Box 23397 Tigard, Oregon 97223 Dear Mr. Howard: Under the Residential Commercial Zone (C-4) of the City's Zoning Ordinance, among the uses permitted are department store, drug store, jewelry store and professional and commercial office buildings, etc. (See Chapter 18.32) . Considering the intent of the Zoning Ordinance and the nature of those uses permitted, I believe a branch office of a bank is a permitted use under the "Commercial office building" category of the C-4 Zone. It seems to me that a branch office of a bank is more appropriate to be considered within the residential commercial zone than uses such as a department store or a jewelry store. The 24 foot private street at the N.W. corner of the complex needs to be altered so that there is a 50 foot turning radius from center of street to center of street to allow fire apparatus accessability at this point. The other private driveway appears to be satisfactory. There will have to be fire hydrants placed on the site in order to meet the minimum fire flow requirements. The Planning Commission approved the zone change. Formal action by the City Council should take place on September 22, 1980. I have this recurring fear that we are tbout to collide with each other concerning future development around the Durham Plant. Co the enclosed map I have outlined our current zoning designations. Note the R-5 Single Family north across Durham. This area is outside the City but will become an "island" very soon. R-5 allows six (6) units per acre--a rather intense density. The area just south of the Tigard High School and west of your plant will develop soon. The City will ask for approximately eighteen (18) a' es of floodplain to add to Cook "ark. In "exchange" for the floodplain I anticipate that the project owner will request an A-12 density (12 unite per acre) and construct either a Mobile Home Park or apartments. We did create an M-4 Industrial Park zo,e an 85th Avenue , south of the High School. This was done with you in wind, however, I do not see a way to "protect" you to a greater degree. Within two (2) years we will improve Durham Road from Upper Boones Ferry west to 99W with a traffic signal at Durham and Hall. This will alleviate some of the traffic concerns you voiced. I make it a point to tell all ^otential developers in the area that USA is a factor that they must cinsider. When we talked to the Tigard School Depa• tment they were primarily co, ,• rned that a retail devlopment be "limited" to small shops--not a Safeway "hangout" for "nooners." Chuckle. I share your concerns, but under the circumstances residential development seems inevitable in your area. Our Neighborhood Planning Organization number 6 studied land use in this area and did not suggest the M-4 zone for all land south of Durham Road west of the plant. Howard objected to their threat to carry on with the Laz.d Use Board of Appeals if they do not get what they want at this hearing. He felt this belied their avowed desire to cooperate. Howard stated the Lommission would not have to hear this applicant again, because if he would accept the PD designation the Commission can, at this meeting, approve both a preliminary and general plan for this development. Also required would be submission by the applicant of language agreeable to the Planning Director and Public Works Director to assure maintenance by the homeowners of the greenway. The R-5 desi;,n:.tion is mandated by the comprehensive plan, and the PD designation by the sensitive lands involved. The applicant's next appearance would be before the City Council. Elton's major concern is that the lotting pattern be not changed, since he feels it is a very good ono. Howard pointed out that the City Council does have the power to make any changes they desire. COMMISSION DISCUSSION AND ACTION: Bonn felt thio wan a good development now. Funk wondered if one or two additional lots could be secured under the R-5 designation, but the applicant does not desire any more. After some further discussion, Bonn MOVED approval of Subdivision S 6-79/Zone Change Planned Development ZCPD 25-80, together with approval of the planned unit development at the preliminary and general plan level, based on staff findings and recommendations, with changes in recommended conditions as follows: ••• 9. Second sentence to read: "Easement to be terminated when temporary arcesn to Durham Road in terminated." ••• 15. Delete in the last sentence the words "recording of the final plat o.