RE: Residential Parking Permit Ordinance
At your request I have reviewed and provide below information
concerning the establishment of restrictions on parking in
residential areas. The purpose which you wish to accomplish by
this ordinance is to allow the City, by regulation, to designate
area-specific parking time limit restrictions in residential areas,
exempting from those restrictions residents who live within that
specific area.
The proposed new regulation can fit nicely within the City's
existing parking restrictions found in TMC Chapter 10. I suggest
the following amendments to the Code:
1. Add to Section 10. 32.010(1) a new subsection (e) to read:
" (e) Establishing residential parking zones." This amendment will
add to the list of parking related actions that can be taken by
City Council resolution, the establishment of this new residential
parking zone.
2 . Section 10.32.020 currently gives to the City
Administrator the authority to post necessary official regulatory
signs to carry out the actions of the City Council pursuant to the
previously referenced section. This section does not need any
further amendment to allow the City Administrator to post the signs
that will be necessary, and will be the key component of the
enforcement portion of this program. TMC 10.28.170(10) currently
makes it unlawful for a person to park any place where parking is
prohibited by an official sign. That subsection will be the
section that will be violated by a person who parks within a
residential parking zone in violation of a sign designating the
area as such.

3. Add a new section 10.28.175 to the City Code entitled
"Residential Parking Zones" and the section would read as follows:
(1) The City Council, pursuant to TMC Section 10.32.010
may establish residential parking zones. The
putposd of residential parking zones is to prohibit
parking by non-residents during specific time
periods within specific geographic areas used
predominantly for residential purposes. The City
Council resolution which establishes the residential
parking zone shall clearly define the geographic
limits of the area affected by the zone and the
hours during which the parking by non-residents will
be prohibited. Residents within the parking zones
may obtain a permit from the City Administrator
pursuant to subsection 2 of this section' to allow
for the parking of vehicles within the zone during
the restricted hours.
(2) The City Administrator shall establish procedures
and standards for the issuance of permits to
residents that will allow them to park their
vehicles within residential parking zones during the
restricted hours. At a minimum, the Administrator
shall establish rules which establish the criteria
for issuance, evident of proof of residence, terms
of the permit, standards for display of the permit,
and allow for the issuance of temporary permits to
residents for the parking of non-resident vehicles
for temporary periods.
(3) The City Administrator shall cause to be installed
and maintained, pursuant to TMC 10.32. 020, official
signs for residential parking zones which clearly
identify the parking restrictions for non-residents
and the exception to those restrictions for permit
holders within the residential parking zones.
The language provided above provides the framework for the
residential parking zone process. Please review the language which
I have supplied and direct your comments to me. If you choose to

present such an ordinance to the City Council, after consideration
of your comments we will put the language into a proper ordinance
form. I suggest that a report accompany the ordinance which
explains and describes the need for the creation of this parking
restriction program.

