The C-P zone is designed to accommodate civic and business/professional services and compatible support services, e.g., convenience retail and personal services, restaurants, in close proximity to residential areas and major transportation facilities. Heliports, medical centers, religious institutions and utilities are permitted conditionally. MM1)2018-00008 Pape Group 1 Developments in the C-P zone are intended to serve as a buffer between residential areas and more-intensive commercial and industrial areas. I-P: Industrial Park Zone. The I-P zone provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor, vibration, are permitted in the I-P zone. In addition to mandatory site development review,design and development standards in the I-P zone have been adopted to ensure that developments will be well-integrated, attractively landscaped, and pedestrian-friendly. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.780.050.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to a conditional of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF BUILDING PERMITS: The applicant shall prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to the PLANNING DIVISION,ATTN: LINA SMITH (503)718-2438 or LinaCS@tigard-or.gov.The cover letter shall clearly identify where in the submittal the required information is found: 1. Prior to issuance of building permits, the applicant shall record the ingress and egress easement across 6975 SW Sandburg Street (WCTM 2S101DD,Tax Lot 101), and submit a recorded copy to the city. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject properties are 6955 SW Sandburg Street (WCTM 2S101DD, Tax Lot 401), 6975 SW Sandburg Street (WCTM 2S101DD, Tax Lot 101), and 7000 SW Sandburg Street (WCTM 2S101DD, Tax Lot 100).The properties are located north and east of SW Sandburg Street;east of SW 72"d Avenue, and west of Highway 217. Tax Lot 100 is currently occupied by a wholesale sales use (Pape Group),and is zoned Industrial Park (I-P). Tax Lot 101 is currently occupied by an office use, and is zoned Professional/Administrative Commercial (C-P) and I-P. Tax Lot 401 is currently occupied by a light industrial use, and is zoned I-P. The applicant intends to purchase Tax Lot 401, and change the use to wholesale sales. MMD2018-00008 Paye Group 2 SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification to three(3) existing properties:6955 SW Sandburg Street (WCTM 2S101DD,Tax Lot 401), 6975 SW Sandburg Street (WCTM 2S101DD,Tax Lot 101),and 7000 SW Sandburg Street (WCTM 2S101DD,Tax Lot 100). The applicant currently owns Tax Lot 100, and intends to purchase Tax Lot 401. The applicant proposes to construct a new concrete ramp that will provide a connection for forklifts to be transferred between Tax Lots 100 and 401. This ramp will cross over Tax Lot 101,which is owned by a separate entity(Weston Investment Company,LLC).Accordingly, staff has included a condition of approval for the applicant to record an ingress and egress easement across Tax Lot 101,prior to issuance of building permits. The applicant proposes to remove landscaping from Tax Lot 101 (271 square feet),and Tax Lot 401 (145 square feet),in order to accommodate the new concrete ramp. The minimum landscape requirement for the C-P Zone is 15 percent,and the minimum landscape requirement for the I-P Zone is 25 percent.The subject properties will continue to meet the minimum landscape requirements for the C-P and I-P Zones, with 34 percent provided on Tax Lot 101,and 26 percent provided on Tax Lot 401.This criterion is met. The applicant proposes to remove four (4) parking spaces from Tax Lot 401, in order to accommodate the new concrete ramp, and a new overhead door on the northern façade of an existing building. Additionally, the applicant is proposing a change of use on Tax Lot 401 to wholesale sales, which is permitted by right in the I-P Zone. These modifications impact off-street parking requirements; accordingly, the table below calculates minimum off-street parking for each of the three (3) properties, based on the requirements in CDC Table 18.310.2. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met.This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in MMD2018-00008 Pape Group 3 compliance with the applicable requirements of this Title. SECTION V. In short, here's a few details that may help: * I didn't get the owners signature form the 6955 building because we would own the building if we were to proceed with the ramp. • This application is strictly to verify that the city would allow us to build the ramp. If we can't, then there's no use purchasing the building.... So, an early approval would be ideal, as I'm currently trying to extend my due diligence period, but time is of the essence... * I would secure a permanent easement before closing on the property, but I haven't gone that far yet as I need to verify that you guys will let us put it in. • As far as parking spaces, I can get a count, and also adjust the ramp size and location to some degree... o I was unclear when I said it would take a parking spot from the 7000 building... It would actually be on the 6975 property, but it's used by the 7000 facility... 