SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. This Temporary Use Permit is valid from January 24, 2019 to April 30,
2020.The findings and conclusions on which the decision is based are noted in Section IV.
THIS APPROVAL IS VALID FOR 15 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The subject property is proposed Lot 14 of the Summerbrook Subdivision (CUP2017-00007). The
granted approval was for a Conditional Use Review, a 15 lot Subdivision Review, Adjustment Review,
and Lot Line Adjustment Review.The subdivision is located south of SW Springwood Drive,east of SW
121"Avenue, north of SW Manzanita Court,and west of SW 118th Ct.All lots are zoned R-4.5,which is
a low-density residential zone.At the time of this writing,the final plat for the Summerbrook Subdivision
has not been submitted to the City of Tigard. The approved Summerbrook Subdivision plat shows that
the existing church building is now located on a different lot than proposed Lot 14 of the Summerbrook
Subdivision. The applicant is proposing to build the model home/temporary sales office in the exact
location that will become Lot 14 of the Summerbrook Subdivision.The applicant has requested that the
approval period be for 15 months.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
CHAPTER 18.440 TEMPORARY USES:
18.440.050 Approval Criteria
C. Temporary sales office or model home. The approval authority shall approve or approve with
conditions a temporary sales office or model home,when all of the following are met:
1.Temporary sales office.
a. The temporary sales office shall be located within the boundaries of the subdivision or
property in which the real property is to be sold;and
The proposed temporary sales office is to be located within the boundaries of the Summerbrook Subdivision
on proposed Lot 14.The real property to be sold includes the subject property.This criterion is met.
b.The property to be used for a temporary sales office shall not be permanently improved
for that purpose.
The applicant proposes to establish a sales office within the single detached house, and no commercial
modifications have been requested.Once the temporary use expires,the commercial space located within
the single detached house will be converted back into a residential space.This criterion is met.
2. Model home.
a. The model home shall be located within the boundaries of the subdivision or property
where the real property to be sold is situated; and

The proposed house to be used as a temporary sales office will also serve as a model home.The house is to
be located within the boundaries of the Summerbrook Subdivision on proposed Lot 14.The real property
to be sold includes the subject property.This criterion is met.
b. The property to be used for a model house shall be a permanently designed
dwelling structure.
The applicant proposes to utilize a single detached house as a model home, which is a permanently
designed dwelling structure. Once the temporary use expires, the single detached house will be sold as a
residence.This criterion is met.
SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A Temporary Use Permit is a Type I procedure. As such,the Director's decision is final on the date it is
mailed or otherwise provided to the applicant,whichever occurs first. The Director's decision may not
be appealed locally and is the final decision of the City.
THIS DECISION IS FINAL ON JANUARY 28, 2019
AND BECOMES EFFECTIVE ON JANUARY 29, 2019

C. Temporary sales office or model home. By means of a Type I procedure, as
governed by Section 18.390.030, the Director may approve, approve with conditions or deny
the use of any real property within the City as a temporary sales office, offices for the
purpose of facilitating the sale of real property, or model home in any subdivision or tract of
land within this City, but for no other purpose, provided the following criteria are satisfied:
1. Temporary sales office:
a. The temporary sales office shall be located within the boundaries of the subdivision or
tract of land in which the real property is to be sold; and
b. The property to be used for a temporary sales office shall not be permanently improved
for that purpose.
2. Model house:
a. The model house shall be located within the boundaries of the subdivision or tract of
land where the real property to be sold is situated; and
Response: Model home to be built within the boundaries of the subdivision,
Summerbrook. See attached preliminary plat-Lot 14. This will be the model
home for the 15 Lot subdivision, projected opening for sales March of 2019.
b. The property to be used for a model house shall be a permanently designed dwelling
structure.

and occupied.

Good morning Sam,
Thank you for your email. I would be happy to clarify:
1. I wasn't sure exactly how to answer this question on my application. April is when we expect to end
construction on the model home, thus the April date. We will, however, be needing a temporary sales office
permit in the model until we are finished selling all of 14 lots in the community. We are anticipating about a
year, April 2020 would be my best estimation.
2. Yes, it will be the only model home and sales office in the entire subdivision. To clarify-this should be lot 14, not
19.
3. Correct, no commercial building components are requested.