•". ••• Add 20: On lots abutting sensitive lands, buildings may be constructed to the edge of the sensitive lands, even though this may not be in accord with a etrirt application of the setback requirements. He expressed the opinion commercial-retail on the property at the northwest corner of Hall and Durham would be more compatible than medium density residential. APPLICANT'S PRESENTATION: Paul Yang, representative of The Robert Randall Company, stated they proposed downzoning 94 per cent of the property, using only 6 per cent of it for residential retail applica- tion. This request on their part is based on their market analysis. They propose 9 units per acre rather than 1? per acre as allowed by the requested zone. PUBLIC TESTIMOtNY: Speaking basically in opposition, but also in order to got additional information on the proposal, were -- ••• Ron Blau:, 8840 SW Avon Court, who inquired the nature of the apartments contemplated. Yang stated they propose condominiums, some of which would bo two story along the western boundary. Black inquired what tho property to the north of the project is zoned. Howard stated both sides of Hall Boulevard in this a"ea are zoned R-5, and pointed out that a condition ii use at this zoning is duplexes or attached single family on 10,000 foot lots. Black inquired about possibility of relief from a bac' traffic situation--one entrance only, onto Durham Road--in his devalopient. Howard outlined ,.he relief that would come from the Durham Road LID and development of tt.e rest of the property between Durham and Sattler Roads. Additional concerns expressed were vandalism from apartment dwellers and docreane in property values i due to adjacent multiple housing. He inquired about the procedures in general, responded to by Howard. \\ "" Dale Tallman, 8895 SW Avon Court, expressed concern about an apartment complex across the stroat from the high school. ••• Ron Dennis, 88P0 Sly Avon Court, objected to a two-story condominium adjacent to him back :ard. ••• An unidentified woman inquired the typo of commercial development, responded to by Yang, who described possible residential service type establishments in the 7,000 square foot building. A11D REAUTTAL: Yang explained possibilities under the present zoning, and the benefits to the area from the down- zoning as pro nosed. He explained that whether the units would bo rented by Randall or sold as condominiums would depend upon the economic climate. He explained why a developer can achieve a better looking and better landscaped community than a community of individual property owners. As a result of questions raised, the president n'iggeated the neighbors look at other Robert Randall projects in the area, and that the Randall Company meet with the residents of the adjoining development to explain what is proposed. IIYang asked Recommendations 9 and 10 be changed by substituting "occupancy permits" for 'buildinp permits" -- readily agreed to by Howard. Howard then added Condition 14 as follows: "Dedication along the south boundary sufficien' to provide 45 feet of right-of-way from the center line of Durham Road shall be made; and nonremonstrance agreements for a Durham Road LID shall be made a portion of the final plat, and made a part of each deed." Because of this, the reference in Condition 1 to Durham Road is stricken. COV!MISSION DISCUSSION AND ACTION: Funk oxprosocd concern about the commercial portion, wishing it deleted entirely; but if it is developed be qu -boned whether it should exit on Durham. Herron expressed the L concern, citing the Durham Grade School just a little east on b..rham. The consensus favored the commercial portion facing Hall Boulevard. Bonn MOVED approval of ZC/CPR 2,3-80, based on staff findings and recommendations, with recommendations modified as follows: ••• 1. Reference to SW Durham Road deleted. ••• 2. A large retail use is not appropriate for this site. I . FINDINGS OF FACT: 1. The NPO 06 Policy allows for a maximum of twelve (12) dwelling units to the acre in a multifamily zone. 2. The site is not within any drainage basin, floodplain, sensitive lands area or greenway. 3. The area to the north is vacant land; to the west are single family homes and durlexes; Tigard High School is to the southwest while an industrial park lies to the south. The rigard Water Treatment Plant is to the southeast of the site. 4. Sewer service is available to the site off of Durham road. 5. CONCLUSIONARY FINDINGS: 1. The proposed seventy-two (72) units are the maximum allowed in the A-12 Zoning on 8.66 acres. 2. Half-street improvements will be needed on SW Hall Blvd. and SW Durham Road. 3. Increased traffic loads cou:d create problems at the intersection of SW Hall Blvd. and SW Durham Road. The applicant should work with the Oregon Dxoartment of Transportation (O.D.O.T.) on this intersection. 4. The Tigari School District should be contacted regarding the impact of the proposed project on schools. III . STAFF RECr'MMENDATION: Staff recommends approval of a Comprehensive Plan Revision for this site subject to the following conditions: 1 Half-street improvements will be made forty-five (45') feet from the centerline of SW Hall Blvd, f�assa to allow for a future ninty (90') foot right-of-way . In addition, because of the size of the Durham Facility , vehicle traffic moving personnel and materials in and out is periodically heavy. I►. A I. EXISTING CONDITIONS: Characteristics of the site and the surrounding area. A. Natural Conditions The site proposed for the Plan Amendment and zonin; designation presently is designated Retail-Commercial by Tigard Neighborhood Plan #6, but has no zoning designation. It contains 8.66 acres, is level and rectangular in shape, being approximately 710 feet by 475 feet. The property is currently developed with one sin- gle family residence, a garage structure and a barn, while the balance of the site is