Williams Air Control as well as a smaller building which appears to be a vehic..e storage building on the eastern portion of the site. The western portion of the site is a vacant field which slopes slightly to the south. A paved access driveway extends across this area to the Williams Air Control parking lot. The entire site is surrounded by a chain link fence. The applicants request Minor Land Partition approval to divide the 11.27 acre parcel into two parcels of approximately 5.05 acres (220,117 eq. ft. ) and 6. 17 acres (268,593 sq. ft. ) . The 5.05 acre parcel will include the Williams Air Control buildLng. The second building will be removed. The Williams Air Control parcel .could be provided with a 30 foot wide acceso easement across the other parcel to SW 72nd Avenue. The access easement will align with SW Landmark Lane across SW 72nd Avenue from the site. An unused, existing 20- foot wide railroad easement on the site will be eliminated Spieker Partners also request Site Development Review approval to allow construction of two multi-tenant flex-apace industrial buildings of 50,960 square feet and 62,000 square feet on the 6. 17 NOTICE OF DECISION - SDR 91-0007(✓ - SPIEVER PARTNERS/WILLIAMS PAGE 1 V t acre parcel. A number of loading docks and at-grade loading doors will be provided, primarily on the south sided of the proposed buildings. Both buildings would be provided with access from a new driveway across the center of the site that will be shared with Williams Air Control. In addition, another access driveway to SW 72nd Avenue is pro-used at the southwestern corner of the site, extending along the southern edge of the property. This driveway will also provide access to one of the other Nelson Business Center buildings to the south as well as Gerber Blades to the east. 160 parking spaces would be provided including 4 designated handicapped accessible spaces distributed around the b'.ildings. A - bicycle rack also would be provided. Approximately 15 percent of the site would be landscaped in a manner consistent with the other parcels included in the Nelson Business Center to the south. 4. Agency and NPO Comments The Engineering Livision has reviewed the proposal and provided the following comments: 1. Streets: The site fronts S.W. 72nd Avenue which is classified as a major collector. The existing roadway has 44 feet of pavement and curbs on both sides; sidewalks are not currently installed and should be a requirement of development 2. Sanitary Sewer: There is an existing 10 inch public sanitary sewer line that is located in S.W. 72nd Ave and runs the length of the property. The existing line appears to have sufficient capacity to handle this development. 3. Storm Sewer: There is an existing public storm sewer line located in S.W. 72nd Avenue. This site could be serviced by this line and the line appears to be adequate to handle this development. The Tigard water District has commented that the proposed building and site modifications will be adequately served by existing water lines. However, the District notes that the buildings will need to be served by 8 inch fire sprinkler lines and a separate irrigation water meter will be necessary. The Water District requests that the applicants present the District with a more detailed water service plan. The Tualatin Valley Fire and Rescue District has commented that multiple access rcutes must be available for emergency vehicle access to the Williams Air Control building to the east. In addition, the buildings will need fire interior sprinklers. Hydrant locations should be coordinated through the Water District's reviow of the water service plan for the site. GTE has commented that the developer must bear the coat of an}' necessary relocation of GTE facilities on the site. The City of Tigard Operations and Building Divisions, PGE, Northwest Natural Gas, and NPO 05 reviewed the proposal and offered no comments or objections. Minor Land Partition Community Development Code Section 18. 162.030 contains the following approval criteria for approval of a minor land partition request: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this Code; and 5. All proposed imprcvemente meet City and applicable agency standards. The proposed partition complies with the approval criteria. Because partitioning would provide for industrial development consistent with the Heavy Industrial Plan designation applied to this area, 7artitioning is supportive of Plan purposes. No minimum lot size ie required in the I-H zone. The proposed parcels are consistent with other Code dimensional criteria applicable to newly created parcels The existing building en the site would continue to satisfy minimum building setback requirements of the I-H zone. The proposed partition therefore complies with all statutory and ordinance requirements and regulations applicable to the parcels. The final survey plat will be required to be checked for consistency with City of Tigard and State of Oregon standards for the preparation and filing of a final plat. Both parcelr will be adequately served by necessary public services or facilities. Service providing utilities and the City of tigard Engineering Division have not reported any problems related to the provision of necessary services to expanded development of the site. Both parcels would have mere than the minimum 15 foot wide of frontage or an access easement to a public street as is required for lets created through the partition process. The total width of the access easement to the Williams pa --el ranges between 30 and 40 feet thereby exceeding the minimum access width requirements of Code Section 18. 108.070.A. A sidewalk will reed to be installed along the site's SW 72nd Avenue front age. 2. Site Development Review The proposal for construction of the two multi-tenant industrial buildings on the 6. 17 acre parcel conforms with Community Development Code I-H (Heavy Industrial) zoning district requirements for building setbacks from property boundaries; with the maximum permitted building height (45 feet maximum allowed; 32 feet maximum building height proposed) ; with maximum permitted site coverage (85 percent maximum allowed - slightly less than 85 percent coverage proposed) ; and with the mirimum site landscaping standard for the 3 NOTICE OF DECISION - SDR 91-000Y- SPIERER PARTNERS/WILLIAMS PAGE 3 • S zona (15 percent minimum landscaping - slightly more than 15 percent landscaping provided) . All future uses occupying the buildings will need to be permitted uses in the I-H zoning district. Proposed site Improvements comply with Community Development Code requirements for street trees, parking area landscaping, access and internal circulation, vision clearance at driveway/roadway intersections, and provision of necessary public services (water, sewer, storm sewers) for the proposed development of the site. The site plan provides an adequate number of parking spaces to comply with Code standards for warehouse and manufacturing uses that are the most likely future uses of the buildings. A minimum ratio of one parking space per 1,000 square feet of building area is required, with 1 space per 700 square feet of public serving area required for warehouse uses. 160 parking spaces are proposed for the approximately 113,000 square feet of building area to be constructed. The plan also provid"s for an appropriate number of designated handicapped parking spaces as required by the Oregon Revised Statutes (4 required; 4 provided). A bicycle rack is proposed within the paved area on the south side of proposed building C. It is recommended that the rack be relocated to an area that would be better protected from motor vehicles. The plan provides for further connections amongst the various Nelson Business Center parcels, Williams Air Control, and Gerber Blades industrial uses. The connections will provide for improved emergency vehicle access to all the buildings. Reciprocal access easements should be recorded for all shared driveways, if not already provided. C.
