The Heavy Industrial designation was renamed the I-H dastrict in 1983. At the same tlee, the list of permitted and conditional uses in this tone was greatly reduced. In 1986 the City Council approved a plan redeslgn•tio.t from Heavy Industrial to Light Industrial and a tone change from I--N to I -P (Industrial Park) for the subj.. 1 property (CPA I-86/1C 1S-86) No other applications regarding this property have been reviewed by the City of Tigard, FINAL ORDER 7.oN 90-0011 PUMRP DENTS (GEORGIA -PACIFIC INC. ) 3. YigiaiLL_Inimaa ion Office uses, ironed C-P, abut rhe property to the north. Light industrial and office activities, on properties zoned I-P, lie to the northwest. Properties to the north and northwest are physically separated from the subject parcel by a tree-covered embankment.. Properties to the .pest and south of the subject parcel are coned 1--H and include the Sandvik Stool, Finlandis Sauna, Williams Air Control, and Gerber Blades manufacturing operation-: . Interstate Highway 5 (I-5) forms the eastern boundary of this site. Access to the subject site is provided by a paved driveway from 72nd Avenue. The driveway also serves Sandvik Steel and Pinlandfa Sauna. SW 72nd Avenue is functionally classified as a major collector street by the City's Transportation Plan Map. SW 72nd Avenue is developed with full width pavement, curbs, storm drains, and streetlights. No sidewalks exist on 72nd Avenue in the vicinity of the subject property. The property includes a number of buildings including offices and a truck maintenance narage. A targe part of the site is • gravel parking area. The Georgia Pacific Company to intending to relocate its operations which are currently on this site to Wilsonville early next year. The applicant requests a zone change from I -P (Industrial Park) to I--I. (Light Industrial) in order to relocate the operation of Power Rents, Inc. from • site elsewhere in Tigard. The I-L sone is requested primarily to allow for heavy equipment rental operations to occur on this site. This is a peraitted use in the I-L sone but not in the existing I-P sone applied to this site. S. AVlncY end ISYQ. Qgl11)1 ult. The engineering Department has reviewed the proposal and has offered the following (-cxtlraent.' Based on the theoretical traffic generation estimates for the permitted uses in the existing I-P sone as compared to the uses allowed in the proposed I-L sone, it does not appear that there would be significant traffic impacts resulting from this sone change. We therefore have no objection to the proposed zone change. NPO 5 ham reviewed the proposal and has reported no objection to the proposed zone change. The NPO, however, has requested consideration of visual screening of portions of the sits+ as it redevelops. FIKA1. ORDKR - ION 90--0011 PUMP RENTS (GRORGIA-PACIFIC INC. ) • 111 The Building Division, Tigard Water District, and PGE have reviewed the proposed zone change and have no objections or comments. No other comments have been received. B. FINDINGS AND CONCLUSIONS The applicable criteria in thin case are Tigerd Comprehensive Plan Policies 2. 1.1, 4.2. 1, 4.3.1, 5.1. 1, 7.1.2, / . ). i, 1.4.4, 7.6. 1, 8. 1.3, and the locational criteria for industrial development (Policy 12.3.1); Chapters 18.68 (I--P zone) and 18.70 (I-L zone) ; and the change or mistake quasi-- judicial Plan Map Amendment criteria of both the comprehensive Plan and Community Development Code. Since the Tigard Comprehensive Plan has been acknowledged by the Oregon Land Conservation and Development Commission, it. is no longer necessary to address the statewide planning goals for • change that does not affect the Comprehensive Plan. The Planning Commission has determined that the proposal in consistent with applicable portions of the Comprehensive Plan based upon the findings noted below; 1 . Policy 2. 1. 1 is satisfied because Neighborhood Planning Organisation S and surrounding property owners were given notice of the hearing and an opportunity to comment on the applicant 's proposal . In addition, notice was posted in the Tigard Times and a sign was posted on the rite. 2. Plan Policy 4.2. 1 will he satisfied through any development review and building permit processes applicable to future development of the site. A development propoesl for the site must be shown to comply with applicable federal , state and regional water quality requirements, including preparation, implementation of a non-point source pollution control plan in compl1anee with the Oregon Environmental Quality Commission's rules for the Tualatin River basin. The proposed redesignation does not by itself affect compliance with this Plan policy. 3. Plan Policy 4.3. 1 is implemented through the development review process in which building placement and landscaping are reviewed with respect to minimizing noise impacts of a developing use upon neighboring land uses. The proposed redesignation does not by itself affect compliance with this Plan policy. 4. Plan Policy 5. 1 . 