vacant and covered with grasses. The only trues present are a small number which shade the house and outbuildings. B. Adjacent Development 1 . Residential The area to the north and west of the site is designated Urban Low Density by Tigard' s N.P.O. #6 (R-7 zone) , while that to the south is designated Institutional (M-4 zone) . The area to the easy_ is outside the boundaries of N.P.O. 06, but contains single family development. The arca north of the site is presently vacant land, while a development of single family and du•,lex housing borders it to the west. To the south is an industrial park, while Tigard High School lies to the southwest. The Tigard Water Treatment Plant lies on the corner southeast of the property. The nearest multi-family developments are a small apartment complex at the corner of S. W. Hall and S W. Bonita Road, and a rilti-family development near Pacific Highway on S. W. Durham Road. Commercial and Industrial Interstate S passes one mile to the east of the site, while Highway 99W passes two miles to the west and one and three- quarters miles to the north. Multiple shopping facilities arc located within two miles, both in the King City Plaza and the downtown Tigard area. Hall Blvd. and Highway 217 also provide easy access to the Washington Square Shopping Center. The Durham Hall Business Park is located directly across Durham Road, while a variety of manufacturing firms are located in the Tigard area. Various gasoline stations are located along 1-5 and 99W, and Tri-Met provides bus service to Tigard, Lake Oswego and the Portland area. Bus connections are located within 1/2 mile on S. W. Hall Blvd. and 3/4 mile on S. W, Durham Rd. -1- 1, C. Existing Urban Services 1. Schools (See attached Exhibit A) The property is located within Tigard School District 23J. Existing schools can a..comudate the small increase of junior high and high school students. Although both elementary schools are expected to open at or near capacity, the small increase in elementary school children (a maximum of eight students using the accepted Washington County and City of Beaverton standard statistics) shauld not place an undue burden on the school system. 2. Utilities Water and sewer service are available for the site. Utility letters will be forwarded as soon as they arc made available to the applicant. Other available services include fire and police protection. 3. Streets The site is bounded on the south by S. W. Durham Rd. and on the east by S. W. (tall Blvd. The residential section of the proposed development would have points of access on both Hall and Durham, while the small commercial section would have two points of access on Durham. The applicant is pre- pared to build a half-street improvement on both Hall and Durham to mitigate any excess traffic burden. II. PROPOSAL This application proposes to change the existing Plan designation on the site from Cot ,ercial-Retail to Urban Medium Density (an A-l2 zoning designation) on all but a 22,000 square foot section on the southeast corner of the property. The Plan designation of this section would be changed to Residential-Commercial (with a C-4 zoning designation) . The proposed use for the site is for multiple-family dwellings containing a total of 72 units, with a small commercial area (consistent with the C-4 zoniig requirements) on the corner section. The site is easily capable of accomodating the proposed development while at the same time giving consideration to planning constraints and goals. III. PLAN AMENDMENT EVALUATION CRITERIA A. Conformance with the Tigard Community Plan Coals -2- III. A. 1. Housing The Tigard Community Plan recognizes that it is essential to a community which is rapidly becoming a regional popu- lation and economic center in its own right to provide for alternative types of housing, not only for an increasingly diversified population, but out of the realization that the housing needs of existing residents do not remain static over time. The proposed Plan Amendment offers the potential for a development providing an alternative housing form in a moderate price range, with the advantage of adjacent neighborhood shopping conveniences. 2. Character of Existing Neighborhood The Plan also points out the importance of maintaining the character of the existing neighborhood. The applicant hopes to provide housing which due to innovative site design and landscaping techniques will not only be attractive to its residents, but equally acceptable to surrounding landowners. 3. Greenways and Open Spaces The applicant recognizes the importance of open space as a major factor in enhancing a community's "livability." One of the greatest advantages of the proposed type of de- velopment is its ability to provide proportionately large amounts of open space, unbroken by lot lines and fences as in traditional single-family housing. 4. Traffic - Access The Plan states that "the ability of streets to move cars to and from multi-family development is a major locational consideration for selecting apartment sites." One of the major advantages of the site in question is that it is lo- cated at the junction of two arterials, both of which pro- vide direct access to major highways. The half-street improvements for S. W. Hall and S. W. Durham proposed by the applicant will further reduce traffic concentration in the area, while providing easy access to the proposed com- mercial center. 