R-7: Medium-Density Residential Zone.The R-7 zone is designed to accommodate attached single-family homes, detached single-family homes with or without accessory dwelling units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks are permitted outright. Some civic and institutional uses are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.520 UFR2019-00001 Elderberry Ridge —Urban Forestry Plan Modification 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request,subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. Prior to issuance of building permits, the applicant must pay a fee in-lieu of planting five (5) street trees. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The applicant proposes to modify the Urban Forestry Plan approved under the Elderberry Ridge Planned Development (Case Nos. PDR2016-00009, SUB2016-00007, and SLR2016-00009), which is located south of SW Bonita Road, west of SW 74th Avenue, and east of SW 79th Avenue. This Planned Development was approved by the City of Tigard Planning Commission in January 2017 for 40 lots.The subject properties are zoned Low-Density Residential (R-4.5) and Medium-Density Residential (R-7). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.520.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Application A. Approval process. Except as exempted in Subsection 18.520.070.B, an application for a modification to the urban forestry plan component of an approved land use shall be processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Subsection 18.520.070.C. The applicant proposes to modify the Urban Forestry Plan approved under the Elderberry Ridge Planned Development (Case Nos. PDR2016-00009, SUB2016-00007, and SLR2016-00009). Specifically the applicant proposes to reduce the number of street trees proposed for planting,and to pay a fee in-lieu of planting five (5) street trees. This proposal is not exempt from the Type I Urban Forestry Plan Modification. Therefore, this application is subject to the approval criteria outlined below. The applicant also proposes to preserve three (3) trees in Tracts D and E that were originally proposed for removal, and to plant two (2) new on-site trees. However, these modifications are exempt from the Type I Urban Forestry Plan Modification, as they result in the same or greater amount of effective tree canopy that was calculated in the original Urban Forestry Plan (CDC 18.520.070.B.2). C. Approval criteria. The approval authority shall approve or approve with conditions the modification to the urban forestry plan component of an approved land use application when all of the following are met: UFR2019-00001 Elderberry Ridge —Urban Forestry Plan Modification 2 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist has provided a revised report and statement (dated October 18,2017) certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. During the construction process, the developer encountered conflicts with the locations of underground utilities and proposed driveways that were not anticipated during land use review. These conflicts will result in the developer planting fewer street trees than what was originally approved with the Elderberry Ridge Planned Development. The linear amount of street frontage for this development is 2,673 feet; therefore, this development is required to have a minimum of 67 street trees (2,673 feet divided by 40 feet,rounded to the nearest whole number).The applicant proposes to plant 62 street trees,and to pay a fee in-lieu of planting five (5) street trees. Staff finds this proposal meets the minimum street tree requirements outlined in CDC 18.320.040.B, and has included a condition of approval for the applicant to pay the fee in-lieu prior to issuance of building permits. Additionally, the revised supplemental report demonstrates how this development will continue to exceed minimum effective tree canopy requirements for the R-4.5 and R- 7 Zones. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The applicant has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.520.030. (Ord. 17-22 §2) The applicant submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with CDC 18.520.030, including tree preservation, protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Elderberry Ridge Planned Development meets all applicable approval criteria. There are no exemptions involved and thus Subsection 18.520.070.B is not applicable to this request. This modification to the approved Urban Forestry Plan is submitted and processed as a Type I procedure. A completed and signed Type 1 Minor Modification application form is submitted along with the required items, including filing fee, this applicant narrative and copies of the approved Urban Forestry Site Plan sheets. In addition, also included with this Type I application is a copy of the October 2017 Urban Forestry Plan for Elderberry Ridge prepared by Morgan Holen & Associated, the project Arborist. This report was submitted to City Planning in Fall 2017 as part of the final engineering plan review and approval process. The approval criteria in Subsection 18.520.070.0 are addressed herein below. C. Approval criteria. The approval authority shall approve or approve with conditions the modification to the urban forestry plan component of an approved land use application when all of the following are met: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; Applicant Response The previously approved urban forestry plan did not account for site plan revisions that lead to the proposed modifications. The previously approved urban forestry plan was based on the design Page 1 of 2 phase site plan, which was revised with construction documents. The total number of building lots was reduced from 43 to 40, two trees in a vegetated buffer(tract D) must be retained, and one tree in tract E can also be retained based on the revised lot layout. Proposed street trees were adjusted provided more detailed information regarding driveway locations and underground utilities. The proposed modifications were unavoidable considering the revised site plan. The City's canopy cover requirements continue to be satisfied, however a payment in lieu of street tree planting is required for five trees. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and Applicant Response There is no practicable alternative to the proposed modifications. Justifications for the proposed modifications have been described throughout this report. These changes provide the most practicable Urban Forestry Plan for the project and satisfy the City's requirements. 