1 is not affected bectuse the propo..al would not appear to have any impact upon the economic diversity of the Tigard area. The proposed redesignation is simply a change from one light industrial zone to another. 5. Plan Polio; !.1.2, 7.2.1, 7.4.4, 7.6. 1, and 6. 1.3 are satisfied because adequate service capacity for public water, sanitary sewer, storm sewers, fire protection, and streets exist to serve development or use of the site with the uses allowed In the I-L zoning district . Specific FINAL ORDER - EON 90-0011 POWER RENTS (GEORGIA-PACIFIC INC. ) 411 I capacity analyses with regard to those facilities' abilities to serve a particular use of the site aro made when the property redevelops. The City of Tigard notifies applicable public and private utility and service providers of pending development applications_ 6. The locational criteria for the Light Industrial Plan designation specified in Policy 12.3. 1 are satisfied for the reasons contained in Ordinance No. 86-57 redesignating this site from the Heavy Industrial to the Light Industrial Plan designation_ The locational criteria provide no guidance for determining whether a property carrying the Light Industrial Plan designation should be zoned I-L or I-P. In the case of this property, the Commi ss:on finds that • redesignation to I-L would be appropriate because the tree-covered embankment between the subject site and the I-P designated properties to the northwest and the C-P properties to the north makes a natural break between the sones, and also because uses allowed in the I-L zoning district would tend to be more In character with the uses of properties at the lower elevation to the south. The I-P designation may be viewed as more of a mixing zone between industrial and commercial uses than the I-L zone because of the broader range of uses, including office uses, allowed in the I-P zone. The I-L zone, with its more limited use types, is closer to the sorts of uses allowed in the I- H sone. Therefore, redesignation of this property to I-L will provide an appropriate transition between the office uses allowed to the north and the heavier industrial uses to the south than would be expected to occur under the existing zoning. 7. The site itself and the buildings on the site are consistent with the lot size, building setback, and building height requirements of both Code Chapters 18.68 (I-P zone) and 18.70 (I-L sone) . Any future use of the site would need to be fully consistent with the use provisions of the I--L zoning district. 8. In order to approve • quasi-judicial amendment to the Zoning Nap, the Commission must also find that there is evidence of • change In the neighborhood ger community which affects the subject parcel. Alternatively, the Commission must find that there has been • mistake or inconsistency made in the original designation of the parcel (Comp shenstve Plan, Volume 2, Policy 1.1.1, Implementation Strategy 2/ Community Development Code Section 18.22.040(A)). A variety of factors in combination point to a mistake in the prior designation of this parcel with the I-P zone. First, development of this site with uses permitted in the I-L sone would provide a better transition between the mixed office and light industrial developments to the north and the heavier industrial uses on the I-H (Heavy Industrial) zoned properties to the south than would be provided by uses allowed in the I-P zone. The I-P sone allows office development. office development may be incompatible with the existing nr future uses of the I-H coned properties what sod south of the subject property. Background Information The subject property was zoned M-2 (Heavy Industrial) upon the plan for NPO OS being adopted In 1977. The Heavy Industrial designation was renamed the I-H district in 1983. At the same time, the list of permitted and conditional uses in this sone was greatly reduced. In 1986 the City Council approved • plan redesignation from Heavy Industrial to Light I'dustrial and a sone change from I-H to I-P (Industrial Park) for the subject property (CPA 7-86/IC 15-86). No other applica.ions regarding this property have been reviewed by the City of Tigard. A. Vicinity Information office uses, zoned C-P, abut the property to the north. Light industrial and office activities, on properties coned I-P, Ile to the northwest. Properties to the north and northwest are physically STAIR HIPORT -- EON 90-0011 POMP RENTti PAOI 1 411 separated from the subject parcel by • trees-covered embankment. Properties to the west and south of the subject parcel are mooed I-H and include the Sandvik Steel, Pinlandia Sauna, Williams Air Control, and Gerber Glades manufacturing operations. Interstate Highway S (I-b) forms the eastern boundary of this site. Access to the subject site is provided by a paved driveway from 72nd Avenue. The driveway also serves Sandvik Steel and Pinlandia Sauna. SW 72nd Avenue is functionally classified as • major collector street by the City • Transportation Plan Map. SW 72nd Avenue is developed with