The applicant also proposes to construct a new on-site pedestrian walkway.No changes to the building footprint are proposed. In addition to the standards of this chapter, development within this zone is subject to the standards of Chapter 18.650. SUB-AREA: Scoffins Street - Commercial Street. This sub-area is intended to provide an opportunity for higher density residential as well as an employment base comprised of civic, office and commercial uses in the areas of Commercial Street and Scoffins. Residential-only buildings, office/commercial buildings, and mixed use developments are all permitted. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.650 DDR2018-00002 McDonald's PAGE 1 01'7 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 12090 SW Main Street(WCTM 2S102AA,Tax Lot 903);at the southeast intersection of SW Main Street and SW Scoffins Street. The 0.43-acre site contains an existing fast food eating and drinking establishment (McDonald's), with associated parking and landscaping. The property is located in the Tigard Downtown Plan District, Mixed Use-Central Business Zone (MU-CBD), and the Highway 99W and Scoffins Street-Commercial Street Sub Area. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.310 Off-Street Parking and Loading 18.310.040 General Design Standards D. On-site vehicle stacking for uses with drive-through service. 1. All uses providing drive-through services shall provide an on-site stacking lane for inbound vehicles as provided in Table 18.310.1. The applicant proposes to modify the design of the existing drive-thru stacking lane, so it bumps out further to the west. Staff reviewed the applicant's site plan to confirm the existing drive-thru stacking lane will continue to meet the minimum stacking lane length for drive-thru restaurants (200 feet), as outlined in CDC Table 18.310.1. This standard is met. 2. The director may reduce the length of the inbound stacking lane by means of an adjustment to be processed through a Type I procedure, as provided in Section 18.710.050, using approval criteria in 18.790.030.B.5. The applicant has not requested an adjustment to the minimum stacking lane requirement for drive-thru restaurants (200 feet). This standard does not apply. 3. Stacking lanes shall be designed so that they do not interfere with parking and vehicle, pedestrian and bicycle circulation. Stacking lanes for the purpose of selling food shall provide at least 1 clearly marked parking space for every service window for the use of vehicles waiting for an order to be filled. Staff reviewed the applicant's site plan to confirm the drive-thru stacking lane is designed so that it does not interfere with parking and vehicle, pedestrian, and bicycle circulation. The applicant's elevation drawings show there will be two (2) drive-thru service windows. Therefore, the applicant is required to provide two (2) designated parking spaces for customers waiting for an order to be filled. Staff reviewed the applicant's site plan to confirm that two (2) clearly marked parking spaces will be provided for customers waiting for an order to be filled. This standard is met. DDR2018-00002 McDonald's PAGE 2 OF 7 18.310.070 Off-Street Parking Requirements A. Off-street parking requirements. The ratios for providing minimum and maximum vehicle parking spaces are provided in Table 18.310.2. The applicant proposes to modify the on-site parking lot for an existing McDonald's restaurant at 12090 SW Main Street. Specifically, the applicant proposes to remove and replace two (2) Americans with Disabilities Act (ADA) accessible parking spaces, add one (1) standard parking space, and add two (2) parking spaces that will be utilized by drive-thru customers waiting for an order to be filled. The 3,164-square-foot restaurant is considered a fast food eating and drinking establishment,which has a minimum off-street parking requirement of 7.0 parking spaces for every 1,000 square feet of floor area (CDC Table 18.310.2).Additionally,because the property is located in the Tigard Downtown Plan District, the minimum off-street parking requirement is only 75 percent of the total computed from CDC Table 18.310.2.Therefore,the total minimum off-street parking requirement for this development is 16 parking spaces. Currently, the on-site parking lot only contains eight (8) parking spaces; therefore, this development is considered existing nonconforming. The applicant's proposed modifications to the on-site parking lot will result in a new total of 11 parking spaces.Although this is still below the 16 parking spaces required, staff finds this modification is approvable, as it will result in a net increase of three (3) parking spaces, and will accordingly decrease the development's nonconformity (CDC 18.50.040.C.1.a).These standards are met. 18.320 Landscaping and Screening 18.320.050 Buffering and Screening