Heliports,medical centers, religious institutions, and utilities are allowed conditionally. Developments in the C-P zone are intended to serve as a buffer between residential areas and more intensive commercial and industrial areas. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapters 18.410 and 18.765 MMD2019-00009 IMMUNOLOGY CONSULTANTS LABORATORY Page 1 of 4 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The applicant is proposing site upgrades to meet Americans with Disabilities Act (ADA) parking requirements at 7150 SW Sandburg Street. Specifically, two ADA parking stalls will be relocated, one ADA loading aisle will replace one undesignated parking stall, and one ADA loading aisle will replace one truck loading stall. The approximately 34,742 square foot office building is located north and east of SW 72nd Avenue, and also located south and west of SW Sandburg Street. The site improvements are in preparation for Immunology Consultants Laboratory (ICL),which will be a non-medical office use.The previous tenant was Progressive Insurance, which was also an office use, and no change of use is occurring. Office uses are allowed in the C-P zone. No changes to the building facade, footprint, or landscaping are proposed. A site plan from a site development review in 1991 (SDR1991-00019) shows that 123 parking stalls were approved for the site, which included four (4) ADA parking stalls. Four (4) truck loading stalls were approved to be located beneath the south side of the building footprint. The site plan from 1991 shows that the four ADA approved parking stalls were located east of the building.No minor modifications for this site have occurred since the site development review in 1991. At some point prior to the submittal of this minor modification, the four approved ADA parking stalls from 1991 were converted into undesignated parking stalls, and four undesignated parking stalls on the north side of the building were converted to ADA parking stalls. In addition, one undesignated parking stall south of the building was converted into an ADA parking stall prior to the submittal of this minor modification, and two new parking stalls were created on the northwestern portion of the lot.This review will focus on the proposed relocation of two ADA parking stalls and the conversion of one undesignated parking space and one truck loading stall into two ADA loading aisles. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.410 Off-Street Parking and Loading 18.410.040 General Design Standards F. Accessible parking. All parking areas must include the required number of accessible parking spaces as specified by the state building code and federal standards. Such parking spaces must be sized,signed,and marked as required by these regulations and in compliance with ORS 447. In order to meet ADA standards, the applicant is proposing a change in location for two ADA parking stalls and the removal of one undesignated parking stall and one truck loading stall for ADA loading aisles. As required by ORS 447,a minimum of five ADA parking stalls are required to be present on site because the reconfigured parking lot will contain 125 parking stalls. According to the proposed site plan, MMD2019-00009 IMMUNOLOGY CONSULTANT'S LABORATORY Page 2 of 4 five ADA parking stalls will be present on site.The proposed ADA parking stall and aisle dimensions on the site plan and supplemental documents meet the parking space dimensional standards in ORS 447.233.2.b, c,and d. This criterion is met. 18.765 Modifications: 18.765.060 Minor Modifications D. Approval criteria.The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; A minor modification is required because the applicant is proposing to remove parking spaces in order to meet ADA standards. The applicant is proposing a change in location for two ADA parking stalls and the creation of two ADA loading aisles in order to be compliant with ADA standards. Specifically, two undesignated parking stalls on the north side of the building will be converted into one ADA parking stall and one ADA loading aisle. One existing ADA parking stall on the north side of the building will be restriped to become an undesignated parking stall.Two existing truck loading stalls underneath the south building facade will be converted into one ADA parking stall and one ADA loading aisle. One existing ADA parking stall on the south side of the building will be restriped to become an undesignated parking stall.The new ADA stall and loading aisle located underneath the south façade will be repaved to achieve a 2%minimum slope. After the proposed modification to the parking lot,there is no net change in the number of ADA parking stalls.There is a net loss of two truck loading stalls as one will become an ADA parking stall and one will become an ADA loading aisle. There is a net loss of one undesignated parking stall for the creation of an ADA loading aisle. After the parking lot modifications, there will be a total of 120 undesignated parking stalls, five (5) ADA parking stalls, and two (2) truck loading stalls. The new tenant of the approximately 34,742 square foot building is Immunology Consultants Laboratory (ICL), which is a non-medical office use. Staff finds that a minimum of 94 parking spaces are required for a non-medical office. After the parking lot modifications, there will be a total of 125 parking stalls and two (2) truck loading stalls on site. Five of the 125 parking stalls will be ADA parking stalls. Staff finds that 31 additional parking spaces above the minimum requirement are provided on site. This criterion is met. 2. If the proposal involves the modification of a condition of approval,at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed;or c. A new or modified condition better accomplishes the purpose of the original condition. This criterion is not applicable because the proposal does not modify a condition of approval. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Tide. PROCEDURE AND APPEAL INFORMATION Final Decision: A minor modification is a Type I procedure.As such, this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first.