2 o The ramp only needs to be 8' wide, so it shouldn't take more than one on the north side, and I don't think it's designated as parking on the 6955 lot.. If it is supposed to be parking spots in that location, then the ramp would take one from that lot as well. LLC, an Oregon limited liability company("Grantor") is the owner of a parcel of real property in Washington County, Oregon ("Grantor's Property"). The legal description of Grantor's Property is set forth on Exhibit A attached hereto. B. Pape Properties, Inc., an Oregon corporation ("Pape") is the owner of a parcel of real property in Washington County, Oregon ("Pape's Property"). The legal description of Pape's Property is set forth more particularly on Exhibit B attached hereto. C. TD Properties LLC, an Oregon limited liability company("TD") is the owner of a parcel of real property in Washington County, Oregon ("TD's Property"). The legal description of TD's Property is set forth more particularly on Exhibit C attached hereto. D. TD's Property is adjacent to, and north and west of, Grantor's Property, and Pape's Property is adjacent to, and south of, Grantor's Property. E. TD and Pape may be referred to collectively herein as "Grantee," and TD's Property and Pape's Property may be referred to collectively herein as "Grantee's Property." F. The location of the Easement Area is shown on Exhibit E attached hereto. Now, for good and valuable consideration, the receipt and adequacy of which is hereby acknowledged by the parties, the parties agree as follows: Agreement 1. Creation of Ramp Easement; Location. Grantor hereby grants Grantee an easement for Grantee to construct, use, maintain, repair, and replace a ramp on Grantor's Property (the "Ramp") within the Easement Area(the "Easement"). The Easement Area is fifteen (15) feet wide, and the Ramp may be up to ten(10) feet wide, substantially centered within the Easement Area. The Ramp may be used for(i) vehicular and pedestrian crossing, ingress, and egress, and(ii)transportation of equipment,materials and supplies over and across Grantor's Property to, from, and between, TD's Property and Pape's Property, including (without limitation)the use of one or more forklifts, and for vehicular and pedestrian crossing. 2. Use and Purpose of the Easement. Grantee, and all future owners of Grantee's Property, and their agents, independent contractors and invitees, shall use the Easement only for the construction, use, maintenance, repair, and replacement of the Ramp for the benefit of Grantee's Property. 3. Type of Easement. The Easement is an easement appurtenant, running with the land for the benefit of both TD's Property and Pape's Property, and is not an easement in gross. 4. Duration of the Easement. The Easement shall be perpetual and shall inure to the benefit of Grantee, Grantee's successors in interest, and all future owners of Grantee's Property, whether or not TD's Property and Pape's Property are held in separate or common ownership. 5. Acceptance of Terms: Deed. This Agreement shall run with the land. By acceptance of the deed to their property, future owners of Grantee's Property and Grantors' Property become parties to and are bound by the Easement and the terms of this agreement whether or not expressly stated in their deed. 6. Maintenance and Repair of the Ramp. Grantee agrees to maintain and repair the Easement Area and the Ramp in good condition and in compliance with all applicable laws and regulations at Grantee's sole expense. All maintenance and repairs shall be completed within a reasonable period of time, lien free, and in good and workmanlike condition. 7. Costs and Expenses. Grantor shall have no responsibility for or be obligated in any way to pay for any costs of installation, maintenance or repair of the Ramp or the Easement Area. Any damage to Grantor's Property due to the installation, maintenance, repair, use or presence of the Ramp will be the sole responsibility of Grantee. 2 - EASEMENT AGREEMENT PDX\11658 I\241537\DHE\23793633,4 8. Indemnity. Grantee agrees to save, protect, indemnify, forever release, defend and hold harmless Grantor and Grantor's Property from and against any and all claims, causes of action, losses, damages, suits and liabilities of every kind, arising out of, having to do with, or related, directly or indirectly, to any use of Grantor's Property by or under Grantee, including all expenses of litigation, court costs and reasonable attorneys' fees, and to pay off and discharge all expenses, fines, liens, claims, demands,penalties, natural resource damage assessments, damages, and liabilities of whatever character or description affecting all parties and Grantor's Property arising out of such use by or under Grantee. 9. No Unauthorized Uses; No Assignment. Grantee may not use the Easement for any other purpose except specifically described herein unless Grantee's proposed additional use has first been approved in writing by Grantor,and Grantee shall have no right to assign the Easement rights granted hereunder to any third party without first obtaining Grantor's written consent thereto. 10. Notice.