D. Screening: special provisions 4. Screening of refuse containers. Except for single-family and duplex dwellings, any refuse container or refuse collection area that would be visible from a public street, parking lot, residential or commercial area, or any public facility such as a school or park shall be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. All refuse shall be contained within the screened area. The applicant proposes to remove and replace an existing trash enclosure. The new trash enclosure will be located in the southwest portion of the site. Staff reviewed the applicant's submitted detail drawings to confirm the new refuse collection area will be enclosed from view by placement of a masonry wall. Additionally, the applicant submitted documentation of approval from the franchised hauler, Pride Disposal, for the new location. These standards are met. 18.650 Tigard Downtown Plan District 18.650.020 Applicability C. Design standards applicability. 2. Expansion, modification and site improvements to existing development: An addition, expansion, enlargement, modification, or site improvements associated with such lawfully preexisting uses and structures shall be allowed, provided the application for such proposed development moves toward compliance with the applicable development standards. Only those downtown building and site design standards applicable to the proposed expansion, modification or site improvements to the existing development shall be applicable. DDR2018-00002 McDonald's PAGE 3 OF 7 The applicant is proposing modifications to an existing McDonald's restaurant at 12090 SW Main Street. The proposed modifications are to: the roofline, design,and materials of the existing building;drive-thru lane; outdoor seating area; trash enclosure; on-site parking lot; and on-site landscaping. The applicant also proposes to construct a new on-site pedestrian walkway. No changes to the building footprint are proposed.Because the applicant is proposing modifications to an existing development,only the building and site development and design standards that specifically apply to this project are addressed below. 18.650.050 Building and Site Development Standards B. Development standards. Development standards apply to all new development in the MU- CBD zone, including developments using the Track 3 approval process. Variances or adjustments may be granted as provided in Chapter 18.790,Variances and Adjustments. 1. Development standards are provided in Table 18.650.1 and Map 18.650.A. The property is located in the Scoffins Street - Commercial Street Sub Area. The applicant is proposing modifications to an existing development, and will not be constructing a new freestanding building; therefore,the development standards outlined in CDC Table 18.650.1 do not apply(CDC Table 18.650.1, Footnote 1). This standard is met. 2. Parking location. a. Parking is allowed on the side or rear of newly constructed buildings.If located on the side, the parking area shall not exceed 50 percent of the total frontage of the site. b. Parking is set back a minimum of 10 feet from the front property line. c. When abutting a public street,parking areas shall be behind a landscaped area constructed to an L-1 standard,as defined in Chapter 18.320,Landscaping and Screening. d. Where a parking lot shares a property line with an adjacent parking lot, the landscape requirement along the shared property line is not required. The applicant proposes to remove and replace two (2) ADA accessible parking spaces, add one (1) standard parking space, and add two (2) parking spaces that will be utilized by drive-thru customers waiting for an order to be filled. The two (2) new ADA accessible parking spaces and one (1) standard parking space will be located near the side of the existing restaurant, directly adjacent to the remodeled outdoor seating area. The two (2) new parking spaces for drive-thru customers will be located at the rear of the restaurant. These new parking spaces will be located at least 40 feet from the front property line, and will not abut a public street or public sidewalk;accordingly the L-1 parking lot screen is not required for these new parking spaces. These standards are met. 18.650.070 Building and Site Design Standards A. Create vibrant ground floors,streetscapes and rights-of-way;provide weather protection;and promote safety and security. Intent. Design standards in this section are intended to foster vibrant, inviting streetscapes and sidewalk-facing ground floors and entryways.They are also intended to create buildings that are easily accessible to and provide protection from the elements for pedestrians. They also will help ensure that the ground floor promotes a sense of interaction between activities in the building and activities in the public realm. Building and site design should also address crime prevention through defensible spaces lighting, and features that allow observation and "eyes on the street." 