Withdrawal of Applications for Mountain Pointe and Mountain Ridge Subdivision Proposals The applicants for both the proposed Mountain Pointe (SUB 90- 11 ) and Mountain Ridge (RUB 90-12) subdivisions have withdrawn the proposals from consideration by the Planning Commission. The hearings scheduled for February 25, 1991 regarding these items have therefore been canceled. INTRODUCTION The following is a request for preliminary plat approval for a 79 lot , single family detached residential planned development . The 26 . 6 acre development is zoned R-4 . 5PD. A variance is being requested from Tigard Community Development Code which specifies ( I ) localublic streets and cul-de-sacs have a minimum right of way of 50 feet and a minimum roadway width of 34 feet , ( 2 ) limits the grade of collector streets and local streets to 12 percent, ( 3 ) requires the installation of sidewalks on both sides of the street , ( 4 ) hammerhead type turnaround in lieu of cul-de-sac. II . ON-SITE ANALYSIS The property slopes generally from the south down to the north. The steepest slopes occur in the western parcel down two drainage- ways . Grades in this area are approximately 40 percent . Grades generally are in the 2 to ;.5 percent range . Vegetation is rela- tively consistent throughout the site . A tree cover consisting of a mixture of evergreen and deciduous species is found over half of the site . Meadow and orchard land takes up most of the easterly half of the bite . III . OFF-SITE ANALYSIS The proposed development will be initially served from the east by S .W. 121st and S .W. Gaarde St . The proposed additional remainder • of this development to the west will provide connections to Bench View Phases I and II and include the minor collector connection S .W. 132nd through to Bull Mountain Road . IV. UTILITIES The subject property is served by Tigard Water District , which has several large diameter lines ranging from 36 inches to 12 inches at S .W. 121st and S .W. Gaarde . The City of Tigard has an existing 8-inch sanitary service line on S .W. Gaarde just easterly from S .W. 121st Ave . To serve the westerly portion If the development a temporary pressurized sewer pump will need to he installed as shown on the preliminary plans until such time as a gravity line can be constructed northeast of the property. Temporary pump will exit to existing manhole in Bench View. Storm drainage will be channeled to the drainageway that runs diagonally through the pro- perty' s eastern boundary. A small amount of storm drainage will he routed to drainage ravine east of S .W. 121st at S .W . Gaarde crossing . Other 'utilities including Northwest Natural Gas, Portland General Electric and General Telephone Northwest are available at the sub- ject site . • PAGE 2 IP V. COMPLIANCR WITH APPLICABLE TIGARD D6VBLOPM1tNT CODE PROVISIONS a. Dimensional Requirements. The subject property is zoned Vd; y—$b:A-fihQ Pfd (Planned De *lopment ) overlay exempts the lots from meet , na the minimum lot size , depth and lot width standards . All lots meet overall density re- quirements . b. Setbacks. Front yard setbacks for structures excluding garages may be less than 20 feet due to the steep grades but are not expected to be less than 10 feet . All garage sPructures will be a minimum of 20 feet from the front property lines . Interior setbacks may be less than 5 feet as allowed within properties with a PD over- lay. c. Access, Ingress and Circulation. 1 . Section 18 . .)4 . 030 provides standards for the crea- tion of streets and improvements within public right-of-way Subsection 18 . 164 . 030( x ) requires public right-of-way to be 50 feet wide for local streets and 60 feet for collectors . This section also requires cul--de-sacs to have a 50-foot radius for their turn-arounds . Roadway widths for local streets are required '.o be 34 feet and cul-de-sacs to be constructed to a radius of 42 feet . The pro- posed development will meet the above standards with exception that the local streets are proposed to have roadway width of 28 feet within 40 foot right-of-ways and two hammerhead turn arounds are proposed in lieu of cul-de-sacs due to the slope of property The justification for this variation will be Ciscussed in a later section . 2 . Section 18 . 164 . 030( K ) requires all cul-de- sacs to be as short as possible and not to exceed 400 feet . All streets within the development meet this sten- dard . 3 . Section 18 . 164 . 030(M) requires all arterial streets to have grades of 10 percent or less and collectors or local streets to have grades of 12 percent or less . The proposed subdivision provides for a minor collector having a grade vf 12 percent and some local streets with grades of 15 percent . The justification for this variation will be discussed in a later section . Section 18 . 164 .030( M) also re- quires minor collectors to have a minimum certer- line radii of 350 feet ar' local street a minimum 100 foot radii . The sLreet within the proposed subdivision meet these standards. All uther re- quiremen, f of Section 18 . 164 . 