noted below.
A. FINI:INO OF FACT
1 . Background
The subject property was annexed to the City in September, 1967
(Ord. 067-52) . An incomplete application for site development
review was submitted in June, 1979. This application was put on
hold at the request of the appli::'ant and never completed.
An application for a minor land partition on the subject parcel was
approved in December, 1983, and has since expired.
2 . Vicinity Information
The subject site is surrounded by properties also zoned P- 1)
Properties to the north, west, and south are developed with
apartments. Property to the east is developed with single-family
residences.
3. Site Information and Proposal Description
The subject sits fronts on BM North Dakota. A single--fully
residence is located in the southeast corner of the lot. There are
a variety of deciduous and evergreen trees located around the
perimeter of the subject parcel . A 6 foot fence surrounds the
property on three sides.
The applicants propose to divide the 14,930 square foot parrs'
Into ? Iota containing approximately 5 49'9 and 9,460 square feet
The smaller lot, located on the southeast portion of the parcel ,
,-ont e l ns the existing house. A 6 foot. fence is proposed to
nsperste the two lots. There Is a utility pole and support wires,

center of the 40 feet of frontage that is to he used as access for

4. Agency anti NPO Comments
The engineering Division has the following comments:
1 . The applicants have submitted a site map showing the existing
house.
2. Access for the parcel with the existing house its 1>y an
existing gravel driveway to SM North Dakota Street Ar••esa
for the remaining parcel is by a separate driveway toss Mnrth
Dakota Street that appears to be obstructer: by • guy fe,r •
utility pole.
3. SW North Dakota Street is a local street requiring a right-of-
way SO feet in width. The existing right-of-way along SW North
Dakota Street has a width of 25 feet from centerline.
Consequently, additional dedi,•ation of right-of- way is not
required.
4. The NW Ncrth Dako..a Street f t nn' age is paved and improved with
curbs and sidewalks.
5. Sanitary sewer service is available from an existing sewer in
S.M. North Dakota Street.. Bach house must connect separately
to the lino.
6. Storm drainage may be provided by an existing storm sewer
along N.W. North Dakota Street or by on site disposal .
Fire District #1 comments that a %ydrant must be provided as
required by the Uniform Fire Code.
The Building Division, aeraral Telephone. Ketsger Water District,
and School District 23J have reviewed the proposal and have no
objections to it.
No other comments have been received.
A. ANLLYAI$ AND CONCLUSION
The proposal meets the minor land partition approval criteria of Section
15.162.040 (Partition Approval Criteria) . It conforms with the City's
comprehensive plan and complies with all statutory and ordinance
requirements and regulations. Adequate public facilities are available
to serve the proposal. All proposed lots conform to the mise and
dimensional requirements of this title.
All proposed improvements meet City and applicable avenc.y standards
except that 1) the applicants have not shown the location of the access
that will serve the back or northern lot and 2) there is a utility pole

and cable box located in the middle of the poet ion of the North Dakota
frontage where the ac.cessway is pres►s>d1 to be located. Prior to
recording this minor land partition the applicants rust submit a site
plan showing the proposed location of the acr•easway and provide
evidence that the configuration they have selected is acceptable to the
utilities involved. It it .is necessary to move the utility pole and/or
cable box the expense will be born by the applicants.
The proposed aci eseway must be 15 foot wide with a 10 foot widdo paved
driveway. Tf the drtvaway is within l0 feet of the abutting property
screenir.q must be provided in the form of • hedge or a row of evergreen
and deciduous trees .n accordance with Section 18. 100.080 of the Cade (a
copy of Section 78. 100.080 is attached to this report) .
The applicants will need to provide a fire hydrant as indicated in the
comments submitted by the Fire Marshall .

existing trees as possible. A tree removal permit must be obtained

width of the driveway located at 9713 SW North Dakota Street by
March 31, 1992 and in accordance with Community Development Code
Section 16. 108.070 (Minimum Requirements* Residential Use) .
Specifically the minimum access width must be 25 Leet with a 20
foot wide paved area.
I further agree to provide additional parking spaces to a total of
four spaces (two for each dwelling unit at least one of which will
be covered for nisch dwelling) in accordance with Code Section
18. 106.030(A) by March 13, 1992.
If it is necessary to perform any work within the public right-of-
way, I agree to obtain a street opening permit prior to performing
such work.
I understand that if I fail to satisfy the teres of this voluntary
compliance agreement I may be subject to civil infractions citation
and/or summons and may be fined up to $250.00 per day for every day
the violation(s) continues to occur.

Attached herewith is the VOLUNTARY COMPLIANCE
AGREEMENT of this date, signed by Mr. i Mrs. Paul Lee.
It is our understanding that this agreement will be
void in the event the city grants a variance from the
code requirement . We will be filing for the variance
shortly after January 1 . 1992 .
It is also our understanding that in the event the
variance is not granted , and weather conditions are
unfavorable, the deadline for compliance will be ex-
tended .
There are also some very serious concerns over
storm drainage the city has dumped on the Lee property.
This problem needs to be addressed by the city before
any driveway widening would be possible. Even though
the city may have the legal right to drain their water
onto private property , I think the city is avoiding
the problem and hoping it will go away Good public
relations with the community demands that the city
assume it ' s rightful responsibility in this matter.

