RE : BOUNDARY CHANGE PROPOSAL NO. 2.155 - Annexation of territory
to the City of Tigard .
rroceedings on Proposal No . 2155 commenced upon receipt by the
Boundary Commission of a resolution and property owner consents
from the City of Tigard on Septenb�r 13 , 1933 , requesting that
,ertain property be annexed to the city. The resolution and
property owner consents meet the requirements C.ir i c.s; ..�;; Lng a
propos;,1 if!t, forth in ORS 199 . 490 particularly Section (2) .
Upon receipt of the petition the Boundary Commission published
and posted notice of the public hearing in accordance with ORS
199 . 453 and conducted a public hearing on the proposal on October
17 , 1985 . The Commission also caused a stuffy ;o be 'r-i h-
prom )sai which ( U,is i de,-e 1 , : )nomic , demographic and sociological
trends and projections and physical development of the land .
The Commission reviewei this proposal in light of the following
statutory guidance :
" 199 . 41 ,) Policy. ( 1 ) The Legislative Assembly find that :
( a) A fragmented approach has developed to public ser-
vices provided by local goverhmei% aid such an approach has
limited the ori..trly development and growth of Oregon' s urban
areas to the detriment of the citizens of this state .
( b) The programs and growth of each unit of local gov-
ernment affect not only that particular unit but also the
activities and programs >f a v-arie%y or other units within
each urban area .
( c) As local programs b- r , 'ae lracreasingly inter-
governmel;.a'. , Lica state has a responsibility to insure
orderly determination and adjustment of local government
boundaries to best meet the needs of the people .
(d ) Local comprehensive plans define local land uses but
may nut specify which units of local government are to pro-
vide public services when those servicc!1 •ars �.� auired .
(2 ) The purposes of ORS 199. 410 to 199 .519 are to :

( a) Provide a method for guiding the creation and growth
of cities and special service districts in Oregon in order to
prevent illogical extensions of local government boundaries;
( b) Assure adequate quality and quantity of public ser-
vices and the financial integrity of each unit of local gov-
ernment ;
( c) Provide an impartial foram for the resolution of
local government jurisdictional questions; and
(d ) Provide that boundary determinations are consistent
with local comprehensive planning , in conformance with state-
wide planning goals . However , when the proposed boundary
commission action is within an acknowl,!d: 11 aruan growth
boundary , the st.+ . - ' ! • ,;)als shall not be applied .
The commission shall consile- the timing , phasing and avail-
ability of services in making a boundary determination .
199 . 462 Standards for review of changes ; territory which may
not be included in certain changes . ( 1 ) In order to carry
out the purposes described by ORS 199.410 when reviewing a
petition for a boundary change , a boundary commission shall
consider economic , demographic and sociological trends and
projections pertinent to the proposal , past and prospective
physical developnent or land that would directly or indi-
rectly be affected by the proposed bourndar, chnnJ,, and the
goals adopted under ORS 197 . 225 . "

On the basis of the Findings and Reasons For Decision listed in
Exhibit "A" , the Boundary Commission approved Boundary Change
Proposal No . 2155 as modified on October 17 , 1985 .

Exhibit "B" and depicted on the attached map, be annexed to tht
City of Tigard as of the date of approval .

On the b sis of the study and the public hearing the Commission
found that :
1 . The territory proposed for annexation contains 1 . 1 acres , 1
commercial structure and is evaluated at $1 , 447 ,500 .
2. The property owners petitioned for annexation to obtain
improved police protection .
3. The territory is within METRO and the acknowledged regi. ►nal
Urban Growth Boundary.
4 . The territory is designated Urban on the Washington County
Comprehensive Framework Plan . Current County zoning is
Industrial .
The City and the County have adopted an 1r1)-, i a1.•, iii . 1 �a
Agreement ('JPAA) . This territory is within the City' s "area
of interest" . The Washington County - City of Tigard joint
Urban Planning Area Agreement ( UPAA) includes tie r,li.1. ,.lins
pertinent provision :

the CITY , the CITY agrees to convert COUNTY plan designa-
tions to 'T."'" p'_an 1itgnations which most closely

maintain this designation for one year after the
effective date of annexation unless both the CITY and
COUNTY Planning Directors .jgr At the time of annexation

5 . Under the Urban Planning Area Agreement the City agreed to
convert county planning and zoning designations to one which
is most closely •tporo iat• i in the City' s ordinances . The
City' s Ind'!strial Park 1. )10! is the closest to the existing
county Industrial zone .
6. The territory t ; ai .tiii the Unified Sewerage Agency . There
is a 12" sewer main in Cascade Blvd . serving the site .
7. The territory is within the Metzger Water District . Existing

