SITE LOCATION: East side of SW 97th, approximately 200 feet south of
SW McDonald. (Wash. Co. Tax Map 2s1 1113A, Tax Lots 100,
106, and 107)
REQUEST: Approval of a Subdivision for ten (10) single family dwelling
units in an R-7 single family zone.
PREVIOUS ACTION:
The City Council approved a Zone Change from Washington County RU-4 to
City of Tigard R-7 "Single Family Residential" on 7,500 square feet.
(Ref. Ord, 70-41)
FINDINGS OF FACT:
1. The applicant is requesting preliminary plat approval in accordance
with Section 17.05.010 of the Tigard Municipal Code to subdivide
a 2.4 acre parcel into ten (10) lots with a minimum lot size of
7,500 square feet, four (4) dwelling units per acre maximum density.
2. Applicable policies from the NPO k6 Plan are as follows:
Policy 2. The maximum overall density of development will be four
(4) dwelling units or 12 persons per gross acre. This
amounts to a standard of 7,500 square feet of land per dwelling
unit allowing for streets and other open space. Some area3 will
have a lower density owing to topography, existing development patterns,
or the desire of individuals L. own a larger lot.
Policy 3. Residential subdivisions will be developed with paved
streets, curbs and gutters, street lights, and walkways,
according to City standards. All utilities will be placed underground.
Policy 4. Development will coincide with the provision of puolic
streets, water and sewerage facilities. Theses facilities
shall be (a) capable of adequately serving all intervening properties
as well as the proposed development, and (b) designed to meet City
standards.
3. Section 17.06.065 of Tigard Municipal Code states that:
"No preliminary plat for a proposed subdivision and no map or major
partition shall be approved unless the Planning Director finds:

(1) Streets and roads are laid out so as to -onform to the plats
of subdivisions or maps of major partitions already approved for
adjoining property as to width, general direction raid in all other
respects, unless the City determines it to be in the public interest
to modify the street or road pattern.
(2) Streets and roads held for private use are clearly indicated
an the tentative plan and all reservation or restrictions relating
to such private roads and streets are set forth thereon;
(3) The preliminary plat complies with the Comprehensive Plan,
the applicable zoning regulations, and the .egulations within th).s
title.
(4) There will exist adequate quantity and quality of water and
an adequate sewage disposal system to support the proposed use of
the land described in the proposed plat.
4. The site is wooded, sloping to the west and there is a single family
residence currently an the bite. Adjacent property is similiar
in nature, consisting of homes located on one acre and two acre
tracts of land. Preliminary plats have been approved by the City
for some of the neighboring properties. Elrose Terrace and Penrose
Terrace are single family subdivisions located east of the site;
Ingebrand Heights lies to the west.
5. Sewer service is presently not available to the site, however, the
City has hired a consulting engineer to design a system that will
bring sewer service to the site as well as to the other developments
in the immediate area. An LID has been formed. The applicant has
signed the petition for a LID Mr public improvements. Water will
be available from the Tigard Water District.
6. A storm drainage plan was not indicated on the preliminary plat.
7. A dedication of five (5) feet along SW 97th will be necessary to
allow for a fifty (50) foot right-of-way. The preliminary plat shows
a twenty-five (25) foot half-street dedication on the southern edge
of the property. Eventually, SW Mountainview which presently lies
to the west, will connect to this dedicated street. When development
occurs an the adjoining property to the south, a twenty-five (25)
foot half-street dedication will be required to allow a fifty (50)
foot right-of-way for the proposed continuation of SW Mountainview.
CONCLUSIONARY FINDINGS:
1. The proposed plat conforms to the NPO 016 Plan for use as residential
development.
2. Water and sewer will be available to the site.

3. The project has been reviewed by the Tigard School District and
approved.
4. The narrative submitted with the preliminary plat discusses a storm
water drainage system. The plans for this shall be submitted and
approved by the Public Works Department.
5. Dedications for the access streets shown on the preliminary plat
must be made to the City. These streets shall be developed to local
street standards. Improvements shall also be made to the portion
of SW 97th which fronts the site.
STAFF RECOMMENDATIONS:
Staff recommends approval subject to the following conditions:
1. No Occupancy Permits shall be issued until all conditions placed
upon this development by the City of Tigard have been satisfied and
inspections l'erifying this have been carried out by the appropriate
department.
2. No changes will be made to approved plans of specifications unless
formal application is made to the appropriate City department, and
changes are approved by that department. Application for changes
will be made in writing and shall include applicable drawings.
3. All public improvements shall be design approved and constructed
through the Local Improvement District process of the City of Tigard
to City standards.
4. All existing and proposed utilities shall be placed underground.
Street lighting installations shall be approved by the Public Works
Department.
5. A metes and bounds legal description and map shall accompany a dedication
of public rights-of-way, and shall be prepared by a registered engineer
or land surveyorer.
6. All streets and parking areas shall be concrete or asphalt. All
sidewalks shall be concrete.
7. No Building Permits shall be issued until the expiration of the twenty
(20) day appeal period from the date of approval or prior to the LID
process for all public improvements have sucesefully passed the
public hearing stage and .he district has been formed.
8. A storm water drainage plan shall be submitted for Public Works
Department approval. Water service and sanitary service and storm
sewers shall be installed prior to the issuance of Building Permits.
9. The preliminary plat shall be reviewed by the Fire Marshall.

The Tigard Water t)istric+. can provide the miniaium State of Oregon water

1 It is the policy of the Tigard Water District to serve water to
any property within the district boundary; property owners pay
the pipe, construction, and meter costs.
The district buys most of its water from the City of Lake Oswego
(Clackamas River) and itb availability to supply is subject
to a mutual agreement.

Nature of Proposal
This site currently consists of three separate tax lots with
a total of 2. 40 acres. One single-family residence presently
exists on the site. Adjacent property is similar in nature,
consisting of homes located on one-acre and two-acre tracts of
land. However, preliminary plats for some of the abutting
properties have been suimit'ed to the City for approval.
Additionally, Elrose Ternice and Penrose Terrace exist to
the east of the site; Inyebrand Heights exists to the West.
Each is a residential , single-family lot subdivision.
The development plan calls for residential , and the existing
zone is R-7 . The R-7 zone in the City of Tigard is residential
in nature, with a minimum lot size of 7,500 square feet. This
preliminary plat proposes subdivision of the 2 . 4 acres into
ten lots with an average size in excess of 8 ,000 square feet.
No variances are being requested. The layout does include
two flag lots, which are adjacent and include the minimum ten-
foot access adjacent to one another.
Impact
No change in zoning or Comprehensive Plan is being requested.
Therefore, the impact is that anticipated when the area was
designate) residential by the City. Direct social and physical
environmental impact of approving the proposed subdivision
would be a potential of nine families added to the community
and their needs for public and quasi-public services.
Public Services
This property slopes approximately 6% northerly. No formal
drainage system currently exists on or adjacent to the site.
However, drainage will be ac-'omplished by construction of a
public storm sewer system as property develops by means of
private funding or formation of local improvement district.
Water is available from the Tigard Water District by means of
a 6-inch main on the east side of S.W. 97th Avenue. Tigard' s
Comprehensive Plan shows S.W. Mountain View Lane being extended
th1ough this site, which is reflected on the preliminary plat.
Sanitary sewer is not presently available to the site. However,
the City has retained an engineering consultant to design a
system that will provide sewer for the development of this area.
