construction first and second floor loyby, and plan revie% by Will Dodge, dated
February 27., 1984, the `ollowino is a -esponce to those items mentioned earlier, in
an attempt to obtain the building permit for Two Lincoln Center.

This arrargement, that is dis•_harging the main stairway ibe into the entrance
hbuto-
space, is permissible because the entire first story protected by an
matic sprinkler system. Reference is made to the exception under Subsection (d)
of Section 3309 of the 1982 edition of the Uniform Building Code.
Eased upon total floor area of all stories, the prescribed and calculated "fire
flow" for th': building is approximately 3,300 gallons per minute; far in excess of
the maximum 3,000 gallons permitted under SJbsection (g) of Section VII of
0rdineoce 83••1 o' Washington County Fire District No. 1 . As a result and through
the tforementicned negotiations it has been agreed that the Entire buiding will be
p.•ov•ded with a complete smoke detection system which will be electrically supervised
and sntertied with the Fire Alam Center of Washington County Fire District No. 1 or
ar approv:d remote. station. This "built-in" form of fire protection will reduce the
required f ,re flow by 25 perc 'nt to a total of roughly 2,500 gallons per minute;
well within tr•e prescribed 3,000 gallons per minute limit.

The finish hardware schedule as contained in the specifications may have
adequately provided For this requirement. We mention the requirement because
we have no Sergeant Builder's Hardware Catalog or guide which adequately

Your preliminary plans for the interior development of the second and
third stories of this building which we discussed on December 14 have
been reviewed 4ith the Washington County Building Official , Mr. Tim
Tyler. We both agree that the exiting arrangement as shown is acceptable
even though technically it does not conform to the strict letter of the
code. That is, the separation shown is by means of travel distance
through the peninsula effect (for lack of a better term) resulting from
the ^figuration of the floor plan in each suite.
The automatic sprinkler protection which will be installed throughout
this building constitutes a Superior degree of fire protection and
safety which we feel , in this particular instance, justifies a variance
from the rigorous application cf the regulations.
Specifically, we feel that modification of the rules in this case is
in conformity with the intent, spirit and purpose of the code and does
not lessen any fire protection requirement or any degree of .t-uctural
integl ity.
On the other hand, it must be understood that this dispensation does
not constitute the establishment of e precedent upon which to base
future plans for interior development in this or any other building.
It applies only to the drawings which we discussed and we are retaining
for future reference until final working drawings and specifications

Concerning the drawings which accompanied your letter of transmittal dated
November 14, 1984, which was directed to Mr. Perry Coleman, the installation
of the storefront assemblies in corridor 107 is not permissible!
Lobby 100 and elevator lobby 106 must be completely "fire isolated" from
corridor 107, south entry 116 and stairway no. 1 . That is, the two stair-
ways must be completely separated one from the other. The installation
of the storefront assemblies compromises this separation. The interior
walls of south entry 116, corridor 107 and stairway no. 1 must he two-hour
fire-resistive and exit doorways (the only permissible openings) which
open into these spaces must have a rated and labeled fire resistance of
1-1/2 hours and a maximum traosmitted temperature end point rating of
450 degrees above the ambient at the end of 30 minutes of fire exposure.
This requirement also applies Li, doors 115 and 118 which, according to
the drawings, are intended to serve the delicatessen.
All doors o�:enng into either stairway enclosure must be self-closing
and latching or automatic closing and latching and in the latter case
activated by a smoke detector at or near the opening.
The foregoing issues were discussed with Mr. David Welsh of yoir firm on

The pli-s for the installation of the automatic sprinkler protection of
the hu' lding, the plans for the Class 1 standpipe system and the plans
for the deluge sys`em which will cover the first and second stores of
the lobby area have been examined.
Referring to sheet 8-7, titled "Penthouse Detail,'' the standpipe outlets
on the roof must he three way as is shown on sheet 3 which is titled
"Standpipe Detail ."
For the purposes of memory refreshment (most notably mine), the entire
fire suppression system must be electrically supervised and must be
intertied with the fi e alarm center of Washington County Fire District
No. 1 or an approves central station such as American District Telegraph,
Honeywell , etc.
The deluge system must be activated by smoke detectors located throughout
the lobby area. A combination of two detectors must activate the system;
that is, one to detect and the second to verify. Plans for this smoke
detection system must be submitted to and approved by representative of
this office priur to its Installation.
Subject to i.t,e foregoing ' :urments end stipulations, the plans urder
discussion are hereby approved. We have retained one copy of each
drawing for the public record, the remaining copies, bearing our stamp,
are being returned to you under separate cover.