030 will be met . Plans will be submitted for review prior to con- struction of all public improvements . 111 4 . Section 18 . 164 . 070 contains provisions for the in- stallation of sidewalks . This section requires sidewalks to be located on both sides of arterial and collector streets , as well as local streets . The sidewalks for local streets may be installed in conjunction with the development of the individual lots . The proposed development will meet the above standards with the exception that sidewalks are proposed for only one side of the collector and all local streets . The justifica:.ion for this varia- tion will be discussed in a later section . d. Sensitive Lands . Chapter 18 84 of the Tigard Develop- ment Code deals with properties to be sensitive . This designation may be due to floodplains , natural drainage- ways, steep slopes or unstable ground . The subject pro- perty contains land determined to be sensitive due to the presence of a drainageway and the steeper slopes associated with the dra'_nageway . Section 18 . 84 . 015(A) lists the uses permitted and pro- hibited for sensitive lands . Among the uses permitted is "Public and private conservation areas for water , soil , open space , forest and wildlife resources . " The sensitive land is being proposed as a conservation under private ownership. The only disturbances proposed with- in the sensitive lands will be sanitary sewer construc- tion including manholes , and short s. :tions of storm lines that will bring storm water to the drainageway. Plans will be submitted to the City and permits will be obtained prior to any construction being commenced with- in the area . e. Planned Development . The 26 .6 acre property is being developed as a planned development . The purpose of the planned development is to preserve to the greatest extent possible the existing landscape features and amenities . An additional purpose is to provide a means for creating planned environments through the applica- tion of flexible standards . Section 18 . 80 . 020( B) requires planned development re- quests to have a pre-application conference with City staff . A pre-application conference was held on June 21 , 1990, with City staff to discuss the proposal and get input to help in the application . Section 19 . 80 . 080 "Applicability of the Base Zone Pro- visions" provides allowable variations in lot size , depth and width, as well as setbacks . As mentioned pre- viously, the only .►ariations from these ste.idards are front yard and side yard setbacks . The front yard set- backs may be as close as 10 feet to the structures, but will he 20 feet to garage structures in order to allow • adequate off-street pa-king . PAGE 4 111 Section 18 . 80 . 100 provides for phased developments . The (41 proposed Mountain Pointe development will be constructed in phases as shown . Section 18 . 80 . 120 provides Approval Standards which are necessary to satisfy prior to receiving Planned Develop- ment Approval . These standards are : 1 . Land Division Provisions Chapter 18. 162 . Thin chap er con-f siuZes, regulation ss and standards for the submittal of land divisions . The proposed preliminary plat has been prepared in compliance with this chapter and the final plat will be pre- pared in accordance with the provisions of this chapter . 2 . Density Cosputrtion and Limitations Chapter 18.92. This chapter provides a formula for determining FRe number of dwelling units permitted. The density calculatiors for the subject property are as fol- lows : Zoning R4 . 5PD Gross Site 26 . 6 Acres Minus 10% for a �• Street Dedication 5 . 3 Acres sensitive Lands 2 . 0 Acres Net Site 19 . 3 Actes ( 840 , 708 s/F) Net Units 840, 708/7 , 500 S/F Per Unit 112 Units The total number of units allowed is 112 while the total number of units proposed is 79 . 3 . Accessory_Structures Chapter 18.144. This chapter pro`vTaes criteria for theocT—ation and usage of accessory structures in residential toning dis- tricts . An accessory structure is requested as nart of this application . A sewer pump facility is contemplated for temporary use until such future time a gravity Fed sewer line is constructed. 4 . Additional Yard Area Requirements Ct"pter 18.96. T1 to cFiapFerprovides for additioniT setbacks on lots adjacent to streets with insufficient right- of-way or where better light , air and vision • PAGE 5 • clearance may be needed. As the proposed prelimi- nary plat provides sufficient right-of-way for all streets and adequate vision clearance is being pro- vided for all street intersections, no additional yard area requirements are needed . 5. Building. Height Limitations Chuter 18.989. This cfiap�er contains provisions for h1iAl exceptions for non-residential zones and for buildings located on flag lots . Neither of these provisions apply to tt.e lots proposed . The building height provisions of the R-4 . 5 Zoning District will apply to the respective lots within the proposed subdivision. 6. Visual Clearance Areas Chapter 18.1U2 . This chap- Er provides sten-ail-di 10 assure proper sight dis- tance at intersections . All proposed street inter- sections will meet the required visual clearance provisions of this section . 