Dear Mr. Skourtes :
The Tigard Planning Commission at their regular meeting of
August 17, 1976, denied your request to the front yard land-
scaping requirements of the Tigard Municipal Code for a parcel
on SW Bonita Road near SW 72nd Avenue, (Wash. Co. Tax Map
2S1 12A) , because it failed to satisfy the requirements for
granting a variance. More specifically the Commission found
that since the same building could be located on the site with-
out the variance no hardship exists. This action becomes final
unless a letter of appeal to the City Council is filed within
15 days of the Planning Commission action.
Since the site plan submitted for Design Review Board
approval was based on the granting of the variance it is no
longer valid for their review. Please notify us whether an-
other site plan will be forthcoming or the submission is being
withdrawn. If the submission is withdrawn the filing fee may
be refunded by the City Council at their next regularly schedul-
ed
cheduled meeting.

REQUEST: Variance to the front yard landscaping and side yard
setback in an "M-3, Light Industrial" zone.
LOCATION: On SW Bonita Road west of SW 72nd Avenue. (Wash . Co.
Tax Map 1S2 12A, tax lot 1900)
APPLICANT: National Safety Company
BAS FACTS:
1 . The site is designated "General Industrial" on the
Tigard Community Plan and zoned "M-3, Light Industrial" .
2. The site is presently vacant with overgrown native
vegetation.
3. Section 18 . 76.010 of the Tigard Municipal Code (TMC)
authorizes the Planning Commission to grant variances
from the requirements of the zoning code "where it
can be shown that , owing to special and unusual
circumstances related to a specific piece of property ,
the literal interpretation of this title would cause
an undue or unnecessary hardship, except that no
variance shall be granted to allow the use of property
for purposes not authorized within the zone in which
the proposed use would be located. In granting a
variance the planning commission may attach conditions
which it finds necessary to protect the best interests
of the surrounding property or neighborhood and to
otherwise achieve the purposes of this title. "
4 . Section 18. 76.030 of the TMC states that "No variance
shall be granted by the planning commission unless it
can be shown that all of the following conditions
exist :
( 1 ) Exceptional or extraordinary conditions applying
to the property that do not apply generally to other
properties in the same zone or vicinity , which conditions
are a result of lot size or shape , topography , or other
circumstances over which the applicant has no control ;
( 2) The variance is necessary for the preservation
of a property right of the applicant substantially the
same as is possessed by owners of other property in
the same zone or vicinity;
( 3) The authorization of the variance shall not be
materially detrimental to the purposes of this title,
be injurious to property in the zone or vicinity in which
the property is located, or be otherwise detrimental to

the objectives of any city development plan or policy ;
(4) The variance requested is the minimum variance
from the provisions and standards of this title which
will alleviate the hardship. "
5. Section 18. 58 .080 of the TMC requires that the front
20 ' of the front yard setback be landscaped and main-
tained.
FINDINGS:
1 . The applicant is requesting a variance to the front yard
landscaping requirements of the M-3, Light Industrial
zone.
2. There is approximately 30,000 sq. feet of buildable
land on the site.
3. The proposed 20,000 sq. feet building can be located on
the lot without the variance.
4 . The flood plain elevation at this site is 140' mean sea
level .

Parcel of lend approximately 2 acres. 260' on Bonito Rd.
Property line begins 160' west of 72nd Ave. Back part of
parcel ( South side - triangle shape) is unbuildeble because
of drainage problems. Approximately one acre.
We propose tc erect 100 x 200 warehouse building. We have
shifted building as far west end south as the terrain and use
utility will allow.
Property to the east aide of applicant 's property along Bonito
Rd. - 160' to 72nd Ave. - heavy brush, trees and swampy terrain.
Property to the west approximately 290' of road frontage to the
Southern Pacific railroad road right-of-way owned by Genu.'.

Special Request
A. Code requires 20' landscape strip between street and park-
