APPLICATION SUMMARY FILE NAME: 85°C Bakery Café CASE NO.: Minor Modification(MMD) MMD2019-00003 PROPOSAL: The applicant proposes to combine three (3) existing tenant spaces (Suites D01, D03,and D04) at Washington Square Mall into a single tenant space(Suite D02) that is approximately 4,000 square feet in size.The new space will be occupied by a new fast food eating and drinking establishment, 85°C Bakery Cafe. The MUC zone includes land around the Washington Square Mall and land immediately west of Highway 217.Primary uses allowed include office buildings,retail,and service uses.Also allowed are mixed- use developments and housing at densities of 50 units per acre.Larger buildings are encouraged in this area with parking under,behind,or to the sides of buildings. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. MMD201 9-00003 85°C Bakery Cafe 1 SECTION III. BACKGROUND INFORMATION Site Information: The project is located inside Washington Square Mall;south of SW Hall Boulevard,east of Highway 217, and west of SW Greenburg Road. The property is located on a 46.24-acre tax lot (WCTM 1S126,Tax Lot 300),and is part of the larger Washington Square shopping center. The property is located in the Mixed Use Commercial(MUC) Zone,and the Washington Square Regional Center Plan District. In November 2017, the City of Tigard Planning Division approved a lot line adjustment (Case No. LLA2017-00010)between WCTM 1 S135BA,Tax Lot 100(which is occupied by the Thirsty Lion Pub& Grill) and WCTM ISI35BA, Tax Lot 101. Additionally,in April 2018, the City of Tigard Planning Division approved an approximately 64,000-square-foot automobile dealership with accessory uses on Tax Lot 101 (Case No. SDR2017-00005). As a result of these approvals, Tax Lot 101 is no longer considered part of the Washington Square shopping center (although it is owned by the same parent company,The Macerich Company), and is therefore not included in the parking count for the overall shopping center. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties,sensitive lands,or public facilities;and The applicant proposes to combine three (3) existing tenant spaces (Suites D01, D03, and D04) at Washington Square Mall into a single tenant space(Suite D02)that is approximately 4,000 square feetin size. The new space will be occupied by a new fast food eating and drinking establishment,85°C Bakery Cafe. Because the proposed new use (fast food eating and drinking establishment)requires the application of a higher parking quantity requirement than the previous uses (personal services and sales-oriented retail),a review of the site's off-street parking area is required to ensure that it complies with the city's minimum off-street parking requirements. The subject tenant space is part of the overall Washington Square shopping center, which is a multi- tenant site,and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.410.030.D.The attached table (Attachment 1) calculates the minimum off-street vehicle parking requirements based on this formula. Staff finds that 4,268 parking spaces are required for the overall Washington Square shopping center, taking into consideration the change of use discussed above. The applicant's materials demonstrate that there is adequate parking at the development site,with 7,005 parking spaces provided.Accordingly,staff finds this proposal will have minimal impacts on surrounding properties, sensitive lands, or public facilities,and meets the definition of a minor modification. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming,except where an adjustment has been approved. The applicant is only proposing a change of use for a 4,000-square-foot tenant space,which primarily affects off-street parking regulations.As demonstrated in the findings above,there is adequate parking provided at the subject development site.Accordingly, this proposal does not cause the development to go out of conformance with any applicable standard. MMD2019-00003 85°C Bakery Cafe 2 D. Approval criteria.The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above,this proposal qualifies as a minor modification as defined in CDC 18.765.060A. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose ofthe original condition. The applicant is not proposing to modify a condition of approval.This criterion does not apply. CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in CDC 18.765.060.A,and is in compliance with all applicable standards of this Title. With over 1000 locations and easy access in major cities across the globe, 85C Bakery presents a full-service bakery with fresh bread, pastry, tea and coffee in a bright, modern and welcoming environment. Customers can peruse the offering at their leisure, with a self-service, fully accessible counter. Clean tile, wood floors, and custom ceiling elements characterize the space with seating and service areas for those who want to linger or grab a treat and coffee on the go. For Bread: All dough products, made by 85, will be shipped from our Central Kitchen. From there our bread department employee's will accept the shipment and fill up the freezer with them, by expiration date and using proper food safety storage. From there the "Separator" will take the cardboard boxes out. Using a bread tray they will arrange the bread according to the proper procedures for that specific bread. once the bread is placed, the tray will be placed in a bread cart (either 15 or 20 slotted), which is covered. Once that cart is filled with the trays needed it will be placed in the walk in fridge (covered with a cart cover), unless the cart will go directly into our bread proofer (uncovered). The rest will go into the walk in fridge with a label as to when it will be put into the proofer. The bread, when it is being separated, will not remain outside for a long time (the yeast will activated and we are risking the quality of the bread), The bread is proofed, baked, and placed in display trays, which then follow the food safety procedures which are applicable (time control, temperature, etc..). None of our bread is kept overnight, we bake our bread daily and never hold it. For Cakes: Cakes are shipped also, placed in the freezer once they arrive. They are taken out of the freezer, defrosted, decorated, dated, and then placed in the walk in for employees to take into the cake display/fridge outside for sell. Items that go in our Grab n Go fridge, such as our cheese bites and angel food cake, will be dated and sold for whatever the allowed time or days is. Drink Equipment: Will depend on whether it is a dry product or not. If its something like cups or some other dry equipment then it will be stores and used accordingly. If it is something like Peach Syrup, then the product is taken into a walk in fridge, or a reach in fridge. Whenever a product is used it will be used with time control or temperature control.
