APPLICATION SUMMARY FILE NAME: DURHAM EDUCATION CENTER CASE NO.: Lot Line Adjustment(LLA) LLA2017-00014 PROPOSAL: The applicant is proposing to consolidate three properties: WCTM 2S113B, Tax Lot 300 (Parcel 1); WCTM 2S113BA, Tax Lot 401 (Parcel 2); and WCTM 2S113BA,Tax Lot 500(Parcel 3).The proposed action will be processed through a lot line adjustment. The three parcels identified above will be combined to create one parcel that is 10.81 acres in size. The R-12 zoning district is designed to accommodate a full range of housing types at a minimum lot size of 3,050 square feet. A wide range of civic and institutional uses are also permitted conditionally. I-P: Industrial Park District. The I-P zoning district provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor, vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped,and pedestrian-friendly. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. LLA2017-00014 Durham Education Center 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot consolidation with Washington County,and submit copies of the recorded survey map and updated deeds to the city within 15 days of recording, to be incorporated into the land use case file. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the south side of SW Durham Road; east of SW 85`h Avenue, and northwest of SW Upper Boones Ferry Road. The site is currently occupied by Durham Elementary School. The site also includes a Historic District Overlay, which is based primarily on the existing historic school building. In October 2017, the City of Tigard Hearings Officer approved the site for a new 15,500-square-foot education building, with associated parking, walkways, and landscaping (Case No. CUP2017-00002). The subject parcels are zoned Medium-Density Residential (R-12) and Industrial Park (I-P). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; An additional parcel will not be created as part of this application. The applicant is not proposing to reduce any lot sizes; the proposal is to combine Parcels 1, 2, and 3 into one 10.81-acre parcel. The resulting parcel exceeds the minimum lot size for the R-12 zone (3,050 square feet per unit) because it is approximately 470,884 square feet in size. Additionally, there is no minimum lot size for the I-P zone. This criterion is met. LLA2017-00014 Durham Education Center 2 2. By reducing the lot size, the lot or structuress) on the lot will not be in violation of the site development or zoning district regulations for that district; The applicant is not proposing to reduce any lot sizes; the proposal is to combine Parcels 1, 2, and 3 into one 10.81-acre parcel. Staff reviewed the applicant's narrative and submitted site plan to determine that this lot consolidation will not result in any violations of the site development or zoning district regulations for the R-12 and I-P zones. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Staff reviewed the applicant's site plan to confirm the resulting parcel exceeds the minimum lot width requirement for the I-P zone (50 feet).Additionally, there is no minimum lot width requirement for the R-12 zone.This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; The resulting parcel exceeds the minimum lot size for the R-12 zone (3,050 square feet per unit) because it is approximately 470,884 square feet in size. Additionally, there is no minimum lot size for the I-P zone and no maximum lot size for the I-P or R12 zones. The applicant is not proposing to create any flag lots with this lot line adjustment. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and The resulting parcel will connect to SW Durham Road via an existing private drive and access easement across an adjacent property (7800 SW Durham Road; WCTM 2S113BA, Tax Lot 200). This existing access easement exceeds the 15-foot minimum width requirement.This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Staff reviewed the applicant's site plan to confirm that all existing and proposed structures on the resulting parcel meet the minimum setback requirements for the R-12 and I-P zones. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots through this lot consolidation. Therefore, these criteria do not apply. LLA2017-00014 Durham Education Center 3 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot consolidation. In addition, fire hydrants are already in place. This criterion does not apply. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The resulting parcel will connect to SW Durham Road via an existing private drive,which has a legally recorded access easement across an adjacent property (7800 SW Durham Road;WCTM 2S113BA,Tax Lot 200). This criterion is met. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The resulting parcel will connect to SW Durham Road via an existing private drive and access easement across an adjacent property (7800 SW Durham Road; WCTM 2S113BA, Tax Lot 200). This existing access easement is in compliance with the standards set forth in Chapter 18.705 Access, Egress, and Circulation. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. Recently approved on the site, was a new 17,500 square-foot education building intended for classrooms, administrative offices and a common courtyard area with associated on- site parking, connective walkways, and landscaping. The property is zoned R-12, which permits a school as a Conditional Use Permit. The site also includes a Historic District Overlay, which is based primarily on the existing historic school building and classroom wing connected to the historic school building. Recent Land Use Approvals —A recent Type III Conditional Use Permit (CUP), Type II Historic Overlay District Review (HDR) and Type II Adjustment were approved with conditions under CUP2017-00002, ADJ2017-00016 and MIS2017-00004. The applicant is now applying separately for a Lot Line Adjustment/Lot Consolidation, with the purpose of removing any existing lot lines that affect the recently approved development. CITY OF TIGARD —TITLE 18 COMMUNITY DEVELOPMENT CODE CHAPTER 18.410 LOT LINE ADJUSTMENTS SECTION 18.410.020 -APPROVAL PROCESS A. Decision-making process. Lot line adjustments shall be reviewed by means of a Type procedure, as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. B. Time limit on approval. The lot line adjustment approval by the director shall be effective for a period of 1-1/2 years from the date of approval. C. Lapsing of approval. The lot line adjustment approval by the director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions attached to the approval; or 2. The final recording is a departure from the approved plan. D. Extension. The director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year provided that: 1. No changes are made on the original plan as approved by the director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable comprehensive plan policies and ordinance provisions on which the approval was based. Response: The applicant is proposing a Type I Lot Line Adjustment and understands the limits of approvals and the extensions identified above in this Section. SECTION 18.410.030 -APPLICATION SUBMISSION REQUIREMENTS A. General submission requirements. All applications shall be made on forms provided by the director and shall include information required for a Type I application, as governed by Chapter 18.390. Response: A Type I application form is provided with this submittal. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the director. Response: A narrative addressing compliance with approval criteria and applicable standards of the application is included with this application submittal. Durham Education Center Cardno Lot Line Adjustment 3 Submitted: December 7, 2017 Exhibit G- Applicant's Statement SECTION 18.410.040 -APPROVAL CRITERIA A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Response: The applicant is not proposing additional parcels in this lot line adjustment, and the resulting parcel from the proposed lot consolidation will result in a larger lot size. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. Response: This criterion is met as the applicant is not proposing to reduce the lot size. The proposal combines three existing lots into a one single lot. The minimum R-12 lot size is 3,050 square feet and the proposed lot line adjustment would create a 10.755 acre single lot. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Response: The building envelopes of the existing buildings on the subject site meet all of the applicable lot requirements of the R-12 zoning district. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; Response: The applicable zoning district is R-12. The required lot size for R-12 is 3,050 square feet and the proposed lot line adjustment would create a 10.755 acre single lot. There are not flag lots proposed as part of this application, therefore, the flag lot component of the criteria does not apply to this Lot Line Adjustment application. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and Response: There are no additional parcels in this lot line adjustment. The accessway and associated easement is approximately 30-feet wide. The access easement is therefore greater than the required minimum 15-foot wide access easement. d. Setbacks shall be as required by the applicable zoning district. Response: This proposed lot line adjustment will not affect the previously approved minimum setbacks for the development of the educational building and other existing buildings. Durham Education Center Cardno Lot Line Adjustment 4 Submitted: December 7, 2017 Exhibit G- Applicant's Statement 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Response: This criterion does not apply, as flag lots are not proposed as part of this application. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Response: This criterion does not apply as the proposed Lot Line Adjustment does not create a flag lot. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Response: The Tualatin Valley Fire District reviewed the proposed site for adequacy of fire protection as part of the recent land use approvals (CUP2017-00002, ADJ2017-00016 and MIS2017- 00004) and fire hydrants were added to provide adequate fire protection as part of that land use approval. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Response: A common drive will be provided to serve a single lot with the lot consolidation, therefore, a reciprocal easement is not necessary. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Response: The existing accessway has been approved in compliance with Chapter 18.410.040.7 under recent prior land use approvals. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Response: This proposal is for a Lot Line Adjustment/Lot Consolidation, with the purpose of removing any existing lot lines that affect the recently approved development and is not for the purpose of the stated dedication requirements. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments.
