Please be advised that the Tigard Planning Commission at their regular meting
of July 8, 1980, approved your request for a Conditional Use Permit for
an auto repair facility in an M-4 "Industrial Park zone".
This approval is subject to the following conditions:

1. A Sign Permit shall be applied for.

2. No outside storage of vehicles shall be allowed at anytime.
3. Tennant modifications of space shall be approved by the Building Inspector
and the Fire Marshall prior to occupancy of this space.

Bring bui1ding to standards ol! Uniform Building Code as adopted by
City of Tigard, (i.e. Businesa "B-2" to "H-4" auto repair) .
Bring electrical wiring to conform to NFPA #70 (Electrical Code as
adopted by State of Oregon) to meet standards for auto repair.
Bring mechanical systems of building to meet standards of the Uniform
Mechanical Code as adopted by City. ,

On January 8, 1979, City Council approved a Zone Change to M-4 (Reference
ZC 24-78, Ordinance No, 78-85) . A Conditional Use Was granted for mini-
storage warehousing in the M-4 Zone on November 21, 1978 by the Planning
Commission (Reference CU 29-70) . The project received Site Design Approval
on April 13, 1979 (Reference SUR 18-79) .
I: FINDINGS OF FACT:
1. The Code allows automobill service stations as a Conditional Use
in a M-4 Zone (Reference Section 18.52.020) . The Code further states
in this Section . . . ."any other use held similar to the above uses, as
approved by the Planning Commission",
2 Auto repair is similar to auto service, In this case, only mechanical
repairs shall be carried out, no gasoline sales, etcshall be a part of
this facility. All work shall be 'arried out within the building. No
V I outside storage Will be in evidence.

4 I have looked at the proposal in Planning Commission minutes
for change of occupancy at the Durham Hall Business
Center. The following needs to bo a part of the changes :

1 . Bring building to standards of Uniform Building Code as
adopted by the City of Tigard (i.e. business "B-2" to
"H-4" auto repair).
2. Bring electrical wiring to conform tn NFPA #70 (Electrial
Code as adopted by State of Oregon) o meet standards
for auto repair.
3. Bring mechanical systems of building to meet standards of
the Uniform Mechanical Code as adopted by the City.
, • 4. Any flammable liquid systems of pumps, piping, tanks and
other storage to meet the standards for the National Fire
Codes as adopted by Tualatin Fire District.

This application pertains to one 1680 square-foot tenant space
in Building ''D" of the Durham-Ball Business center. The
prospective tenant, Mr . Janos Kiraly, wishes to establish an
auto repair business. He specializes in mechanical, electrical
and tune-up work on Mercedes and BMW cars. No body or painting
work will be involved.
Mr. Kiraly has attended factory training schools on Rolls-Royce
and Mercedes cars. He has worked as a mechanic for import auto
dealers on Mercedes and BMW cars for several years. He has
surveyed the local area with regard to the availability
ty of
service for these cars. He is convinced there is a substantial
need for the high quality of service he is able to offer.
Mr. Kiraly wiEhes to lease tenant space #401 , which is identified
in the enclosed sLe plan. This is in a sprinklered building.
ye The planned tenant improvements are specified by Mr. John Sachs,
Architect, on the enclosed plans. The parts of this plan which
are peculiar to Mr. Kiraly' s needs, such as the exhaust venting
system, will be installed by him prior to occupancy.
There should be no adverse impact on adjacent tenants in the
business park or upon neighboring properties. All service work
will be confined within the building. No vehicles will be stored
in the open areas of the property.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:

SECTION 1: Finding that tha lands hereinafter described have been heretofore and
are now classified as Washington County "RU-4" and further findings
that pursuant to prescribed procedures, the above-stated application for a zoning
map amendment was heard in a public hearing held by the Tigard Planning Commission
on November 21, 1978, and all interested persons were there and then afforded an
opportunity to be heard, and thereafter the Planning Commission filed its report
and recommended approval with the City Recorder, a copy therefore hereto attached
and by reference made a part hereof, the Council adopts the following substantive
findings:

( 1) Automobile service station;
( 2) Fruit packing and processing;
( 3) Furniture manufacturing;
( 4) geating equipment manufacture;
( 5) Machine shop, welding shop, contractor's office;
( 6) Paper product manufacture, but not including the
manufacture of paper itself;
( 7) Railroad trackage and related facilities;
( 8) Public utility (such as water tower, substation
etc. ) ;
( 9) Tool and hardware manufacture;
(10) Trailer manufacture;
(11) Warehousing and wholesale distribution;
(12) Weaving of cotton, wool, flax and other fibrous
materials;
(13) Any other use held similar to the above uses: as
approved by the planning commission;
(14) Any business, service, processing, storage or dis-
play essential or incidental to any permitted use in the M-4
zone and not conducted entirely within an enclosed building;
(15) Building or structure in excess of two stories or
• twenty-five feet in height whichever is less;
(16) Retail sales, when authorized by the planning
commission, supplemental to, in conjunction with, or part
of any of the foregoing conditional uses,
(17) Carden supply stol..0 when in conjunction with a