7 . Landscaping and Screening Chapter 18. 100. This chapter provides standarcas for the-Fu!Te ring, land- scaping and screenings , as well as specific stan- dards for the location of street trees . The buf- fering and screening standards include a minimal level of screening and buffering along property lines between specific zoning districts . In the • case of the subject property all of the surrounding ' properties are either N-4 . 5PD or d-7 zoned parcels . Subsections 18 . 100 and 18 . 100.035 ccatain require- ments and standards for the installation of street trees . Street trees will be planted by the indivi- dual property owners as constructions proceeds. The standards of these sections will be followed during the planting of the street trees. A . Off-Street Parking and Loading Chapter 18.106 . No oT istreet parking and loading areas are proposed for the subdivision . Therefore, this se -tion does not apply. 9. Signs Chapter 18.114 . This section does not apply. 1 ) . Relationship to the Natural and Physical 6nviron- ■enR. The streets, -Fu`iT1Tngs ani other site ele- ments shall be designed and located to preserve the existing trees, topography and natural drainage to the greatest degree possible . Proposed layouts of streets within the subdivision minimizes grading and, thus minimises tree removal by narrowing the turning radius , right-of-way and • street widths . The layout also does not provide PROS 6 any crossings of the drainageway except for St . "A" Since a portion of the site is heavily wooded, the street locations would disturb an equal amount of area, however , by reducing the road widths we will be able to maximize the retention of existing vegetation while still providing a rea- sonable use of the property. The site plan also provides a conservation area in both public and privet 'nership. Areas in private ownership will be rebLricted for building and disturbance in drainage area which contains the drainageway and steeper slopes . This .sill assure the retention of trees and vegetation. In addition to the variance in the street widths we are requesting a variance to ' he minimum street grade . Approval of these variances will allow us to follow the existing glades more closely which will also result in a lessening of the grading and the preservation of additional trees and vegeta- tion . Trees with a 6-inch caliper measured at 4 feet in height from ground level shall be saved where pos- sible . All trees will be saved whenever possible. Approval of the variance request to reduce street width and modify cul-de-sac with turnarounds will • allow additional retention of trees. VI . JUSTIFICATION roll VARIANCES As part of our submittal we are requesting variances from the fol- lowing Development Code Standards : • Section 1R . 164 . 030( E) ( l ) which specifies that local pub- lic streets and cul-de--sacs have a minimum right-of-way of 50 feet and a minimum roadway width of 34 feet . • Section 1R . 104 . 0.10( M) ( l ) which limits the grade of col- lector and local streets to 12 percent . • Section 18 . 164 . 070 which requires the installation of sidewalks on both sides of local streets . The purpoue for each of the requested variances is to help reduce the impact on the natural vegetation and existing topography . Approval of the requested variances will res'ilt in less disruption of the site and the increased retention of vegetation without changing the efficiency of the street system , Section 18 . 134 . 050 of the Tigard Development Code establishes five criteria that must be met in order to grart a variance. These criteria are stated and discussed below: • PAGE 7 (411 1 . The proposed variance will not be materially detrimental to the purposes of this Code; be in conflict with the policies of the Comprehensive Plan, to any other appli- cable policies and standards; and other properties in the same zoning district or vicinity . The proposed variance will not be materially detrimental to the purposes of the Tigard Development Code or the Comprehensive Plan. Approval will help protect the quality of water resources by minimizing erosion and maximizing retention of vegetation in close proximity of a drainageway . It will also conserve needed open space and help protect natural and scenic resources . All this while also providing a sane and economic transportation system and an orderly and efficient a . rangement of pub- lic services . All of these are purposes found in the Purpose Chapter ( 18 . 02 . 010 ) of the Development Code . Approval will allow local streets to be constructed with a pavement width of 28 feet with a 40 foot right-of-way, a maximum 15 percent grade and sidewalks on one side . Also, a variance to the standard cul-de -sac is requested to allow a hammer head type turnaround in the two areas shown . Steepness of slopes make these desirable to minimire tree removal and help erosion control . Standard circular cul-de-sacs are not feasible on these steeper slopes . • 2 . There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control , and which are not applicable to other properties in the same zoning district . The site has a substantial tree cover on the westerly portion. The existing conditions have resulted in a reduction in the number of lots from the allowable 112 to the proposed 79 . Denial of the requested variances would not result in fewer lots, but would result in smaller lots and additional grading and vegetation removal . 