Although I don't recall mentioning it in our telephone conversation of
December 5, doer assembly nos. 111 and 119, .ince they open into the
ext^nsion of the stairway enclosure, must in addition to having a -1/2
hour fire-r"sistanc€ rating have a 450 degree temperature end point rating
at the end of 30 minutes of fire exposure. For your further information
regerding this, your atteriion is invited to Subsection (c) of Section 3309
of the Uniform Building Code.
One other issue which should be clarified is with reference to the i'inish
har•da.are provided by the door supplier. Cxclesive of•the doors on the
extericr of the building, ail doors must he openahle from the inside
at all tinF, for irrtuediate exit wittout the use of a key, s;retial know-
ledge nr effort. Keyed deadlocks, manually-operated flush bolts, edge
bolts and similar restraining devices are prohibited.

Confirming our telephone conversation of November 15 1 have received your
letter of transmittal dated November 12 and directed to Mr. E. Carl Schiewe
relating to the revised location of the water heater. That is, the
accompanying drawings '-hew that the water heater will be located within
a rc.nm which opens into the stairway enclosure of st ° r no. 2. This is
not permissible!
Exit enclosures must have no openings other than exit doors. This is
why we made such an issue of the HVAC systom in the case of the main
entrance/exit lobby.
Further, stairway enclosures and their extension (i .e. the main entrance
lobby) must be substantially clear of any cnmhusrible material which
would ccnstitute a fuel load. ' make this comment in reference to the
location of some sort of deliratessen or other eatery in the lobby space.
In the future, when it comet to massing around with the stairway
enCTnsu s please touch hasp with me before proceeding.

Confirming cur conversation of February 13 during the inspection of con-
struction in progress at this occupancy with respect to door a,semb'y no.
110; the south entrance/exit door. I observed this door assembly to be
in place. It consists of a pair of leaves with key-operated deadlocks
at the foo: of each leaf.
Please refer to your records for this project which will contain our
Plan! Examination Report No. 1520. I respectfully direct your attention
to item no. 8 thereof in which we prescribed that exterior exit doers
may he fitted with keyed deadlocks only if they are of the indicating
type (being readily distinguishable as being locked when in the locked
position), etc. , etc.
It also should be noted that where exit door assemblies contain pairs
of leaves , when the "active" leaf is unlocked the other lea` must he
free to swing. That is, only unc locking device may be employed for
each pair of doors. We touched on this briefly in our letter of
December 6, 1984, which was directed to Mr. Harry Dinihanian of your
firm. Also, on December 11 we v,rote a letter to Mr. Dinihanian complain-
ing of change orders and addendums to the cortract documents being issued
without first having them cleared through the Washington County Building
Department and this offs:e. Subsequently, and with a copy of his letter
of transmittal dated December 13 we received, among other things, a re-
vised door finish schedule which contained no finish hardware schedule
for door assembly no. 110.

Oar district inspector for the area in which this project is located has
been performing most of the construction 'nspections and has -orae to me
with a concern regarding the installation of the fire dampers installed
at mechanical shaft penetrations and in corridor walls. As a result, I
(rade an onsite inspection of the project on February 13 and have come

Iii the first instance, fire damper assemblies installed in walls must be
so secured that, the duct work on either side may fall away without dis-
locating the fire damper assembly. From my inspection I `ail to see how
these fire dampers are secured to anything of substance and it appears
that they will merely be friction fit in the gypsumboard shaft wall .
Another concern I have is ttat apparently the workmen on the job are
nut conversant with the appr;ved plans. I found two instances where thre
exitway enclosures have beer penetrated by HVAC duct work contrary to
the approved plans and in violation of the regulations re',ating to the
protection of enclosed stairways. You will recall that this was a major
protlem during the course of developing the HVAC system plans.
Accordingly, by way of this lett.er,we are requesting that you provide
detailed drawings chowinq the proper manner for securing fire damper
a .:,emblies in rated walls and partition.z to the mechanics en the job

Reference is made to the memorandum of December 13, 1984. As I mentioned
in our telephone conversation today a copy of the 30 X 42 arch blue line
print of the first floor lobby and south entry revision was not included
in the packet which contained cur copy of the memorandum. We need one
copy of the print for tie public record.
Incidentally, the first floor door finis'i schedule dated 12-13-84 which
accompanied the memorandum shows that door assembly nos. 113 and 114 will
be l-1/2 hour fire rated. Since these door assemblies are located in the
first stet._ storefront scheme and will be covered by the deluge system,
no fire-resistance rating is rt. iuired.
Anyway, 1 will be looking forward to receiving the aforemfntioned and
reque!rP print. If you have a questios please let me know.

to currently applicable fire safety regulations.