5. Convenience in Location - Shopping Facilities The property is within two miles of most shopping facilities and within eight miles of the Washington Square Shopping Center. The proposed neighborhood commercial center on the site should take care of small convenience needs, les- sening traffic generation and increasing the desirability of the site. -3- 1 II:. A. 6. Location of Schools and Parks The site is located within Tigard School District 23J. Tigard Senior High School is located within easy walking distance, while junior high and elementary schools are in the general vicinity. The property, as well as provid- ing its own open space for resident 's use and enjoyment, is also within three miles of both Cook Park and Avalon Park. B. Existing Public Need According to the Tigard-Tualatin Business Directory, the City of Tigard is "No longer a bedroom community, no longer a 'strip city'. . . [but] . . .has become a self-sustained community of diverse economic, recreational and civic resources." Its population has .ncreased 176.3% between 1970 and 1979, as compared to a county- wide increase of 40.6c. Its economy, once based almost entirely on agriculture or highway commerce, has taken on great diversi- fication, including a variety of manufacturing firms as well as full financial and commercial services. These facts point out a need for new heosing in the Tigard area, and are confirmed by a demand for housing that continually outstrips the existing supply despite escalating housing costs. This demand has not been for single-family housing alone. The decrease in the average number of people per household, rising prices, and the housing shortage have combined with the still- prevalent desire for owner-occupied housing to produce an in- creased interest in multiple-family development living. There is significant evidence showing a public need for the proposed Plan Amendment and zoning designation. "he current population growth points up a need for more •ommon wall housing in the Tigard area to meet future needs. Th..) current economic recession also clearly indicates a need for the efficient use of property whose development may he accomplished with the least burden both to the City of Tigard and the developer. The pro- posed commercial development would add to the desirability of the site by providing for convenience shopp ng for the neighbor- hood as well as the proposed residential units. C. Alternatives to the Proposal There are two different types of alternati, es to this proposal ; either to develop at another location or t ) develop this proper'y in another manner. There are few sites ir. the N.P.O. 016 area as w,'ll suited for the proposed develo,iment as this property, in terms of ease of access, character of thf area, and potential for an attractive development. -4- 1 _ III. C. As far as on-site alternatives are concerned, development of the property, whether following the proposed Plan Amendment or with its current designation, will cause an irreversible com- mitment of vacant land to urbanized use. The property in its present state is too small to be econo- mically used for agricultural purposes. One possible alter- native would, therefore, be to leave the property as it is, vacant and unproductive. Another alternative would he to develop the site in a manner consistent with its current desig- nation. Given the surrounding residential development, it is submitted that the current designation of Retail Commercial would have a far more detrimental effect on the neighborhood than the proposed Plan Amendment. A mixed residential and commercial develonment would provide a sort of "middle ground"-- allowing for an orderly transition of the neighborhood to urban- ized use. A third alternative would he to develop the property in a lower density. This would not only frustrate the Tigard Community Plan goals for a variety of housing, but would he an inefficient use of land which, due to its location, is particu- larly adaptable to a multi-family development use. Such an alternative, by maintaining a lower density, would also reinforce a tendency for residential sprawl. D. Impacts Both the propose.t Plan Amendment and the current designation commit the property to urbanized use. Thus the loss of at least some open space is already a forgone conclusion, though it is probable that more would be lost if the site was developed under the current designation. The proposal would not bring about a substantial change to the existing neighborhood. First, the re- sulting development would he mainly residential rather than co'n- mercial . Secondly, the commercial uses permitted under a Residen- tial/Commercial -- C-4 designation have been deliberately restricted so as not tc be a detriment to the neighborhood while at the same time providing for convenience shopping. The existence of this commercial section as well as the proposed improvements to Nall Blvd. and Durham Rd. and the availability of Tri -Met bus