Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.810.030 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2018-00003 Moore-Woodard Lot Line Adjustment 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit copies of the recorded survey map and updated deeds to the city within 15 days of recording, to be incorporated into the land use case file. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the east side of SW 95th Avenue;north of SW Commercial Street,and south of SW Greenburg Road. Parcel 1 currently contains a detached, single-family dwelling, and an accessory structure. Parcel 2 currently contains a detached, single-family dwelling, and two (2) accessory structures. Both parcels are zoned Low-Density Residential (R-4.5). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.810 Lot Line Adjustments and Lot Consolidations 18.810.030 Approval Criteria A. Approval criteria. The approval authority shall approve or approve with conditions an application for a lot line adjustment or lot consolidation application when all of the following are met: 1. An additional lot is not created by the lot line adjustment or lot consolidation, and the existing lot or lots are not reduced below the minimum lot size required by the applicable base zone. This lot line adjustment will not create an additional lot. Parcel 1 will be 7,587 square feet in size, and Parcel 2 will be 19,360 square feet in size.Accordingly,both lots exceed the minimum lot size for the R- 4.5 zone: 7,500 square feet for a detached unit. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the applicable base zone regulations. This lot line adjustment will reduce Parcel 1 from 12,592 square feet in size to 7,587 square feet in size, and will increase Parcel 2 from 14,356 square feet in size to 19,360 square feet in size. Therefore, this criterion only applies to Parcel 1.As a result of this lot line adjustment,Parcel 1,and all existing structures on Parcel 1,will not be in violation of the applicable regulations for the R-4.5 zone.This criterion is met. 3. The resulting lots are in compliance with the dimensional standards of the applicable base zone, including: a. The minimum lot width of the applicable base zone shall be met. Lot width for flag lots shall be measured as provided in Section 18.40.090. LLA2018-00003 Moore-Woodard Lot Line Adjustment 2 The minimum lot width for a detached unit in the R-4.5 zone is 50 feet. Staff reviewed the applicant's submitted site plan to confirm that the widths of the resulting lots will exceed 50 feet. This criterion is met. b. The minimum lot size as required by the applicable base zone shall be met. In the case of a flag lot, the accessway may not be included in the lot area calculation, as provided in Section 18.40.090. Parcel 1 will be 7,587 square feet in size,and Parcel 2 will be 19,360 square feet in size. Accordingly,both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for a detached unit. In addition, the applicant is not proposing to create any flag lots through this lot line adjustment. This criterion is met. c. The depth of all lots shall not exceed 2.5 times the average width, unless the lot is less than 1.5 times the minimum lot size of the applicable base zone. This criterion is intended to apply to the creation of new lots. This lot line adjustment will not create an additional lot. Furthermore, Parcel 1 will meet the standard outlined above as a result of this lot line adjustment. This is because the lot depth of Parcel 1 will be decreased from 212.68 feet to 129.51 feet, which is less than 2.5 times its average width of 58.59 feet. This criterion is met. d. The side lines of lots shall be at right angles to the street upon which the lots fronts, unless impractical. Both Parcels 1 and 2 have frontage on SW 95`"Avenue. Staff reviewed the applicant's submitted site plan to confirm the side lines of Parcels 1 and 2 will be at right angles to SW 95`"Avenue,as far as practicable. This criterion is met. e. Each lot shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and Parcel 1 has 57.62 feet of frontage on SW 95th Avenue, and Parcel 2 has 46 feet of frontage on SW 95th Avenue.This criterion is met. f. Setbacks shall be as required by the applicable base zone. Staff reviewed the applicant's submitted site plan to confirm that all existing structures on Parcel 1 comply with minimum setbacks for the R-4.5 zone. Parcel 2 is currently occupied by a detached, single-family dwelling,and two (2) accessory structures. The main dwelling complies with the development standards for the R-4.5 zone,but the accessory structures do not meet minimum setbacks for residential accessory structures ("1UC 18.210.010). Therefore, these two (2) accessory structures are considered existing nonconforming,and are subject to the standards in'1'DC Chapter 18.50 Nonconforming Circumstances. The lot line proposed for adjustment does not create or change the nonconforming situation. Any new accessory structures on either Parcel 1 or Parcel 2 shall comply with all the dimensional requirements in '1'DC 18.210.010. This criterion is met. 4. With regard to flag lots: a. The applicant may determine the location of the front yard,provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the LLA2018-00003 Moore-Woodard Lot Line Adjustment 3 paved accessway is located within 10 feet of an abutting lot in compliance with Section 18.320.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots through this lot line adjustment. Therefore, these criteria do not apply. 5. Where a common drive is to be provided to serve more than one lot,a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved lot line adjustment or lot consolidation. The applicant is not proposing a common drive to be provided to serve more than one lot. Therefore, this criterion does not apply. 