3 . The use of the proposed will be the se.me as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitted some economic use on the land. Approval of the requested variances will not change the use of the property . As mentioned previously, denial will result in smaller lots , but not fewer lots . 111 MOB 8 t • 4 . Existing physical and natural systems, such as, but not t limited to, traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code . The primary purpose of the variances requested is to minimize any adverse effects on the natural features found on the site . The only existing public street in the vicinity is S.W. 121st Ave. and S.W. Gaarde which will not he adversely affected try the requested variances . 5 The hardship is not self-imposed and toe variance re- quested is the minimum variance which would alleviate the hardship The hardships mentioned are not self-imposed, but are a function of the natural topography and vegetation that exists on the subject property. The reductions in the standards that are being requested are the minimum that will alleviate the hardship while still allowing safe and efficient access and circulation VII . CONCLUSION The proposed 79 lot Mountain Pointe development utilized the 26 . 6 • acre parcel in an efficient manner while providing maximum protection to the physical characteristics . The project will continue the street and utility improvements of S .W. 121st and S .W. Gaarde . The street pattern proposed allows for connection to proposed street pattern with proposed layout adjacent to Bench View Phases 1 and II and provides for eventual minor collector connection of S .W. 132nd which connects Walnut to Bull Mountain Road . Also provides for S .W. Gaarde collector extension through eventual connection to S .W. Walnut . Sanitary Sewer A) The City has an existing S-inch sanitary service line on S.W. Oaarde St. approximately 200 feet east of the proposed project. The other proposed connection, an existing S -inch line, is located on the south end of S.W. 132nd Ave. B) Based on the applicants submittal, the southly portion of the project , Phase's I and II , will use gravity tow lines that will connect to the existing line on S.W. Oaarde St. Phase III, the north portion of the development, will connect to the existing line on S.W. 132nd Ave using a temporary pump station. C) After reviewing the applicants submittal we Ieel there are some significant design flaws that need to be addressed: 1 ) the sewer line that serves lots 9 - 16 does not connect to any other lines, it does not go anywhere. 2) the proposed temporary pump station does met go anywhere; the applicant has not Shown hen e! where it will connect up to the existing line on S.W. 132nd Ave. ti F 4 D# w ; + % s 3) the proposed temporary pump station, according to the applicant , would be removed after such time as a gravity line is installed to north/northeast . He has not shown how this would be accomplished 4) the proposal shown the use of : back-lot sewer lines , manholes outside of the public right -of - way, ight -of - way, and sewer lines on adjacent properties . rhe applicant has not shown how these will be able to be maintained by the city or if they ars accessible. It also appears, that with some of these heck-lot lines, that it would mak•+ the lot unbuildable. 5) the applicant has not shown how this design would work with future development in the surrounding area. 2. The applicant is proposing to channel the storm drainage to the drainageway that runs diagonally through the property ' s eastern boundary . A small amount of storm drainage will be routed to the drainage ravine east of S.W. 121st at B.W. Oaarde crossing. The Unified 8ewe--age Agency has established and the City has agreed to enforc,•, (Resolution 90- 13) Surface Water Management Regulations requiring construction of on-site water quality facilities or tees in-lieu of their construction. Based on the size and location of this development the applicant should be required to install an on site water quality facility. It is not clear how the existing natural drainageways will be preserved, protected and maintained. 