Metzger )blains its water from the City of Portland with
which it has a 25-year contract to purchase water .
To meet its long-range goals the District approved the
issuance of $ . 75 million in general obligation bonds in
1930. These funds are earmarked for the capital improvements
necessary to meet the water system demands to the Year ..1')fl .
Since the City i, not in he water business the District will
continue to provide water service to this area .
8. The territory is currently served by the Washington County
Rural 7Lre Protection District No . 1 . Annexation will not
affect this service as Wash. Co . RFPD No . ; provides fire,
protection to the the northerly portion ;f ;Ye City of
Tigard .
9 . Upon annex:at io,i the Tigard Police Department will provide
police protection to the site . Currently it is under the
jurisdiction of the Washington :7,),)!t% ;;a.eriff' s Department .

county does not have statistics on response tiAos , ' ) ever
other police officers in the area indicate the county
response time can be up to 30 minutes . The Officer to popu-

for the City of Tigard .

1 . The proposal should be modified to include the road right-or-
way of Soho11s Perry Rd . on the west side of the property .
2. The annexation is consistent with the wishes of the property
owners who desire City services , most particularly improved
police protection .
3. The annexation is consistent with regional , County and City
planning.

A tract of land situated in the Southeast one-quarter of Section
27, and the Southwest one-quarter of Section 26, Township I South,
I' Lange I West of the Willamette Meridian, in the County of Washington
and State of Oregon, more particularly described as follows:
Co'm'mencing at the intersection of the east line of said Section 27
with the north line of Southwest Cascade Boulevard, said point
bears North along the east line of said Section 27, a distance of

A RESOLUTION FURTHERING ANNEXATION TO THE CITY OF TIGARD OF THE TERRITORY AS
OUTLINED IN EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED (Perrin/Schenk

WHEREAS, "consents" in the form of a petition have been presented to the City
of Tigard requesting annexation of a certain tract of land presently
contiguous to the corporate limits of the City; and
WHEREAS, the consents in the form of a petition were signed by the owners of
said tract of land; and
WHEREAS, the City of Tigard Council has reviewed the consents and set the
final boundary for the annextion as required by subsection (2) of ORS 222 . 170;
and
WHEREAS, subsequent to the setting of the final boundary, the consents of land
contained therein represent "more than half of the owners of land in the
territory, who also own more than half of the land in the contiguous territory
and of real property therein representing more than half of the assessed value
of all real property the continguous territory;" and
WHEREAS, the proposed annexation therefore is in accordance with ORS 222 . 170
and constitutes a so-called "triple majority" annexation under ORS 222. 170 and
a "minor boundary change" under Boundary Commission law, ORS 199. 410 to
199. 510.
NOW, THEREFORE, Bf IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF TIGARD, a
municipal corporation of the State of Oregon, at a regular meeting held on the
9th day of September 1985, that.
SECTION 1 The Council hereby approves the proposed annexation and requests
the Commission to approve it and effect it as soon as possible.
SECTION 2 The City Recorder is hereby directed to file certified copies of
the statements of consent and of the Resolution with the Portland Metropolitan
Area Local Government Boundary Commission at once.

WHEREAS, "consents" in the form of a petition have been presented to the City
of Tigard requesting annexation of a certain tract of land presently
contiguous to the corporate limits of the City; and
WHEREAS, the consents in the form of a petition were signed by the owners of
said tract of land; and
WHEREAS, the City of Tigard Council has reviewed the consent and set thy f in,+l
b' undary for the annexation as required by ORS 199 490(2); and
WHEREAS, subsequent to the setting of the final boundary, the consents of land
contained therein represent "more than half of the owners of land in the
territory, who also own more than half of the land in the contiguous territory
and of real property therein representing more than half of the assessed value
of all real property in the contiguous territory;" and
WHEREAS, the proposed annexation therefore is in accordance with ORS 199.490
and constitutes a so-called "triple majority" annexation under ORS 199.490 a
"minor boundary change" under Boundary Commission law, ORS 199. 410 to 199.510
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that
SECTION 1 : The Council hereby approves the proposed annexation and requests
the Commission to approve it and effect it al soon as possible.
SECTION 2 - The City Recorder is hereby lirected to file certified copies of
the statements of consent and of the Resolution with the Portland Metropolitan
Area I oral Government Boundary Commission at once

