1 . Streets:
The site is served by a private Street ; S.W. Peppertree Lane, which
has access to S.W. 100th Avenue between S.W. Sattler and Murdock.
Last year the applicant requested, and received approval, for a
Minor Land Partition, MLP 90-23 and MLP 90-24, which created 2 and
3 lots respectively. As a requirement of these MLP's the applicant
was required to sign a non-remonstrance agreement for a Local
Improvement District for the improvements to S.W. 100th Ave.
Therefore, no additional requirements are needed.
2. Sanitary Sewer:
There are no existing sanitary sewer lines within 300 fest of this
proposed development. As was a requirement of the two previous land
division in this vicinity the applicant was required to gain
approval from the Washington County Sanitarian to install a septic
system. Therefore, it should be required for the applicant to
submit evidence that the Washington County Sanitarian will approve
a septic system for the newly created lot.
3. Storm Sewer:
Existing storm water is directed, via the private street, to drain
to the existing public system within S.W. 100th Avenue. Therefore,
no additional requirements are needed.

Information Bulletin
A minor land partitioning is the division of a tract of land
into three or fewer parcels within one calendar year. No
new street or road is created in a minor partition.

The application and approval process for a minor partition
is as follows:

decision by mail. The amount of time you can expect
preliminary approval to take will be 1etermined a•: your
pre-application conference.
6. Final Amumfjl - If the application is approved, tae
applicant must then submit three copies of the
partition plat prepared by a land surveyor or engineer
licensed to practice in Oregon as well as the necessary
information related to the map.

surveyors, the partition may then be recorded by the
applicant with Washington County. The partitions may
not be sold or developed until recording has occurred.

a 46,981 sq. ft. parcel into parcels of 22, 300 and 24,681 sq. ft.
Zoning Designations R-3.5 (Residential, 3.5 units per acre) .

DECISION, Notice is hereby given that the Planning Director's
designee for the City of Tigard has APPROVED the above request
subject to certain conditions. The findings and conclusions on
which the decision was based are noted belowi
A. FINDINGS OF FACT
1 . Background
On November 14, 1990, the Planning Division approved
Minor Land Partitions MLP 90-23 and MLP 90-24 which
created the 46,981 square foot subject parcel and four
adjacent parcels from two existing lots. The parent
parcel for the 46,981 square foot parcels parent was
divided into three of the parcels. That partition was
recorded in December, 1990.
2 . Vicinity Information
The subject parcel is surrounded by other properties that
are zoned R-3. 5 and are developed with single family
residences on large lots. SW Peppertree Lane is a
private street extending eastward from SW 100th Avenue.
SW Peppertree Lane contains 24 feet of pavement, curbs,
and a sidewalk on one side. The lane terminates in a
hammerhead shaped turnaround.
3 . Proposal Description
The applicants request Minor Land Partition approval to
divide the 46, 91 square foot parcel into two parcels of
22, 300 and 24 , 681 square feet as illustrated on the
attached map. The 22, 300 square foot parcel would
contain the existing house. Access to the 24,681 square
foot lot would be provided by a 15 foot wide access
"pole. " The applicants intend for a future residence on
this lot to be served by a septic nr...7m, as are the
other homes in this area. The awi:_.ation material
submitted includes a site evaluation report from the
Washington County Sanitarian's office approving this lot
for septic tank installation. Other utilities are
provided within the private street.

4 . Agency and NPO Comments
The Engineering Division has reviewed the proposal and
provides the following commenter
a. Streeter
The site is served by a private street - S.M.
Peppertree Lane, which has access to S.M. 100th
Avenue between S.W. Battler and Murdock.
Last year the applicant requested, and received
approval, for two Minor Land Partitions, MLP 90-23
and MLP 9-24, which created 2 and 3 lots
respectively. As a requirement of these partition
approvals, the applicant was required to sign a non-
remonstrance agreement for participation in any
future local improvement district for improvements
to S.M. 100th Avenue. Therefore, no additional
requirements are needed.
b. Sanitary Sewers
There are no existing sanitary sewer lines within
300 feet of this proposed development. As was a
requirement of the two previous land divisions in
this vicinity, the applicant was required to gain
approval from the Washington County Sanitarian to
install a septic system. Therefore, it should be
required for the applicant to submit evidence that
the Washington County Sanitarian will approve a
septic system for the newly created lot.
c. Storm Sewers
Existing storm water is directed, via the private
street, to drain to the existing public system
within S.W. 100th Avenue. Therefore, no additional
requirements are needed.
The Building Division, Tigard Water District, GTE, and
PGE have reviewed the proposal and have offered no
comments or objections.
No other comments have been received.
B. ANALYSIS AND CONCLUSION
The proposed minor land partition, as shown on the
attached map, complies with the minor land partition
approval criteria specified by Sections 18. 162 .030 and