2. Primary entry. a. For commercial/mixed use buildings: i. At least 1 entry door is required for each business with a ground floor DDR2018-00002 McDonald's PAGE 4 OF 7 frontage. ii. Each entrance shall be covered, recessed, or treated with a permanent architectural feature in such a way that weather protection is provided. iii. All primary ground-floor common entries shall be oriented to the street or a public space directly facing the street, not to the interior or to a parking lot. The existing building is located approximately 20 feet away from the nearest public sidewalk, with the primary entries located on the northern building facade. The applicant is not proposing to modify the location of the existing building. The applicant's elevation drawings show two entry doors on the northern building facade, and one entry door on the southern building facade. Each entrance will be covered with a permanent architectural feature for weather protection, such as a canopy or trellis. The primary entries on the northern building facade are oriented to the public street.These standards are met. 3. Windows. a. Ground floor windows for nonresidential and mixed use buildings: i. 60 percent minimum ground floor window coverage for street-facing wall (minimum window coverage includes any glazed portions of doors). The applicant proposes to modify windows on the existing building's two street-facing facades: the northern facade (which faces SW Main Street),and the western facade (which faces SW Scoffins Street). Currently, the total ground floor window coverage on the northern and western facades is below the minimum standard outlined above.The applicant's proposed modifications will result in a net increase in ground floor window coverage, but will continue to be below the minimum 60 percent required. However,staff finds this proposal is still approvable,as the net increase in window coverage demonstrates the applicant is moving toward compliance with the minimum standard (CDC 18.650.020.C.2). This standard is met. ii. Ground floor window transparency. All buildings with nonresidential ground floor windows shall have a visible transmittance (VT) of 0.6 or higher, with the exception of medical and dental offices, which may have tinted windows. The applicant states the transparency of the new windows will match that of the existing windows. Staff reviewed photographs of the existing building and conducted a site visit to confirm the new windows will meet the window transparency standard outlined above. This standard is met. d. Window shadowing for all buildings: Windows shall be designed to provide shadowing.This can be accomplished by recessing windows 3 inches into the façade and/or incorporating trim of a contrasting material or color. The applicant's narrative states that window shadowing will be provided by recessing windows three (3) inches into the facade and/or incorporating trim of a contrasting material or color. This standard is met. 4. Weather protection. For nonresidential and mixed use buildings: a. A projecting façade element (awning, canopy, arcade, or marquee) is required on the street-facing facade of the street with the highest functional classification. b. Awnings/marquees/canopies shall project a minimum of 3 feet from the DDR2018-00002 McDonald's PAGE 5 OF 7 façade and may project a maximum of 6 feet into the public right-of-way or the minimum sidewalk width along the building frontage, whichever is less. Any element that projects into the right-of-way is subject to approval by the city engineer. c. Marquees shall have a minimum 10-foot clearance from the bottom of the marquee to the sidewalk. Awnings and canopies shall have a minimum 8-foot clearance from the bottom of the awning or canopy to the sidewalk. d. Awnings shall match the width of storefronts or window openings. e. Internally lit awnings are not permitted. f. Awnings shall be made of glass, metal, or exterior grade fabric (or a combination of these materials). The existing building has two street-facing facades: the northern facade (which faces SW Main Street), and the western facade (which faces SW Scoffms Street). The applicant proposes to install awnings that will project approximately four (4) feet from the building facades. The building is located approximately 20 feet from the nearest property line, and does not directly abut a public right-of-way or sidewalk. The applicant's elevation drawings show the awnings will be made of aluminum, and will match the width of the proposed storefronts and window openings. The awnings will have accent lighting, but will not be internally lit. These standards are met. C. Integrated building façade standards. Intent. Build upon and improve downtown Tigard's architecture by creating an attractive and unified building façade that encourages ground floor activities, and creates visually interesting façades and roofs. 