2 Background
The City has nut processed any other development applications on this
property .
3 . Vicinity Information
The property south of the site across Cascade Blvd is within the City
of Tigard, is zoned I--P and is occupied by Portland Chain. The subject
property is bordered on the west by Scholls Fy . and on the east by the
Hwy 217 on ramp. The property lies on the northern tip of the City of
Tigard' s Planning Area.
4. Site Information
There is a two story office building with associated parking and
landscaping on the site The property is the only remaining parcel in
the immediate area that is within the City' s Planning Area but not
within the City limits
5. Agency and NPO Comments
None of the agencies contacted returned objections or comments t.O thr
proposal .
B F IN1ND S AND CONCLUSIONS
The relevant criteria in this case are Statewide Planning Goals 1 , 2,
and 14; Tigard Comprehensive Plan policies 2. 1 . 1 , 10. 1 . 1, 10. 1 . 2, and
10. 1 . 3 , 18. 136 and Chapter 18. 138 r,f the Community Development Code.
The Planning Staff concludes that the proposal is consistent with the
applicable Statewide Planning Goals and Guidelines based upon the
following findings'
a Statewide Planning Goal #1 is met because the City has adopted a
Citizen Involvement program including review of all development
applications by the Neighborhood Planning Organization (NPO) . In
addition, all public notice requirements were met.
b. Statewide Planning Goal #7 is met because the City applied all
applicable Statewide Planning Goals, City Comprehensive Plan
Policies and Development Code requirements to the application
Goal #14 is met because the City and Washington County have
adopted an Urban Planning Area Agreement which provides policies
for annexation of property from Washington County into the City .
The Planning Staff has determined that the proposal as submitted is consistent
with the relevant portions of the Comprehensive Plan based upon the findings
noted below
a Plan Policy 2 . 1 1 is satisfied because the Neighborhood Planning
Organization and surrounding property owners were given notice of
the hearing and an opportunity to comment on the applicant ' s
proposal .
b Plan Policy 10 1 1 is satisfied because the required services
either currently are provided or can be adequately provided to the
site
c Plan Policy 10. 1 2 is satisfied because the annexation will not
create an irregular boundary or an island, the Police Department
has been notified of the annexation and the land is located within
Tigard' s Urban Planning Area
d . Plan Policy 10. 1 . 3 is satisfied because upon annexation the land
will be zoned the City zoned which most closely conforms to the
County zoning designation.
The Planning staff has determined that the proposal is consistent with the
relevant portions of the Community Development Code based upon the findings
noted below.
a. Chapter 18 116 is met because the applicant has met. all of the
approval standards
b Chapter 18 138 is met because the land does not meet the
definition of buildable land so it shall not be designated as a
"developing area", or "established area"
C. RFCOMMENDAl1ON
Staff recommends that the Planning Commission forward a recommendation
of approval of LCA 10--85 to the City Council including approval of the
zoning designation from MA 1 to IP.

This letter is Element (C) of the Comprehensive Plan Amendment/
Zone Change Application
As detailed in the application, we request. a Comprehensive Plan
Amendment from MA1 to IL and a Zone Change from MA1 to IP. The
purpose is to transfer the subject property into the city and to
rename the zones consistant with city zone designation.
Present use as a commercial office building is consistant with the
Comprehensive Use Plan. We plan no change in the activities on
this already-developed property.
The property is bounded on the north and east by Highway 217 and
on the west by Scholls Ferry Road . These two main arterials act as
substantial physical barriers separating the subject property from
Beaverton to the north. Hence it would seem most logical to join
Tigard which is immediately adjacent across S.W. Cascade Blvd . to
the south.
The primary advantage for joining the city is for the Scholls West
Building to come under the protection of the Tigard Police
Department. .

RESOLUTION NO.
A RESOLUTION INITIATING ANNEXATION OF TERRITORY TO THE CITY OF Tigard, OR.
This matter is before the Common Council of the City of Tigard
hereinafter referred to as Council ; and
It appearing that:
1) The Council is authorized by ORS 199.490(2) to initiate an annexation upon
receiving consent in writing fror more than half of the owners of land in
the territory proposed to be annexed who also own more than half the land
and real property therein representing more than half of the assessed value
of all real property in the territory proposed to be annexed.
2) The Council has received the necessary "consents" signed by the owners of
land, in sufficient numbers to meet the so-called "triple majority" annexation
requirements listed above and set the boundary of the territory proposed for
annexation as authorized by CRS 199.490(2).
3) The territory proposed to be annexed is presently within the
Metzger Water District and/ i( Unified Sewer District