6. Any accessway shall comply with Chapter 18.920,Access, Egress, and Circulation. Parcel 1 has 57.62 feet of frontage on SW 95th Avenue, and Parcel 2 has 46 feet of frontage on SW 95th Avenue. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for lot line adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. Approval criteria. The approval authority shall approve or approve with conditions an application for a lot line adjustment or lot consolidation application when all of the following are met: 1. An additional lot is not created by the lot line adjustment or lot consolidation, and the existing lot or lots are not reduced below the minimum reduced in size required by the applicable base zone. RESPONSE: The purpose of this Lot Line Adjustment is not to create an additional lot, but to adjust the boundary between 2 existing lots in order to increase the size of the parcel that contains 11950 SW 95th Avenue(tax lot 4301). 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the applicable base zone regulations. RESPONSE: The existing house at 11930 SW 95th Avenue (Tax lot 4200), will still meet the minimum lot standards for size and setbacks as a result of this requested Adjustment. See the attached site plan that shows the lots after the proposed adjustment. 3. The resulting lots are in compliance with the dimensional standards of the applicable base zone, including: a. The minimum lot width of the applicable base zone shall be met.Lot width for flag lots shall be measured as provided in Section 18.40.090. b. The minimum lot size as required by the applicable base zone shall be met. In the case of a flag lot,the accessway may not be included in the lot area calculation,as provided in Section 18.40.090. c. The depth of all lots shall not exceed 2.5 times the average width,unless the lot is less than 1.5 times the minimum lot size of the applicable base zone. d. The side lines of lots shall be at right angles to the street upon which the lots fronts,unless impractical. e. Each lot shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and f. f. Setbacks shall be as required by the applicable base zone. RESPONSE: Both of the affected lots will remain in conformance with all of the dimensional standards except for the depth to width ratio.Neither of the 2 existing tax lots currently meet the depth to width ratio,with tax lot 4200 having a ratio of approximately 3.71 and tax lot 4301 having a ratio of approximately 6.93.After the proposed lot line adjustment tax lot 4200 will be in compliance,with a ratio of approximately 2.23, and tax lot 4301 will have a ratio of approximately 4.08,which is an improvement of approximately 59%from the existing ratio. City of Tigard Lot Line Adjustment—Moore/Woodard March 21, 2018 4. With regard to flag lots: a. The applicant may determine the location of the front yard,provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved accessway is located within 10 feet of an abutting lot in compliance with Section 18.320.050. c. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. RESPONSE: Neither adjusted lot will be a Flag Lot,therefore,this Code section does not apply. 5 Where a common drive is to be provided to serve more than one lot,a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved lot line adjustment or lot consolidation. RESPONSE: Both lots will continue to use their separate driveways, and not a common drive. Therefore,this section does not apply. 6 Any accessway shall comply with Chapter 18.920,Access,Egress and Circulation. Responses to individual sections are highlighted in bold for each applicable development standard criterion. 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. RESPONSE: The purpose of this Lot Line Adjustment is not to create an additional lot, but to adjust the boundary between 2 existing lots in order to increase the size of the parcel that contains 11950 SW 95th Avenue (tax lot 4301). 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. RESPONSE: The existing house at 11930 SW 95th Avenue (Tax lot 4200), will still meet the minimum lot standards for size and setbacks as a result of this requested Adjustment. See the attached site plan that shows the lots after the proposed adjustment. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. RESPONSE: Both of the affected lots will remain in conformance with the dimensional standards of the R-4 zoning district as a result of the requested Adjustment. And,each lot will have the same amount of frontage on a public right-of-way is existed prior to the adjustment. 4. With regard to flag lots: City of Tigard Lot Line Adjustment—Moore/Woodard March 7, 2018 When the partitioned lot is a flag lot, the developer may determine the location of the front yard,provided that no side yard is less than 10 feet.Structures shall generally be located so as to maximize separation from existing structures. a. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. RESPONSE: Neither adjusted lot will be a Flag Lot,therefore,this Code section does not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. RESPONSE: While an accessway is not being requested,we can report that a fire hydrant is located at the northeast corner of SW 95t' Avenue and SW Center Street,which is just to the south of the properties which are requesting this lot line adjustment. 6. Where a common drive is to be provided to serve more than one lot,a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. RESPONSE: There is not currently a joint access between the 2 lots,nor will there be one after the requested adjustment. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation.
