Section IV.

SECTION III. BACKGROUND INFORMATION
Site Information:
The applicant is proposing a change of use from personal services to indoor entertainment at 15965 SW
72" Ave. No exterior modifications are proposed. The 1,530 square-foot tenant space is located within
Building A of Oregon Business Park III located west of SW 72nd Avenue, north of SW Upper Boones
Ferry Road,east of SW 74th Avenue.The approximately 19-acre development site is made up of four (4)
parcels,and contains four (4) buildings, associated landscaping, and 455 parking spaces. The property is
located in the Industrial Park (I-P) Zone.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.780 Site Development Review:
18.780.050 Minor Modifications
C. Approval criteria. The approval authority shall approve or approve with conditions an
application for a minor modification when all of the following are met:
1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant is only proposing a change of use from personal services to indoor entertainment. With a
change of use, the potential issues are primarily related to the off-street parking requirement. The
proposed use is allowed in the I-P Zone. The tenant space is part of a multi-tenant building and is
therefore subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D. The
table below presents calculations of the minimum off-street parking requirements based on this formula:

Staff finds that 204 parking spaces are required for the building. There are currently 455 parking spaces
available for the building,therefore with the change of use, there are 251 additional parking spaces above
the required minimum on site.Upon review of the applicant's plans and narrative,staff finds this proposal
is in compliance with all other applicable requirements of this title.This criterion is met.
2. The modification is not a major modification.
The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this
proposal is not a major modification. This criterion is met.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Title.

A minor modification is a Type I procedure.As such, this decision is final for purposes of appeal on the

appealable locally,and is the final decision of the City.
THIS DECISION IS FINAL ON FEBRUARY 4TH, 2018,
AND BECOMES EFFECTIVE ON FEBRUARY 5TH, 2018.