3 . Traffic The Comprehensive Plan Transportation Map currently calls for a street connection between Oaarde Street and Walnut Street . In the Northeast Bull Mountain Transportation Study , staff recommended that the connection he accomplished by extending Oaarde Street west and north to connect with Walnut Street near 132nd Avenue. The Oaarde extension would be a major collector. The staff also recommended extension of 132nd Avenue south of Benchview Terrace to connect to Bull Mountain Road. During hearings on the Transportation Study, NPO 03 proposed an alternative plan . The NPO proposed that Oaarde be extended went from 121st Avenue to connect with 132nd Avenue. The Oaarde extension would be a minor collector with a design speed of 25 mph . The NPi) proposal included the extension of 132nd Avenue south from Benchview Terrace to connect with Bull Mountain Road. 410 Both the staff recommendation and the NPO $3 recommendation are still under consideration by the City Council . Therefore, the staff requested the applicant to submit alternative plans providing for each of the options . Instead, the applicant has submitted a plan which attempts t.) provide for both options. Street "F" provides the Oaarde sx} ension recommernded by staff . It could he extended to Walnut street as properties to the north are developed. If Street "C" is designed to major collector standards, it would satisfy the requirements o; the staff recommendation for a Oaarde extension. As currently submitted, the proposed Street "F" tails to meet the standards of a major collector. Street "F" should be redesigned to meet major collector standards for grades , sight distance, and intersection spacing. Street "A" provides for a connection westward to 132nd Avenue. If the NPO recommendation is later selected by the Council , the applicant proposes to satisfy that recommendation by building Street "A" to minor collector standards and deleting any future direct connection of Street "F" to Walnut Street . We understand that the NPO has reviewed this proposal and found it to be consistent with their recommendation. The applicant has requested a variance to allow a curve radius on Street "A" less than the standards. The radius requested would meet the 25 mph design standard proposed by the NPO and would meet the design standards for local streets. We have no objection to this var'_ance. 4 . Streets A) Section 18. 164 .030.0. 1 of the Community Development Code requires that streets making "T" intersection at collectors and arterial be designed such that no jogs of less than 300 feet on such streets be created. Street "J" of the proposed subdivision does not meet this criteria . The proposed street is within 155 feet of the S.W. 121st /oaarde intersection; additionally the applicant has not request a variance to the Community Development Code. 61 Section 18. 164 .030. F. 1 of the Community Development Code states that "Where necessary to give access or permit a satisfactory future division of adjoining land, streets shall be extended to the boundary lines of the tractto he developed, " The applicant has submitted, for street "F" , a proposed alignment hut does not propose to extend the street to the boundary line of the development , and thus would required a variance. In addition, thy' proposed street terminates at a 16% grade which exceeds the applicants requested variance of 15%. C) Section 18 . 164 .030.M. 1 .b. of the Community Development Code requires that a landing be provided and shall be five percent or less. The applicant ham, failed to provide for this at various intersections and has not request a variance to this section. D) The applicant has proposed various streets to be extended for future development buthas failed to show where thee* streets will connect with the existing street system. Street. "C" is proposed to be extended in the future; the main problem with the proposal is that there is no provisions for emergency/maintenance vehicles . The length of the street , for this development , is approximately 375 feet , which would necessitate a turn around either temporary or permanent . E) Traffic exiting from Street "H" onto Street "F" (the collector street) would have limited sight distance to the west . The sight distance would be restricted both by a horizontal curve and by a sharp hill crest immediately west of the intersection. Alternate designs should be explored to eliminate an intersection at this location. It appears that design options are readily available . F) The applicant has requested the following variances to the City of Tigard. Community Development Code: 1) lection 1$ . 164.030.E. 1 .a - which specifies minimum right-of way width's and minimills roadway widths; the applicant is proposing that local streets and cul- de-sacs have a 40 foot right-ow-way with 28 toot of pavement width whereas the code requires 50 fest of right-of-way and 34 feet of pavement width. In addition the applicant is requesting the use of two hammerhead shaped turnarounds whereas the circular turnarounds are required. 1) Section 18 . 164.030.M. 1 which specifies that no grade shall exceed 12 percent for collector or any other street . The applicant has requested a variance to the grades of 15 percent . While he has requested a variance, the plans submitted show that. streets "A" , "D" , and "F" exceed the requested variance by a minimum of 1%. Street "A' has a 17% grade and street "D" and "F" have a 16% grade. 3) Section 18 . 164 .070 which requires the installation of sidewalks on both sides of collector and local streets .