service should substantially mitigate the increased traffic flow, which is the only adverse impact of the proposed development. It is important to point out, however, that this incr ase in traffic would be of a far different character than if the site were de- veloped under its current designation. In that situation, the traffic would be unrelated to the surrounding residential area, and would have the affect of transforming Hall Blvd. and Durham Road into major thoroughfares rather than residential arterials. -S- III. E. Conformance of the Proposed Plan Change with the Statewide Planning Goals GOAL 1 -- CITIZEN INVOLVEMENT The public hearing process necessary for any Plan Amendment guarantees that citizens of the community will be involved in the determination of this proposal. GOAL 2 -- LAND USE PLANNING This goal is met by the City's procedures of identification and review of the issues and problems relevant to the proposed Plan Amendment in conjunction with the public hearing process in order to secure the information necessary to make a ,lecision which is in the best interests of the community. GOAL 3 -- AGRICULTURAL LANDS L.C.D.C. has ruled that the provisions of this goal do not apply to urbanized or urbanizable land. The location of this site, as well as its present Plan designation, exempts it from the provi- sions of this goal . GOAL 4 -- FOREST LANDS This goal states that Forest Lands are to be retained if such lands have existing or potential commercial forest uses, are valuable for wildlife, or are needed for windbreaks. Inasmuch as there are no areas of the site which can be classified as Forest Lands, this goal is inapplicable. However, the appli- cant understands the need and beneficial effect of harmonizing the development with the existing trees. GOAL S -- OPEN SPACES, SCENIC AND HISTORIC AREAS AND NATURAL RESOURCES The proposed Pl%n Amendment and d welopment will accomodate this goal by site designing which will insure both open space for the residents and the retention, wherever possible, of the existing features of the property. Furthermore, use of land such as this, which is located at the junction of two major arterials and has available urhan services, permits preservation of open land in other areas. GOAL 6 -- AIR, WATER AND LAND RESOURCES QUALITY This goal ' iii be met by provision of water by the Tigard Water District and provision of sewer services by the City of Tigard. -6- I III. E. GOAL 6 continued The project's location provides direct access to all necessary service and commercial facilities. Tri-Met bus service into Tigard, Lake Oswego and the Portland area is also readily available. GOAL 7 -- AREAS SUBJECT TO NATURAL DISASTERS AND HAZARDS This goal is inapplicable because the presence of any natural hazards applicable to the property has not been discovered. GOAL 8 -- RECREATIONAL NEEDS This goal can be facilitated by the project through proper site design wh;ch would allow open space areas for recreational use by project residents. GOAL 9 -•- ECONOMY OF THE STATE The economy will be aided in the short run by the employment of construction personnel, a factor which is particularly important during the current period of limited construction activity. In the long run, this project will help to bolster the Tigard area by providing affordable, atrractive and efficiently designed housing which will attr:ert an employment base for the growing service and commercial area. GOAL 10 -- HOUSING A basic concept of this development as a moderately priced alter- native form of housing meets the intent of this goal. This pro- ject will provide a new alternative to those who require housing in the immediate arca. GOAL 11 -- PUBLIC FACILITIES AND SERVICES This goal will be facilitated by the orderly application of existing services in a coordinated manner by a single experienced developer familiar with the proper construction of utilities and services. GOAT, 12 -- TRANSP `RTATI ON The close proximity of commercial facilities and employment oppor- tunities help to facilitate this goal , as does the ready avail- ability of mass transit in the form of Tri-Met bus service. The development will aid this goal by site design in cooperation with interested transportation agencies, giving strong consideration to Ie •ening the traffic impact on Hall Blvd. and Durham Rd. -7- lbw �_ __ I/ III. E. GOAL 13 -- ENERGY CONSERVATION The close proximity of employment, service and hsopping facil- ities (some provided by the commercial section of the development) will mean a low demand for long trip lengths for essential services. The actual housing construction will also include many energy- saving techniques and procedures. GOAL 14 -- URBANIZATION The proposed Plan Amendment and zoning designation would facilitate this goal by providing for the infilling of urbanizable land with- in an established Urban Growth Boundary for which public facilities and services are readily available. The proposed use of the site would allow for a more orderly transition to urbanized use than would itvelopment under its current Pl..n designation. IV. CONCLUSION This petition for a Plan Amendment is consistent with all necessary requirements.