Greg:
Pat Reilly has reviewed the driveway and drainage issues raised by
Mr . Arnett and Mr . Lee regarding the new duplex at 9733 SW North
Dakota Street . Based on this review, Pat has concluded that :
• The driveway will .aca need to be widened. (Pat discussed this
issue with Planning and they are aware of the decision. )
• Mr . Lee is still responsible for correcting t.h* drainage.
I p coned Mr . Arnett and told him of this decision . He seemed to
think that Mr . Lee would accept this decision and proceed with the
drainage work .
I told Arnett that they needed to construct a ditch or swale to
carry the water from the culvert outlet to the northwest part of
the Lee property, then discharge it toward the northwest to the
back of the neighbor' s property. I told him that they also needed
to direct water from the end of the new curb line into the ditch.
They may contact you . J told them that you could help them or
their contractor to understand exactly what in needed and that you
could help in coordination with the neighbor, if necessary, to
assure that the neighbor does not block the new ditch/swale
discharge .

City of Tigard has APP1 )VID the above described application SO$JPCT TO CERTAIN
CONDITIONS. The findings and conclusions on which the decision is based are
noted below.
A. FINDING OF FACT
1. Background
The subject property was annexed to the City in September, 1987
along with • large number of other properties in the northeast
Mstsger area. In June, 1989, the Planning Commission approved a
request to subdivide a 3.41 acre parcel into 6 lots between 7,917
and 44,058 square feet in wise. In August, 1909 approval of
Subdivision 189-06 allowed the creation of 7 lots instead of 6.
2. Vicinity Information
Surrounding properties in all directions s -e also soned R-4.5. The
majority of these have been developed as single-family rstidenoes
on varying amounts of acreage.
1. Sits Information and Proposal Description
TI. site abuts SW 71st Avenue at the intersection of 71st and
Maple Leaf. There is an existing dwelling, a garage, and an
outbuilding in the approximate center of the lot. In the vicinity
of the proposed partition there are 3 trees: a maple, an apple,
and an oak.
The •pplicsnt proposes to partition this 33,000 square foot perosl
into 2 parcels to accommodate the construction of • single-family
dwelling. The parcel to be used for the new dwelling is proposed
to be approximately 8,364 square feet In sine and is located on the
southern portion of the parent parcel, the remaining 24,436 square
pazcel will contain the existing residence.

4. Agency and MPO Comments
-he Engineering Division has the following costrentsi
The applicant proposes to divide • 0.76 acre residential parcel
along SM 71th Avenue into two parcels.

a. The applicant has submitted a site map showing the existing
house and a proposed house as well as a proposed sanitary
sewer service lateral.
b. The parcel was created by • previous subdivision application
(6A9-06/V89-1e) .
c. tach parcel abuts SW list Avenue. The required public right-
of-way dediLation was provided by the previous subdivision
application. The previous application also required •
nonremonstranoe agreement for the formation of • future local
improvement district formed to improve SW 71st Avenue. The
nonremonstrance agreement has not been provided.
d. SW 71st Avenue is an unimproved local street. Subsection
18.164.030.A of the Code permits the Director to accept •
future improvement guarantee in lieu of street improvements on
property zoned residential if the proposed land partition does
not create any new streets. The existing street has • low
volume of traffic, and is adequate for emergency vehicle
access. No right-of-way on the opposite side of SW 71st
Avenue has been dedicated. Additional paving would be
required to connect an improved street frontage to a paved
street. Moreover, the area surrounding the site is nearly
fully developed with streets without. curbs and sidewalks;
consequently, a future improvement guarantee in lieu of street
improvements is acceptable.
a. Sanitary sewer service is available from the existing line at
the intersection of SW 71st Avenue and SN Maple Leaf Street.
The proposed connection will require a separate permit.
f. Storm drainage is provided by an existing culvert crossing SM
71st Avenue
The Building Division notes that the utilities for the existing
house must be located and, if they cross new property lines,
easements must be provided. The applicants should be required to
submit a plan showing the location of the utilities.
The Metzger Mater District notes that service must be extended from
a 6 inch line in SM 71st Avenue.

Cablevision, and U.S. Nest have reviewed the proposal and have no
objections to it.
No other oosswnts have been received.
B. ANALYSIS AND CONCLUSION
The proposal satisfies the minor land partition approval criteria of
Section 18. 162.040 of the Tigard Community Development Cade. The
proposal conforms with the City's Comprehensive Plan and oomplims with
statutory and ordinance requirements and regulations. Adequate public
facilities are available to serve the proposal, the proposed lots
exceed the 7,500 square foot minimum lot slim and other dimensional
requirements of this title. All proposed improvements meat City and
applicable agency standards.
The Applicant is advised to contact the Tigard Water District concerning
the extension of the waterline from 71st Avenue.
C. DSCISIOM
The Planning Director's designee for the City of Tigard approves NLP 90-
0009 subject to the following conditions,

Description,
The applicant proposes to divide • 0.76 acre residential parcel along SW 71th
Avenue into two parcels.
Findings:
1. The applicant has submitted • site map showing the existing house and a
proposed house as well as a proposed sanitary sewer service lateral.
2. The parcel was created by a previous subdivision application
(189-06/V89-1e) .
3. !tech parcel abuts to SW 71th Avenue. The required public right-of-way
dedication was provided by the previous subdivision application. The
previous application also required a remonstrance agreement for the
formation of a future local improvement district formed to improve SW
71st Avenue. However, the agreement has not been provided.
4. SN 71st Avenue is an unimproved local street. Subsection 18.164.030 A of
the Code permits the Director to accept a future improvement guarantee in
lieu of street improvements on property sand residential if the proposed
land partition does not create any new streets. The existing street has
• low volume of traffic, and is adequate for emergency vehicle aooess.
No right-of-way on the opposite side of SN 71st has been dedicated.
Additional paving would be required to connect an improved street
frontage to a paved steet. Moreover, the area surrounding the site is
nearly fully developed with streets without curbs and sidewalks.
Consequently, • future improvement guarantee in lieu street improvements
is acceptable.
S. Sanitary sewer service is available from the existing line at the
intersection of SW 71st Avenue and SW Nipleleaf Street. The proposed
connection will require. a separate permit .