3. Modifications are identified in bold underlined type.These changes are not exempt from a Type I land use decision to modify the Urban Forestry Plan component of an approved land use permit.The relevant criteria are discussed herein.The applicant will be required to pay a $711 review fee to the City. Scope of Work and Limitations Morgan Holen &Associates, LLC, was contracted by Riverside Homes to visually assess existing trees measuring six inches in diameter and larger in terms of general condition and suitability for preservation with development and prepare an Urban Forestry Plan to satisfy City of Tigard code requirements.The site is planned for residential development, including 43 lots, new streets, and storm water tracts.A site plan was provided by Westlake Consultants illustrating the location of trees and tree survey point numbers, and potential construction impacts. Visual Tree Assessment(VTA1) was performed on individual trees located across the site.Trees were evaluated in terms of species, size, general condition, suitability for preservation, and potential construction impacts, and treatment recommendations include remove, retain, or protect off-site. Limited visual assessment was performed for off-site trees located directly adjacent to the project site because access for complete assessment was not authorized on adjacent private properties. Following the inventory fieldwork, we coordinated with Westlake Consultants to discuss and finalize treatment recommendations based on the proposed site plan. The client may choose to accept or disregard the recommendations contained herein, or seek additional advice. Urban Forest Plan—Supplemental Report Elderberry Ridge Subdivision,Tigard,OR May 30,2016 I Revised:October 18, 2017 Page 2 General Description The complete site includes three existing homes, which will be demolished for site development. In all, 72 trees measuring six inches and larger in diameter were inventoried, including 18 different species and 21 trees located off-site within 25-feet of the development impact area. Of the 51 on-site trees,49% received condition ratings of less than two and 53% received suitability for preservation ratings of less than two. The 21 off-site trees can be protected during construction. The trees to be protected off-site will not require much consideration due to their distance from proposed construction impacts, except for tree #31799, a 4-inch diameter Norway maple (Acer platanoides) located adjacent to the existing sidewalk along the east side of SW 76th Avenue—this tree is located adjacent to street improvements associated with the project, but adequate protection can be provided with silt fencing established at the property boundary for tree protection. None of the on-site trees are planned for retention with site development,except for trees 32236 and 32237 in tract D and tree 32387 in tract E;tracts D and E are not included in the development impact area and no canopy cover credit is provided for retaining these trees.The driplines of these three trees do overlap proposed construction areas and tree protection specifications are provided.The other on-site trees are planned for removal;adequate protection is not possible based on their locations in proximity to the proposed grading, building and other site improvements. A complete description of individual trees located on and adjacent to the project site is included in the enclosed existing tree inventory data (attachment A). Effective Tree Canopy Cover In the R-4.5 and R-7 zoning districts,the minimum required effective tree canopy for each lot is 15%and the minimum required effective tree canopy for the overall development site is 40%.A summary of the effective tree canopy cover by lot and across the overall development site is included as attachment B. No canopy credit is provided by off-site trees to be protected, or the three trees now planned for preservation in tracts D and E. Canopy credit will be provided by planting 64 individual trees and a stand of 11 native trees in storm water tract B. Note that tracts D and E are not subject to this Urban Forestry Plan according to Westlake Consultants. The required quantity of street trees is determined by dividing the total linear street frontage by 40. In this case, the total street frontage is 2,673 feet and 67 street trees are required. However, only 62 street trees are proposed,which is the maximum number of trees that can reasonably be planted based on the City's various spacing requirements and in an effort to satisfy canopy cover requirements by planting a mix of species with variable mature statures.The 62 proposed street trees provide the closest and best spacing possible.The proposed street trees comply with the street tree planting standards in Section 2 of the Urban Forestry Manual and with the soil volume standards in Section 12. Per Section 18.745.040.G, "In cases where it is not practicable to provide the minimum number of required street trees,the director may allow the applicant to remit payment into the urban forestry fund for tree planting and early establishment in an amount equivalent to the city's cost to plant and maintain a street tree for three years (per the street tree planting standards in the Urban Forestry Manual)for each tree below the minimum required." In this case, payment of an in lieu of planting Urban Forest Plan—Supplemental Report Elderberry Ridge Subdivision,Tigard,OR May 30,2016 I Revised:October 18,2017 Page 3 fee is proposed for five street trees in order to satisfy the street tree planting requirement.The City's 17/18 Fee Schedule lists the applicable fee as $566 per tree.The required total payment in lieu of street tree planting is$2,830. In addition to the 62 proposed street trees and in order to satisfy the 40%effective tree canopy cover requirement for the overall development site, one tree is proposed on each of lots 16 and 20. In addition to the 64 individual trees described in the planted tree inventory (attachment C),tract B includes a planted stand of native trees.Tree quantities were determined by Westlake Consultants based on CWS standards and include four cascaras (Rhamnus purshiana),four Oregon ashes (Fraxinus latifolia), and three bitter cherries(Prunus emarqinata). The effective tree canopy cover summary(attachment B) demonstrates that the minimum effective tree canopy cover requirements are satisfied for each lot and tract, and the overall development site. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual, which illustrate how the Urban Forestry Plan requirements are met. Specifications A. Tree Protection Specifications 1. Tree Protection Zone.The project arborist shall designate the Tree Protection Zone (TPZ). Where feasible,the TPZ shall be established at the dripline of protected trees as a minimum.The location of the TPZ shall be shown on construction drawings. If infrastructure must be installed closer to the trees,the TPZ may be established within the dripline area if the project arborist determines that the trees will not be unduly damaged. The contractor is responsible for coordinating with the project arborist prior to working beneath protected tree driplines. 2. Protection Fencing.All trees to be retained shall be protected by 5-foot tall metal fencing unless otherwise approved by the city manager or designee. Protection fencing shall be secured to steel posts placed no further than 8-feet apart and shall be installed at the edge of the TPZ. Exception:Silt fencing is recommended for the protection of off-site tree#31799. 3. Preconstruction Conference.The project arborist shall be on site to discuss methods of tree removal and tree protection prior to any construction. 4. Pruning.The project arborist can help identify if and where pruning is necessary once trees planned for removal have been removed and the site is staked and prepared for construction. Pruning shall be performed by a Qualified Tree Service. 5. Tree Protection Zone Maintenance.The protection fencing shall not be moved, removed, or entered by equipment except under direction of the project arborist. 6. Storage of Material or Equipment.The contractor shall not store materials or equipment within the TPZ. 7. Excavation. Excavation beneath protected tree driplines shall be avoided if alternatives are available. If excavation is unavoidable,the project arborist shall evaluate the proposed excavation to determine methods to minimize impacts to Urban Forest Plan—Supplemental Report Elderberry Ridge Subdivision,Tigard,OR May 30,2016 I Revised: October 18, 2017 Page 4 trees. All construction beneath the dripline of protected trees shall be under the on- site technical supervision of the project arborist. 8. Landscaping. Following construction and where landscaping is desired, apply approximately 3-inches of mulch beneath the dripline of protected trees, but not directly against tree trunks. Shrubs and ground covers may be planted within tree protection areas. If irrigation is used, use drip irrigation only beneath the driplines of protected trees. 9. Tree Protection Inspection.The project arborist shall inspect and verify the location of protection measures prior to construction, monitor tree protection measures regularly, and provide biweekly written reports to the City during periods of active construction. 10. Final Report.After the project has been completed,the project arborist shall provide a final report that describes the measures needed to maintain and protect the remaining trees. B. Soil Characteristics and Specifications for Improvement Native soils at the project site consist of Hillsboro loam (-87%) and Quatama loam (-13%), which are both deep, well drained and capable of supporting healthy tree growth. No soil amendments are proposed, but could be recommended by the landscape contractor at the time of new tree installation. If soil compaction occurs during construction, the project arborist should provide additional recommendations as needed. C. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements should conform to the applicable standards in the Tigard Urban Forestry Manual and be planted in accordance with the American National Standards Institute (ANSI)standards for tree planting (A300, Part 6) and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock should meet the requirements of the American Association of Nurserymen for nursery stock (ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability during the establishment period. Root barriers shall be installed according to manufacturer's specifications when a street tree is planted within five feet of any hard surface, paving, or utility box. If needed, irrigation should be design/build by the landscape contractor. Criteria for Urban Forestry Plan Modifications Tigard Municipal Code Section 18.790.070 requires that any modification to the urban forestry plan component of an approved land use permit shall be processed as a Type I land use decision.There are exemptions to the Type I procedure,which are not applicable in this case.Therefore,the approval criteria in subsection D of this section are applicable: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The previously approved urban forestry plan did not account for site plan revisions that lead to the proposed modifications.The previously approved urban forestry plan was based on the design phase site plan,which was revised with construction documents.The total number of building lots was reduced from 43 to 40,two trees in a vegetated buffer(tract D) must be retained, and one tree in tract E can also be retained based on the revised lot Urban Forest Plan—Supplemental Report Elderberry Ridge Subdivision,Tigard,OR May 30,2016 I Revised:October 18,2017 Page 5 layout. Proposed street trees were adjusted provided more detailed information regarding driveway locations and underground utilities.The proposed modifications were unavoidable considering the revised site plan. The City's canopy cover requirements continue to be satisfied, however a payment in lieu of street tree planting is required for five trees. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and There is no practicable alternative to the proposed modifications. Justifications for the proposed modifications have been described throughout this report.These changes provide the most practicable Urban Forestry Plan for the project and satisfy the City's requirements. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan,compliance with Section 18.790.030. This revised Urban Forestry Plan is provided in compliance with Section 18.790.030. Note that a street tree payment in lieu is required for five trees.
