Suite Z3 will be changing from a personal services use (bank with drive-thru) to a drive-thru fast food eating and drinking establishment (Starbucks). The applicant also proposes modifications to: the building footprint;design and materials of the building facades; on-site landscaping; on-site parking lot; drive-thru lane; and on-site pedestrian walkway. The applicant also proposes to install a new trash enclosure. The C-G zone is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.780.050.0 MMD2018-00055 Starbucks 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 16200 SW Pacific Highway, Suite Z3; south of SW Durham Road, west of SW 113' Avenue, and east of SW Pacific Highway. The property is located in the Tigard Towne Square shopping center, which is made up of seven (7) tax lots totaling 20.45 acres, and contains multiple commercial buildings, 920 parking spaces, and associated landscaping. Starbucks currently occupies a 1,378-square-foot space in the shopping center (Suite Q1) and proposes to move out of Suite Q1 into Suite Z3. Suite Z3 was previously occupied by a personal services use (bank with drive-thru), and will be changing to a drive-thru fast food eating and drinking establishment. The shopping center is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing modifications to an existing building at 16200 SW Pacific Highway, Suite Z3. Specifically, the applicant proposes to: • Reduce the building footprint, in order to accommodate a new outdoor seating area, and to modify the design and materials of the building facades.The applicant is not proposing to modify the building's height. Staff reviewed the applicant's submitted site plan and elevation drawings to confirm these modifications comply with all applicable development standards for the C-G zone, including minimum setbacks, as outlined in CDC Table 18.120.3. • Modify landscaping, which will result in a net increase of 1,500 square feet of total on-site landscaping. As determined in Case No. MMD2007-00008, the Tigard Towne Square shopping center currently contains 146,396 square feet or 16.4 percent on-site landscaping. With the proposed modifications, the shopping center will continue to exceed the minimum 15 percent landscape requirement for the C-G Zone (CDC Table 18.120.3)with 147,896 square feet or 16.6 percent on-site landscaping provided. • Change the use of the existing building from personal services (bank with drive-thru) to a drive- thru fast food eating and drinking establishment (Starbucks). The applicant also proposes to modify the on-site parking lot,in order to accommodate a reconfigured drive-thru stacking lane. This modification will result in a net loss of two (2) parking spaces.The 20.45-acre Tigard Towne Square shopping center is a mixed-use, multi-tenant site, and is therefore subject to the required MMll2018-00055 Starbucks 2 minimum vehicle parking formula outlined in CDC 18.310.030.D. The attached table (Attachment 1) calculates the minimum off-street vehicle parking requirement based on this formula. Staff finds that 618 parking spaces are required for the shopping center, taking into consideration the change of use discussed above. Even with the proposed reduction of two (2) parking spaces, staff finds there is still adequate parking at the project site, with 918 spaces remaining. • Reconfigure the existing drive-thru stacking lane. Staff reviewed the applicant's site plan to confirm the modified drive-thru stacking lane will continue to meet the minimum 200-foot stacking lane length for drive-thru restaurants (CDC Table 18.310.1), and that the drive-thru stacking lane is designed so that it does not interfere with parking and vehicle, pedestrian, and bicycle circulation (CDC 18.310.040.D.3). • Reconfigure the existing on-site pedestrian walkway, in order to accommodate the modified parking lot and drive-thru stacking lane. Staff reviewed the applicant's site plan to confirm the modified on-site pedestrian walkway complies with all standards for walkway location, design, and pedestrian safety,as outlined in CDC 18.920.030.F. • Install a new trash enclosure that will be located southwest of the existing building. Staff reviewed the applicant's detail drawings to confirm the new refuse collection area will be enclosed from view by placement of a masonry wall (CDC 18.320.050.D.4). Additionally, the applicant submitted documentation of approval from the franchised hauler, Pride Disposal, for the new trash enclosure. Upon review of the applicant's plans and narrative, staff finds that all other requirements of this Title are not applicable. This criterion is met. 2. The modification is not a major modification. Starbucks currently occupies a 1,378-square-feet space in the shopping center (Suite Q1) and proposes to move out of Suite Q1 into Suite Z3. Suite Z3 was previously occupied by a personal services use (bank with drive-thru), and will be changing to a drive-thru fast food eating and drinking establishment. The applicant submitted a trip generation and queuing assessment, prepared by Kittelson & Associates, to illustrate how the proposed change of use will not create an increase in vehicular traffic to and from the site that exceeds 100 vehicles per day (CDC 18.780.040.B.7).This conclusion is based on trip generation estimates from the Institute of Transportation Engineers.Accordingly,the applicant is not proposing any of the changes outlined in CDC 18.780.040.B.Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title. A site vicinity map is provided in Figure 1. The analysis herein addresses the traffic impacts per the Tigard Municipal Code (TMC) Section 18.910.030.CC as well as the drive-through queuing requirements in Table 18.310.1 (Reference 1). The results herein indicate that no trip vesting or off-site traffic analysis is anticipated to be required as a result of the change in trip making associated with the redevelopment. Additional details in support of this conclusion are provided herein. PROPOSED DEVELOPMENT The applicant seeks to permit and redevelop the existing 2,188 square-foot bank into as a 2,082 square- foot drive-through coffee shop with indoor seating. As part of the redevelopment proposal, the existing drive-through lane will be reconstructed and aligned to maximize the availability of on-site vehicular queue storage while minimizing the impact to the adjacent parking field. A site plan is provided in Figure 2. TRIP GENERATION Trip generation estimates for the proposed redevelopment are based on trip rates from Trip Generation, 9th Edition (published by the Institute of Transportation Engineers) for Land Use Codes 912 (Drive- Through Bank) and 937 (Coffee/Donut Shop with Drive-Through Window). A comparison of the coffee shop trip generation to the existing bank trip generation is shown in Table 1.The pass-by rates shown for both uses are reflective of data contained in ITE's Trip Generation Handbook, 3rd Edition, as shown in Table 1. Pass-by rates assumed are consistent with assumptions in previous traffic studies approved by the City of Tigard. None of these thresholds are met by the redevelopment, therefore, no off-site operational analyses are needed to support the redevelopment. QUEUEING Tigard Municipal Code (Reference 1) Table 18.310.1 states that drive-in restaurants have a minimum queue length requirement of 200 feet. The proposed drive-through queue length is 201 feet; as such, this code requirement is met. In-house queuing studies prepared by Starbucks over the last 12 months indicate that the average 95th percentile queues during peak hours in urban environments is approximately 10 vehicles,with an average spacing of 19.6 feet per vehicle. This results in an average 95th percentile of approximately 196 feet, similar to the City code requirement. As noted, the proposed site plan queue length is 201 feet. Additionally, the proposed drive-through lane is within the confines of the existing parking lot serving a number of other uses. The entrance to the drive through is located more than 200 feet from the nearest access onto the adjacent street system and therefore, no off-site queuing-related issues are anticipated. Intersection sight distance (ISD) measurements were obtained in the field from a viewpoint 14.5 feet behind the edge of the traveled way and from a height of 3.5 feet above the ground, looking toward an object that is 3.5 feet above the ground, consistent with current AASHTO recommendations. Stopping sight distance (SSD) measurements were obtained in the field from a viewpoint 3.5 feet above the ground looking toward an object that is 2.0 feet above the ground, also consistent with AASHTO methodologies. Field measurements were compared to the AASHTO design guidelines for the posted 45 mph speed for "Case 82: Right Turn from Stop" analysis. The sight distance summary is provided below in Table 2. Sufficient sight distance is currently available at all existing site accesses and is expected to continue to be available upon site buildout. Signage, above-ground utilities, and landscaping near the internal intersections and site access points should be maintained to ensure adequate sight distance. ADDITIONAL CONSIDERATIONS There is an existing, operational Starbucks coffee shop within the Tigard Towne Square commercial development that is expected to be closed with the construction of the new site.The trips of this existing Starbucks coffee shop were not considered for credit in the analysis for the current application and would be considered separately should the existing Starbucks site redevelop or be occupied by a new tenant. The site plan shows 1 enclosure on the property measuring 11'8" deep and 20' wide, which allows for straight on access. The other details on the site plan are not shown. These requirements will need to be met to ensure our access: • The gates need to be hinged in front of the enclosure walls to allow for the full 20' width. This will also allow for the 120 degree opening angle that is required. • No center post at the gate access point. • The gates need cane bolts and holes put in place for the gates to be locked in the open and closed position. The holes for the gates to be held open need to be at the full 120 degree opening angle. • Overhead clearance of at least 25' • There must be 75' of unobstructed access to front of the enclosure (no parking island, parked vehicles, light pole, buildings, etc).
