SECTION III. BACKGROUND INFORMATION
Site Information:
The applicant is proposing to change the use at 13727 SW Pacific Highway, Suite #300, from a motor
vehicle servicing/repair use to an indoor entertainment use.The approximately 1,360 square foot tenant
space is located in the Tigard Retail Center,which is located northwest of Pacific Highway, south of SW
Fairhaven Street, and east of SW 110th Avenue. No exterior modifications are proposed. The
approximately 2.11-acre site consists of two tax lots, three buildings, and associated landscaping. The
property is located in the General Commercial(C-G) Zone.
An approved minor modification in November of 2002 (MMD2002-00032) required that the Tigard
Retail Center provide a total of 97 parking spaces to accommodate new tenants.A revised site plan that
indicates 97 parking spaces was accepted and approved in December of 2002 by City of Tigard staff.No
other minor modifications have occurred on this site since November of 2002, therefore City of Tigard
staff finds that 97 parking spaces are approved for this site.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.765 Modifications:
18.765.060 Minor Modifications
D. Approval criteria.The approval authority will approve or approve with conditions a minor
modification application when all of the following criteria are met:
1. The proposed modification qualifies as a minor modification as defined in Subsection
18.765.060.A;
The applicant is only proposing a change of use from a motor vehicle servicing/ repair use to an indoor
entertainment use.With a change of use,the potential issues are primarily related to the off-street parking
requirement.A minor modification is required for this change of use because the application of a higher
parking quantity is required according to Table CDC 18.410.3. The proposed indoor entertainment use
is allowed in the C-G Zone. The tenant space is part of a multi-tenant commercial site and is therefore
subject to the required minimum vehicle parking formula outlined in CDC 18.410.030.D.The table below
presents calculations of the minimum off-street parking requirements based on this formula:

Staff finds that 72 parking spaces are required for the Tigard Retail Center.There are currently 97 parking
spaces that were approved by a land use decision for the Tigard Retail Center,therefore with the change
of use, there are 25 additional parking spaces above the required minimum on site. Upon review of the
applicant's plans and narrative, staff finds this proposal is in compliance with all other applicable
requirements of this title. This criterion is met.
2. If the proposal involves the modification of a condition of approval,at least one of the
following criteria is met:
a. The condition cannot be implemented for reasons outside the control of the
applicant or property owner;
b. The condition is no longer needed or warranted because circumstances have
changed;or
c. A new or modified condition better accomplishes the purpose of the original
condition.
This criterion is not applicable because the proposal does not modify a condition of approval.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Title.

SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A minor modification is a Type I procedure.As such,this decision is final for purposes of appeal on the
date it is mailed or otherwise provided to the applicant, whichever occurs first. This decision is not
appealable locally and is the final decision of the City.
THIS DECISION IS FINAL ON FEBRUARY 28TH, 2019,
AND BECOMES EFFECTIVE ON MARCH 1ST, 2019.
