The C-G zone is designed to accommodate a full range of retail, office,and civic uses with a city wide and even regional trade area. Except where nonconforming, residential uses are limited to mixed-use developments.A wide range of uses,including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers,major event entertainment, and gasoline stations, are allowed conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The applicant is proposing a change of use from industrial services to personal services at 11572 SW Pacific Highway. The approximately 1,944 square foot tenant space is located south of Pacific Highway, east of SW 72'd Avenue, north of Red Rock Creek, and west of SW 68th Parkway. No exterior modifications are proposed. The approximately 2.03-acre site is made up of two tax lots (tax lot 1S136DA01000 and 1S136DA00901), two buildings, a freestanding bathroom facility, and 44 parking spaces.The property is located in the General Commercial (C-G) Zone. The property owner confirmed that the first tenant located at 11572 SW Pacific Highway was Mark 50 Machinery in the mid 1950's. The property owner is confident that Mark 50 Machinery manufactured and sold sawmill equipment,which is an industrial services use.No minor modifications for a change of use were ever recorded for 11572 SW Pacific Highway, however a minor modification in 2013 (MMD2013-00035) approved an additional motor vehicle sales/rental use and a freestanding bathroom facility for 11564 SW Pacific Highway.After MMD2013-00035,11564 SW Pacific Highway now has both a motor vehicle sales/rental use and a motor vehicle servicing/repair use. The proposed personal services use intensifies the minimum parking requirement from the previously identified industrial services use, and therefore requires a minor modification in accordance with the Community Development Code (CDC) 18.765.060.B.1. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications D. Approval criteria.The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; The applicant is only proposing a change of use from an industrial services use to a personal services use. With a change of use, the potential issues are primarily related to the off-street parking requirement. A minor modification is required for this change of use because the application of a higher parking quantity is required according to Table CDC 18.410.3. The proposed personal services use is allowed in the C-G Zone. There are currently 44 parking spaces provided on site, therefore with the change of use, there are 10 additional parking spaces above the required minimum on site. Upon review of the applicant's plans and narrative, staff finds this proposal is in compliance with all other applicable requirements of this title. This criterion is met. 2. If the proposal involves the modification of a condition of approval,at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed;or c. A new or modified condition better accomplishes the purpose of the original condition. This criterion is not applicable because the proposal does not modify a condition of approval. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Tide. PROCEDURE AND APPEAL INFORMATION Final Decision: A minor modification is a Type I procedure.As such, this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first. I can't do anything including lease the space without it. We will have to update our agreement as soon as the new address is created. At this point I am committed to getting this change and improvement completed. With that said it appears that the space was misrepresented to me at the time of the lease. The contract we have is for a space that doesn't technically exist. I am willing to be flexible and don't want to walk away because this space is perfect for me. I would however appreciate a break on the lease for the month of March. As it stands now there is a 3 week delay on the permit approval process even after we go through all the needed changes in the city side. I will need you to either have the owner get directly involved in the next two applications or give you authority or even give me authority via a written letter passing that authority to you or I as we navigate this issue. In reality I don't this will be a major obstacle as far as the space is concerned, but there will still be delays and my worry is that if we are waiting on the owner then that delay may be extended. Please let me know your thoughts. The City of Tigard has been very helpful and understanding in this process but they are clear that the owner has to sign off on the new changes in less the owner authorized someone else via a formal letter or email. The current owner purchased the property in the mid 1950's and operated a business known as Mark 50 Machinery. The business was closed and leased to 99 Towing in 1990. According to the owners 99 towing subleased 11572 to Kaady Appliances probably in the mid 1990's to the best of their recollection. 99 towing vacated the property in 2010 and the current owner ended the sublease and re-leased 11572 to Kaady appliances at that time.The only tenants to occupy 11572 were 99 Towing and Kaady Appliances from 1990 to 2019.