full wtdth pavement, curbs, storm drains, and streetlights. Ho sidewalks exist on 72nd Avenue in the vicinity of the subject property. The SW 72nd Avenue/Highway 217 interchange is approximately one-half mile to the north of this site. 4. Site Information and Proposal Description The property is presently used as a trucking facility, gypsum lab, and shop for the Georgia Pacific Company. The property includes • number of buildings including offices and a truck maintenance garage. A large part of the site is • gravel parking area. The Georgia Pacific Company is intending to relocate its operations which are currently on this rite to Wilsonville early next year. The applicant requests a sons change from I-P (Industrial Park) to I-L (Light Industrial) In order to relocate the operation of Power Rents, Ino. from a site elsewhere in Tigard. The I-L sone is requested primarily to allow for heavy equipment rental operations to occur on this site. This is a permitted use in the I-L sone but not in the existing I-P sone applied to this site. S. Agency and NPO Comments The Engineering Department has reviewed the proposal and has offered the following coweentst Based on the theoretical traffic generation estimates for the permitted uses in the existing I-P sone as compared to the uses allowed in the proposed I-L sone, it does not appear that there would be significant traffic impacts resulting from this sone change. wo therefore have no objection to the proposed sone change. NPO S has reviewed the proposal and has reported no objection to the proposed sone change. The NPO, however, has requested consideration of visual screening of portions of the site as It redevel.ope. The building Division, Tigard Water District, and POG have reviewed the proposed :one change and have no objections or comments. No other comments have been received. The Planning staff has determined that the proposal is oonsistent with applicable portions of the Comprehensive Plan based upon the findings noted below! 1. Policy 2.1.1 is sat/lifted because Neighborhood Planning Organisation S and surrounding property owners were given notice of the hearing and an opportunity to comment on the applicant's proposal. In addition, notice was posted in the Tigard Times and a sign was posted on the site. 2. Plan Policy 4.2.1 will be satisfied through any development review and building permit processes applicable to future development of the site. A development proposal for the site must be shown to comply with applicable federal, stats and regional water quality requirements including preparation, implementation of a non-point source pollution control plan in ccspliance with the Oregon Environmental Quality Commission's rules for the Tualatin River basin. The proposed redesignation doss not by itself affect compliance with this Plan policy. 3. Plan Policy 4.3.1 is implemented through the development review process in which building placement and landscaping are reviewed with respect to minimising noise Ltmpacts of a developing use upon neighboring land uses. The proposed redesignation doss not by itself affect compliance with this Plan poli]y. 4. Plan Policy 5. 1. 1 is not affected because the proposal would not appear to have any impact upon the economic diversity of the Tigard area. The proposed redesignation is simply a change from one light industrial sone to another. 5. Plan policy 7. 1 .2, 7.2. 1, 7.4.4, 7.6. 1, and 5. 1. 3 are satisfied because adequate service capacity for public water, sanitary sewer, storm sewers, fire protection, and streets exist to serve development or use of the site with the uses allowed in the I-L zoning district. Specific capacity analyses with regard to these facilities' abilitieu to serve • particular use of the site are made when the property redevelops. The City of Tigard notifies applicable public and private utility and service providers of pending development applications. STAFF REPORT - ION 90-0011 POWIR RENTS PAOE 3 0 w 6. The locational criteria for the Light Industrial Plan designation specified in Policy 12.7.1 are satisfied for the reasons contained in Ordinance No. 86-67 redesignating this site from the Heavy Industrial to the Light Industrial Plan designation. The locational criteria provide no guidance for determining whether a property carrying the Light Industrial Plan designation should be Boned I-L or I-P. In the case of this property, staff believes that a redesignation to I-L would be appropriate because the tree-covered embankment between the subject site and the I-P designated properties to the northwest and the C-P properties to the north makes a natural break between the sones, and also because uses allowed in the I-L Boning district would tend to be more In character with the uses of properties at the lower elevation to the south. The I-P designation may be viewed as more of a mixing sone between industrial and oommercial uses than the I-L sone because of the broader range of uses, including office uses, allowed in the I-P sone. The I-L sone, with its more limited use types, is closer to the sorts of uses allowed in the I-H sone. Therefore, redesignation of this property to I-L will provide an appropriate transition between the office uses allowed to the north and the heavier industrial was to the south than would be expected to occur under the existing 'Boning. 