at this location. Apparently they were overlooked with respect to the

To confirm our telephone I:onversation of the afternoon of January 6, 1984.
[his office and Wilburn Dodge of Washington County Fire District #1 have agreed
to accept the proposed construction of the first and second floor lobby area as
an acceptable alternate to the requirements of Section 3309 for stairway enclosures,
subject to all of the following listed items.
1 ) The first story is fully protected by an automatic sprinkler system.
2) The second story with a common atmosphere to the first story lobby is fully
protected by an automatic sprinkler system.
3) The first and secono story relights opening from interior tenant areas to the
lobbj are in fixed frames and are protected in each instance by a deluge type
sprinkle► system, automatically operated by a smoke dctecticn system. The
sprinkler system must be on each side of every opening.
4) All HVAC ducts which penetrate walls or ceilings in the lob!ly or in areas
having a cannon atmosphere with the lobby mus be fire darnperod.
r) Openings other than doors are not permitted in corridor No. 107 which is to be
rnaint-ined as 3 stair enclosure.
6) The opening between lobby No. 106 and Corridor No. 107 must be a smoke and
draft control door assembly having not less than a 1-15 hour-fire-resistive
rating having a maAlmun transmitted temperature end point of not less than
45cP F. above ambient at the end of 30 minutes of tho fire exposure specified
in U.B.C. Standard Nu. 43-2. The doors are to be automatic clo:ing, activated
by smoke detectors located on both side7. of the door opening.

2) Frit doors to the public corridor shall have a fire-protection
rating of not less thar 20 minutes, and have a tight-fitting smoke
and draft-contrn1 assembly. Doors to be sell-closing or automatic
closing.
3) Doors must be fit tea with a type of locking or latching device 1 .1
which will permit the opening of the door from the inside without
the use of a ke.y, special knowledge or effort, except that exterior e
exit doors may be Fitted with a keyed locking device which is
readily dictinguistsble as locked and there is a readily visible,
durable sign on or adjacent to the door stating this door to remain
unlocked during business hours.

The plans for this tenant improvement project which we understand will be
located in the third story have been examined with respect to fire safety
requirements. Listed as follows are issues which must be addressed and
resolved during the course of development and for which we found no pro-
visions on the submitted drawings.
1 . Automatic Fire Protection: The al.tomutic sprinkler
system must be extended—and modified to prov hle full
coverage for the project space. No ceiling-moLnted
automatic: sprinkler head may be located closer *. 'an
1 foot nor more than 9 feet from any wall , partitnnn
or similar bulkhead.
2. Materials of Construction: All materials, ov construc-
tfo1 must be noncclilbustfble.
3. Public Corridor Protection: The public corridor must
be fulTy T`fTre isorated'Trom the remainder of th.2
building by construction having a one-hour fire-resistar.;e
rating. the access openings into the public corridor and
elevator lobby must be protected by self-closing and
latching smoke and draftstop door assemblies having a
rated and labeled fire resistance of not less than 20
minutes. Gaskets must be provided where the doors meet
the stops 3n both sites and across the top.

4. lnsprctions: Inspe,_tion and approval of construction by a
representative of this office is requ•red:
a) prior to the cover of any new framing elements
following the installation of all utility runs
which will be concealed within wall and partition
cavities.
b) prior to cccupancy of this suite by personnel of
the Prudential Insurance Company.
5. Retention of Plans: The drawings on file at the Washington
County I3uiTding Department have been modified to conform to
the drawings which accompanied your letter of May 30, 1985.
The plans have been given conditional apprrval based partly
upon these modifications. One set of approved plans bear-
ing the stamps of the Washington County Building Department
and this office must be maintained on the project site
throughout all phases of construction and must be made avail-
able to building and fire inspectors for reference during
required construction inspections.
6. Certificate of Occupancy: Prior to the occupancy of this
project space by any member of the personnel staff of
Prudential Insurance Company, a Certificate of Occupancy or
other written instrument of approval must be obtained from
the i+ashington County Building Department.
Subject to the foregoing stipulations, the plans under discussion are hereby
approved. I hope this letter will assist in clearing the way for the further
development of the project. If I can be of service in any other way, please
let me know.

The pans for this tenant improvement project have been examined with
refere'tce to the currently applicable regulations of this jurisdiction
and have been conditionally approved subject to the foll9wing stipula-
tions.
The main entrance/exit door assembly to the suite which opens onto
the stair/mezzanine must have a rated and labeled fire res 'sAnce of
not less than 90 minutes and a telperatere end point ratirrj of nor. to
exceed 450 degrees above the ambient ager 30 minutes of f re exposure.
These ratings nest appear on the door and frame labels .
All doors shown on the drawings must he op.nable from ,he inside at all
times for immediate exit witho,,t t-e use of a key, special knowledye
or effort.
The materials of construction must hn non.oribustib1e ani inspection and
approval of constr-u.tion b;; a reprr-sentative of this office is required
