WHEREAS, the City of Tigard Subdivision Ordinance requires installation of streets, sidewalks, streetlights, storm sewers, curbs, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City further required the payment of fees and execution of a Compliance Agreement, which stipulated that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements subject to the requirement for correction of deficiencies and maintenance for a period of one year. . .and WHEREAS, the City Council received conditional certitication from the Department of Public Works and the maintenance bond, and WHEREAS, the City Council accepted said improvements, subject to correction of specified deficiencies during the maintenance period, via Council Resolution No. 78-54, and WHEREAS, the Department of Public Works has now certified that said specified deficiencies have been corrected, and all public improvements thereinregard said subdivision are complete, and WHEREAS, the required one year maintenance period has passed NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts all public improvements constructer' within Pathfinder No. 2 Subdivision, said sub- division being recorded in Book 37 on Page 33 in Washington County, Oregon, Plat Records, AND FURTHER, hereby authorizes release of the maintenance bond. Wilson: Throughout the past three weeks I have been piecing together the events leading to the development of the Pathfinder Subdivision, especially in regards to the surface drainage and site problems you and your surrourling neighbors have encountered. My research has included conversations with the City Engineer and Building Department., Mr. Ditman and Sam dotter. Several questions lead to the discussions for clarity as to building require'.nts, competence and builder's ability to meet faithful intent. The 'onclusion to these concerns were as follows: 1) The wooden retaining wall on the north side of Mx . Ken Till 's prnl.*rty was required of the developer by the City to be installed. It was installed and approved by the City, having met all requirements. 2) Site drainage plans were required and approved by the City Building Department. 3) No site in the subdivision is on the 100 year flood plain leve) . 4) The builder' s sinale family units are constructed per State 8 :i ding Code regulations and therefore, the proper a ,'Ant of roof dreinace down spouts and surface drainage facility in regards to crawl space area drainage hsve been inspegted and approved by the State licensed inspecctor. 11 In summary; it ..rpearA that the developer h- sufficiently complied with the conditions and regulations of state and local standards. I shall make every effort through my position to alleviate any future occuranoe of this nature to other residential developments . Popp stated that to gain an objective we have to forego a certain amount of convenience (the night lights). Popp further stated that he could understand the need for a concession stand but thought that the baseball field would be used for other than the Babe Ruth League, that the games should be concluded as rapidly as possible and a thorough litter program be inaugurated, that he concurred with staff recommendations and that a 11:00 PM curfew should be instituted for use of the field. Nicoll moved for approval of the amendment to CU 9-72 with staff recommendations. Motion died for lack of a second. Phillips asked why this activity could not be located at Cook Park. Everett Ntxon stated that Cook Park had been considered as a possible location for Babe Ruth games but it was determined upon examination of existing activities and the size and needs of the Babe Ruth League that it would not prove feasible based on those findings. Nicoli then re-made the motion for approval anending CU 9-72. Seconded by Popp. Notion failed three to two. Krause, Goldbach and Phillips no. Popp and Nicoll yes .. Dave Schutz owner of the entire subject parcel being subdivided stated that he did not want to be included within the subdivision requirements for the proposed request as his property was to be developed seperately. Schultz further stated that upon purchase of the sub- ject parcel by the applicants the land on the south side of the greenway would belong entirely to him. Phillips asked if off street parking problems would result as to the proposed alloting pattern. Nicoli stated that due to the very deep alotting pattern as proposed on the preliminary plat long drive-ays would be provided to the site and thus provide sufficient parking. D. Staff Recommendations: Staff recommended approval subject to the following conditions: 1. A drainage plan for the site be approved by the engineering department prior to final plat approval. 2. Rebuttal: Schutz stated that he was not receptive to staff condition number 6 that a 20' wide "driveway strip" abutting the proposed cul-de-sac include a public accessment easement to the greenway. Maker stated that he was willing to grant a 50' easement for greenway use but had difficulty with accepting the sidewalk proposal around the cul-de-sac. F. Commission Discussion and Action: Krause stated that staff condition number 6 be eliminated. Goldbach concurred with Krause's recommendation. Nicoli stated that the use of the words meandering sidewalk be eliminated from staff condition number 7. Goldbach moved to approve the preliminary plat with staff conditions 1 through 5, eliminating staff condi- tion number 6, rewording staff condition number 7 to eliminate the word meandering sidewalk and approving staff conditions through 11. Motion seconded by Krause. Goldbach stated that due to the existing topography and proposed lotting pattern the applicant should not be required to' construct a sidewalk around the cul-de-sac.