SUBJECT: ResidentialoPermit Process
Attached is a copy of a memorandum from the City Attorney regarding
appropriate ordinances to enact a residential permit process within
the City of Tigard.
In addition to the ordinance changes, the following is procedural
and material needs that would have to accompany the adoption of the
ordinance.
The residential parking permit is tentatively scheduled for the
neighborhood streets adjacent to the Tigard High School. The
streets where the residential parking would be enforced to the west
of the high school would be on all of Martha Street, all often, :
and also all of 93rd Avenue, and Julia Place. North of the high
school across from Durham the residential zone would be Stratford
Loop, 88th from Hamlet to Durham, 87th from Hamlet -to Durham, Avon
Court, Avon Street, and Stratford Court.
The Police Department would be initially responsible for issuing
the permits and also enforcing them on a regular basis during the
prohibited time.
The Engineering Department would be responsible for ensuring that
the appropriate signs get posted.
The adoption of this residential parking would be on a trial basis
for one calendar year. After that time an assessment would be done
as to the effectiveness of the parking and the possible alteration
of the program. The Police Department would only be able to
enforce the residential parking in this particular area with
existing personnel . If the residential parking zones increased
throughout the City, there would be a need for additional
enforcement.
The permanent permits would be issued to one per every vehicle
registered to each household that fronts the proposed residential
parking area. Each household would also receive three temporary
parking permits that they could give to visitors during the
prohibited time. They would also be eligible, upon request, to
receive additional temporary parking permits for special occasions.
The School Resource Officer assigned to the high school would be
responsible for checking the residential parking zone for
violations.
The process to proceed with possible implementation of this should
be:
1. A briefing with the Council and work session should be held to
explain all the perimeters and operations of a possible
residential parking permit area.
2 . If Council approves the general concept, there should be a
group meeting wieh all affected residents being invited' to
further discuss and answer questions regarding the possible
implementation of the parking permit area.
3 . If there are any significant changes or suggestions from the
original plan, it would probably be beneficial to have a
follow-up session with the Council before step number 4.
4. This would be a postcard vote of the residents within the
proposed residential parking area.
My feeling is that there should be an overwhelming support to
establish the zone, rather than just a 51% positive response. An
overwhelming support would be something higher than 70%. In order
for it to be an effective vote, I think there should at least be a
required percentage of return.
Immediately after the informal vote, the ordinances s:.iula be
adopted, signs ordered, permits and stickers ordered, . temporaries
ordered, and a formal process and procedure established in the
Police Department for the issuance and the enforcement .

A RESOLUTION OF THE TIGARD CITY COUNCIL, ESTABLISHING A RESIDENTIAL
PARKING ZONE FOR THE CITY STREETS AROUND THE TIGARD HIGH SCHOOL
INCLUDING 87TH; 88TH; 92ND; 93RD; MARTHA; MILLEN; STRATFORD LOOP
AND COURT; AVON STREET AND COURT; AND JULIA PLACE
WHEREAS, pursuant to Tigard Municipal Code Section 10.32.010, the
City Council has the authority to establish residential parking
zones; and
WHEREAS, residents near Tigard High School have been experiencing
problems with high school students parking vehicles on residential
streets and congregating near the vehicles during school hours; and
WHEREAS, residents on or near the following streets near Tigard
High School have voted favorably for the establishment of a
residential parking zone:
87th, 88th, 92nd, 93rd, Martha, Millen, Stratford Loop
and Court, Avon Street and Court and Julia Place;
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. The geographic limits of the residential parking
zone near Tigard High School are shown on a map,
attached hereto and incorporated herein as
Exhibit "A".
Section 2. Parking on the streets within the residential
parking zone without a permit will be prohibited on
days when school is in session from 8:00 a.m. to
3:00 p.m.
Section 3. A permit fee of $10.00 per year is established for
the processing of each request for a permit.

SUBJECT: Durham Area Parking Program
Here is a refresher on the Durham Area Parking Permit program.
History:
Residents in the area were having problems with high school students parking in
neighborhoods near the high school and littering, loitering, taking up parking spots, and
worse. In 1991 after a survey showed that area residents would favor restricting
parking in their neighborhood, a parking program was enacted.
Rules:
Signs are posted on SW 87th, 88th, 92nd, 93rd, Martha, Millen, Stratford Lp./Ct., Avon
St./Ct. and Julia PI. They prohibit anyone from parking on the street during school
hours (8A—3P) on school days unless they display a permit issued by the Police Dept.
Permits:
Letters have been sent with an application and explanation of the permit details.
• No charge for the permits
There are stickers for resident vehicles and hang tags for guests.
Permits are good for 2 years; they expire June 2002.
• We'll make special arrangements for someone having a function with multiple guests.
When sending in the application,proof of residence and vehicle are required.
Throughout the year, people who did not apply or who are new to the area can request
a permit application, which I will mail upon request. Applications will also be available at
the Records counter.

questions, great. Let me know if you would like more clarification.
Enforcement:
As the High School parking lot continues to be crowded, there will probably be more
students parking in these neighborhoods. During the first few weeks of school, school
officials will explain the rules to the students, so I'm hoping enforcement will begin in
October.