18. 162 .050 of the Community Development Coda. Those
criteria ares
18.162.030 Partition A oroval Criteria - A request
to partition land shall meet allof the following
criteria:
( 1) The proposal conforms with the City's
Comprehensive Plan;
(2) The proposed partition complies with all
statutory and ordinance requirements and
regulations;
(3) Adequate public facilities are available to
serve the proposal;
(4) All proposed lots conform to the size and
dimensional requirements of this Code; and
( 5) All proposed improvements meat City and
applicable agency standards.
18. 162.050 Special Provisions for Lots Created
Through Partition Promos'),
(a) Lot Width. The minimum width of the building
envelope area shall meet the lot requirement of
the applicable zoning district.
(b) Lgt Aree. The lot area shall be as required by
the applicable zoning district. In the case of
a flag lot, the accesawayy may not be included
in the lot area calculation.
(c) Lot Frontage. Each lot created through the
partition process shall front a public right-
of-way by at least 15 feet.
(d) setbea. Setbacks shall be as required by the
applicable zoning district.
(e) Front Yard Determination for flat Lot. When
the partitioned lot is a flag lot, the
developer may determine the location of the
front yard, provided that no side yard is less
than 10 feet. Structures shall generally be
located so as to maximise separation from
existing structures.

provided along the property line of a lot of

record where the paved drive in and accesawey
is located within 10 feet of an abutting lot in
accordance with Sections 18.000.080 and
18. 100.090. Screening may also be required to
maintain privacy for abutting lots and to
provide usable outdoor recreation areas for
proposed development.
(g) Fire Protection. The Fire District may require
the installation of a fire hydrant where the
length of an accessway would have a detrimental
effect on fire-fighting capabilities.
(h) Reciprocal Easements. Where a common drive is
to be provided to serve more than one lot, a
reciprocal easement which will insure access
and maintenance rights shall be recorded with
the approved partition map.
( i ) ,ncessway. Any accessway shall comply with the
standards set forth in Chapter 18. 108 (Access
and Egress) .
The proposed partitioning would promote infilling of
vacant and underdeveloped residentially designated
properties within an otherwise developed area, and thus
would promote development closer to the maximum Low
Density Residential opportunity called for by the
Comprehensive Plan for this area. The proposal complies
with applicable requirements of the Plan and Community
Development Code. Both parcels will exceed the 10,000
square foot minimum lot size and the 65 foot average
minimum lot width standard of the R-3.5 zoning district.
The existing house would continue to satisfy applicable
setback standards .
Both parcels will be adequately served by necessary
public facilities including water, fire hydrants, and
other utilities . Because the parcels are greater than
300 feet from an existing sanitary sewer, development on
the proposed parcels may be served by septic systems. A
septic system is serving the existing residence and the
applicants have provided • copy of the County
Sanitarian's approval for a septic system on the other
parcel to be created. Storm drainage will be handled by
on-site drainage facilities.
Community Deve).opment Code Section 18. 162.050.0 requires
that each lot created through the partition process front
on a public right-of-way for at least 15 feet or else
have a legally recorded minimum 15 foot access easement.
Both parcels would share in ownership and maintenance

responsibilities for the private street, Peppertree Lane,
which provides access to a public right-of-way and is
felly improved with the necessary improvements for a
street serving up to six dwelling units. Therefore, all
applicable access requirements are satisfied.
Because of the proposed relatively short length of the
access pole to proposed parcel 2 and the depth of the
rear yard of parcel 1, the City of Tigard will not
require screening )f this accessway. The existing house
on parcel 1 will be a sufficient distance from the
accessway that residents should not be adversely affected
by noise or lights from vehicles on this accessway.
C. DECISION
The Planning Director's designee APPROVES Minor Land
Partition MLP 91-0009 subject to the following conditions

1 . A partition survey plat with an outbound description
shall be submitted to the Engineering Department
before recording in Accordance with the requirements
of Code Section 18 . 162 .080. .
SECTION 18. 162 .080 Final Plat Application
Submission Requirements
A. Three copies of the partition plat
prepared by a land surveyor or engineer
licensed to practice in Oregon, and
necessary data or narrative.
B. The partition plat and data or narrative
shall be drawn to the minimum standards
set forth by the Oregon Revised Statutes
(ORS 92.05) , Washington County, and by the
City of Tigard.
2 . Upon the Engineering Division's approval of than
partition plat, the applicant shall record the plat
with the Washington County Department of Records and
Taxation. The Engineering Division shall be
informed of the plat's recordation number as soon as
practicable. A reproducible Eyler plat of the
partition shall be submitted to the City within 15
days of the plat's recording.
APPROVAL IS VALID IF EXERCISED WITHIN 18 MONTHS OF THE PIMAL