7. The site itself and the buildings on the site are oonsistent with the lot site, building setback, and building height requirements of both Code Chapters 18.68 (I-P sone) and 18.70 (I-L sone). Any future use of the site would need to be fully consistent with the use provisions of the I-L zoning district. 8. In order to approve • quasi-judicial amendment to the coning Hap. the City must also find that there is evidence of a change in the neighborhood or community which affects the subject parcel. Alternatively, the City must find that there has been • mistake or inconsistency made in the original designation of the parcel (Comprehensive Plan, Volume 2, Policy 1.1.1, Implementation Strategy 21 Community Development Code Section 18.22.040(A)) . A variety of factors in combination point to a mistake in the prior designation of this parcel with the I-P sone. First, development of this site with uses permitted in the I-L so..e would provide • better transition between the mixed office and light industrial development' to the north and the heavier industrial uses on the I-H (Keary Industrial) zoned properties to the south than would be provided by uses allowed in the I-P sone. The i-P sone alluws office development. office development may be incompatible with the existing or future uses of the i-H scned properties west and south of the subject property. Second, the private access road to this property also serves these neighboring properties that are toned I-H. The Plan and corresponding zone designations were Industrial Park (Pi-4) on the north side of Sandburg Street and Heavy Industrial (M-2) to the south. Both of these zoning districts allowed for commerclnl office and industrial uses. During the City-wide review of the Comprehensive Plan in 1983, the zoning for the properties directly north changed to C-P (Commercial Professional) and the subject property was designated Heavy Industrial (I-H) . Along with the change in the map designation, the list of permitted uses in each zoned was reduced and I-H zone now prohibits office uses . On 1915, several properties to the northwest of the subject property were rezoned from C-P to I-P (Industrial Park) to eliminate the non-conforming status of those properties caused by the 1983 Comprehensive Plan amendments. 3. Vicinity Information Office uses, zoned C-P abut the property to the north and light industrial activities zoned I-P lies the northwest. A small parcel which contains a light industrial facility shares the same I-H zone designation and is immediately to the west. The I-H zoning district applies to the industrially developed parcels to the south. Access is provided via a driveway to 72nd Avenue, which is classified as e collector street and the I-5/217 interchange is adjacent to the eastern property boundary STAFF REPORT -- CPA 7-S6 & ZC 15-86 - PAGE 1 a r I • The property is presently used as a trucking facility, gypsum lab, and shop. The applicant is requesting the zone change to I-0 to allow for a wider range of re-development options for the property. B FINDINGS AND CXONCLUSIONS The relevant criteria in this case are Tigard ga Compr•ehens e v e Plan Policies 2. 1. 1, 7. 1.2, 7.6. 1, 6. 1 .1, and the Locational Criteria for I industrial development (Section 12.3). Since the Tigard Comprehensive Plan has recently been acknowledged by LCDC, it is no longer necessary to address the Statewide Planning Goals. The Planning staff has determined that the propose. is consistent with the relevant portions of the Comprehensive Plan based upon the findings noted below: I 1 . Policy 2. 1 . 1 is satisfied because the Neighborhood Planning Organization and surrounding property owners were given notice of the hearing and an opportunity to comment on the applicant's proposal . 2 Policy 7. 1 .2, 7.6. 1 and 6. 1 .3 are satisfied because adequate service capacsty for public water, sanitary sewer, storm sewer, fire protection and streets exist. Specific arrangements to utilize these facilities will be made when the property re- develops. I Section 12.3 . 1 has been addressed by the applicant on pages 3 and 4 of the narrative and the staff concurs with the analysis presented which shows that the proposal is consistent with this portion of the Plan. It should be noted however, that this proposal will effect landscape buffering requirements for future development on the adjacent properties to the south and west zoned I-H. The Community Development Code requires a 10 foot wide landscaping buffer when development on land zoned I-N abuts property zoned I-P and vice versa. Since these affected properties are ,rimarily developed this requirement should not cause any significant problems .