3. Roof forms. a. The roof form of a building shall follow one (or a combination)of the following forms: i. Flat roof with parapet or cornice; ii. Hip roof; iii. Gabled roof; iv. Full mansard roof; v. Dormers; vi. Shed roof. b. All sloped roofs (other than full mansard roofs) exposed to view from adjacent public or private streets and properties shall have a minimum 5/12 pitch. c. Sloped roofs, shall have eaves, exclusive of rain gutters, that shall project from the building wall at least 12 inches. d. All flat roofs or those with a pitch of less than 5/12 shall be architecturally treated or articulated with a parapet wall that shall project vertically above the roof line at least 12 inches or a cornice that shall project from the building face at least 6 inches. e. When an addition to an existing structure or a new structure is proposed in an existing development, the roof forms for the new structures shall have similar slope and be constructed of the same materials as the existing roof. f. Green roof features or rooftop gardens are encouraged. As part of the development permit, applicant shall execute a covenant ensuring the maintenance of any green roof. The covenant shall be approved by the director. The applicant proposes to modify the roofline of the existing building. The new roof will be flat, and treated with a parapet wall that projects vertically above the roof line by at least 12 inches.These standards DDR2018-00002 McDonald's PAGE 6 OF 7 are met. E. Assure building quality,permanence and durability. Intent. Use building materials that evoke a sense of permanence and are compatible with Downtown Tigard and the surrounding built and natural environment. 1. Building materials. a. The following exterior building materials or finishes are prohibited: i. Vinyl siding; ii. T-111 or similar sheet materials; iii. Plain concrete block (not including split faced, colored, or other block designs that mimic stone,brick,or other masonry);foundation material may be skim-coated concrete block where the foundation material is not revealed for more than 2 feet; iv. Mirrored glass. The applicant is not proposing to utilize any of the prohibited building materials outlined above. This standard is met. SECTION V. On the north elevation we have added a 4th storefront window to our previous design of 3 storefront windows. The occupancy is A2 and the use is fast food restaurant.The construction type is V-B. None of these are changing. Our project is a refreshment of the exterior and interior finishes along with a modification of the roof from mansard to parapet. In addition to this we will ensure that the site and interior is accessibility compliant. The proposed project is a remodel of an existing McDonald's restaurant of 3,164 sq.ft. This will include an exterior modernization of the building's appearance. The modernization includes installation of new siding,with new paint colors, and a new storefront window and door at the entrance (Please see A2.0&A2.1 for color scheme). New building walls signs will replace the old. New accent walls of a charcoal tile with a wood appearance will be placed on the building to break up the facade intermittently per 18.650.05.2. The existing mansard roof will be cut back to allow for construction of new parapets. A new corrugated metal panel system at the parapets provides visual interest. New metal trellises and a metal fascia band break up the facade vertically and provide lighting and weather-protection at the doors.A new white illuminated canopy at the entrance and front facade will provide pedestrian-scale lighting and create a path leading to the main door.At the interior, a new order counter, new seating, and finishes will be provided at the dining area and restrooms. All set backs are existing to remain.The parapet roof will screen equipment better than the existing mansard per 18.650.050.3.A new pedestrian access route will be added to the site to allow access to main st.An accessibility analysis has been performed for this store. I've highlighted the design standards that apply to this project (starting on page 15 in the first document) —please go through and revise your submittal to meet this standards, or demonstrate how you're moving closer into conformance with them (for example, if you cannot meet the 60% ground floor window coverage standard, demonstrate how you'll end up with a net gain in window coverage from the existing conditions). Also make sure to include an applicant's statement/narrative that addresses how your revised proposal meets each standard. You don't need to send me hard copies of the revised documents; e-mail is fine. I also made a couple redlines on your site plan; please see attached.
