APPLICATION SUMMARY FILE NAME: CHRIS AUTO DEALER CASE NO: Minor Modification (MMD) MMD2018-00051 PROPOSAL: The applicant is proposing to convert an approximately 500 square-foot building from a Motor Vehicles Servicing/Repair Use to a Motor Vehicle Sales/Rental Use. The applicant has one location in Damascus, Oregon,and the applicant would like to open a second location on a parcel adjacent to Pacific Highway. The C-G zone is designed to accommodate a full range of retail, office, and civic uses with a citywide and even regional trade area. Except where nonconforming,residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses,including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses,utilities,heliports,medical centers,major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.310 and Chapter 18.780 MMD2018-00051 CHRIS AUTO DEALER 1 of 3 SECTION II. DEC_ISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The .43-acre site is located southeast of SW Pacific Highway, northeast and northwest of SW Walnut Place,and southwest of SW McKenzie Street.The property contains a car wash,and is part of a three lot commercial area that also contains Davidson's Restaurant and a Jiffy Lube. Parking is not shared, but common drive aisles provide for internal circulation. In February 2012, the City of Tigard approved of a Minor Modification (MMD2012-00002) for a reconfiguration of the car wash site. In February 2015, the City of Tigard approved of a Minor Modification (MMD2014-00030) for the car wash to construct a 400 square-foot shed.The site includes one 500 square-foot building,one car wash facility,two storage sheds, associated parking, and associated landscaping. The site is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a change in use from Motor Vehicle Servicing/Repair to Motor Vehicle Sales/Rental for an existing 500 square-foot building located at 9893 SW Walnut Place. With a change in use, the potential issues are primarily related to the off-street parking requirement. Both previous and proposed uses are allowed in the C-G Zone, provided that the Motor Vehicle Sales/Rental use is strictly limited to motor vehicles and light equipment. This lot is a multi-tenant site and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D. Based on the applicant's site plan and the approved site plan of MMD2012-00002, staff finds that there is adequate parking at the site,with 10 parking spaces provided. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A minor modification is a Type I procedure.As such, this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first. This decision is not appealable locally, and is the final decision of the City. THIS DECISION IS FINAL ON NOVEMBER 14, 2018, AND BECOMES EFFECTIVE ON NOVEMBER 15, 2018.
