In response to a line of questioning by Moen and Speaker, Howard explained it would be Feder- . ally funded by TWD over a 30-year period for senior center living. He stated serious consideration is being given to rezone this parcel and five acres across Fanno Creek, also owned by this applicant, as an A-70/80 Home for the Aged zone. Helmer raised the question of curbs and sidewalks, especially because of the probability of use of public transit. Howard pointed out that the provision for ODOT approval, and approval by the public works director would result in proper provision of these improvements. • Howard then addressed the density issue, pointing out that we may • be shocked that these people live in 288 square foot units, but that that is all they need or want. He commented that when the code was framed, land was cheap, homes were single story on large lots, and A nobody considered densities such as this. He acknowledged the condi.. tional use procedure never contemplated an action such as this. However, this has been taken up with NEC #1, and on a question by Speaker stated • • we would be hearing a request for a proper zone which would embrace this and other parcels, at the January meeting. Tepedino expressed concern for the use of the floodplain for parking. Howard pointed out there is no change in the floodplain, and called attention to testimony by the property owner at the last meeting • as to the very small amount of flooding which does occur. He stated the effect on the neighborhood would be small--the building would be unchnnged, there would be fencing around the property, access and parking isadequatelyprovided at the existing center. PUBLIC TESTIMONY in opposition was presented by -- * * Anne Craig, 12360 SST Knoll. Drive, speaking for the residents of Knoll Drive, opposing the request. She said they opposed further infringement of their zoned .residential zoning by the enlargement of this day care center, which most of them opposed when it was started =,{ in 1967 and 1968. She called attention to the profit-making character of the enterprise, and alleged traffic would be further increased on Hunziker and Hall Boulevard, to the detriment of the Knoll Drive residents. *'k* John W. LOCATION: 13335 SW Hall Blvd. (Wash. Co. Tax Map 2S]. 2DA, Tax Lot 702.) . PREVIOUS ACTION: Tabled on October 28, 1980, Planning Commission meeting. tior • STAFF COMMENTS: On October 28, 1980, the Planning Commission tabled this application to allow Staff and the applicant time to resolve certain pertinent issues. The applicant has reduced the density of this proposal from 84 units • to 16._uA ;L_and has reduced the building to two (2) stories instead of three (3) . This reduces the "impact" of the structure and reduces the parking space requirement to_3$ spaces instead of the 42. The applicant shows 15 spaces in the flooplain and has submitted a Sensitive Lands Permit. No change in the f]:ooplain is anticipated except to provide an asphalt surface and curbing. The major concerns of the Fire Marshall have been satisfied. The fifty • 150) foot access requirement in the code could be met although thirty (30) feet seems adequate. A driveway surrounding the building has been included on the revised plan. Staff admittedly has changed its approach from one of denial to one of acceptant:e. Several reasons for this change came about after the applicant's presentation on October 28, 1980, and after a meeting with NPO #1 members. The Conditional Use section of the code never anticipated this proposed density although it does list "home for aged." We have to "re-think" the code in relationship to this application. The 76 units per acre is almost double the density allowed in the highest density zone in this city--A-40. The relevancy of this is the question. The applict nt's presentation--"Unfortunately these people don't have many visitors"— reduced the parking requirements. The parking for Staff persons is a concern, but if parking in the flooplain were allowed, the applicant would be :Four spaces shy of the code requirement. The issue seems reduced to hoping some would ride the bus on Hall Blvd. • r STAFF REPORT C, AGENDA 5.3 - CU 13-80 TIGARD PLANNING COMMISSION NOVEMBER 25, 1980 Page 2 • One concern was that this structure could be converted at a later date to a use othe,. than for Senior Living. The applicant must guarantee to HUD that seniors will be housed here to obtain financing. This assures the use for thirty (30) years unless the oroject is refinanced or sold. The chances of that occurring are insignificant. • Just to show you that the Planning Director is approaching the "senior" status, it should be pointed out to you that I am considering a Comprehensive Plan Revision to change the zoning cn the five (5) acres to the north, • also owned by this applicant, to A-70/80. If this change was approved we would create a Senior Living Zone in this area. The five (5) acres to the north and this particular parcel could be zone changed to A-70/80. • The main reasons for this propos'i Comprehensive Plan change are the proximity of the new Senior Center, the park area planned between Main and Hall, the availability of mass transit and the industrial zoning along Burnham to the north. These factors would make this area very attractive for this density, Obviously this proposal would have to go before the NPO, you, and the Council, but a very strong case could be made supporting the appropriateness of this Comprehensive Plan change. I. FINDINGS OF FACT: 1. The Comprehensive Plan Map shows this parcel in the greenway along Fenno Creek, It has been clearly shown that a large portion of this site is buildable. Buildings exist on the site. The applicant has requested use of a portion of the floodplain for parking. This would not seriously change the floodplain. A Sensitive Lands Permit has been submitted, Al]. work in the floodplain will be reviewed by the o , Public Works Department during the Site Design Review process. 2. Applicant has reduced the height of the building to two (2) stories and reduced the density to 7S units which reduces the site parking requirement. 3. The Fire Marshall and Planning Staff have reviewed this proposal with the applicant. 4. Code Section 18,20,020 allows "Home for the aged" as a Conditional Use in an R-7 zone. NPO 41 has reviewed this proposal. Most of } their major concerns have been satisfied. II, CONCLUSIONARY FINDINGS: 1. If the Planning Commission allows the parking in the floodplain, I the applicant can meet the parking requirement of 38 spAces. 20 Adequate access is available. All plans for work in the floodplain be approved by the Public Works Department prior to the issuance of Building Permits. Floodplain to be staked in the field prior to Site Design Review. 2. Project to be subject Site Design Review. 3. All plans for work in Oregon State Highway right-of-way shall be approved. in writing by Mr. William Geibel of Oregon Department of Transportation #' ,Y in the form of an ODOT Permit prior to issuance of Building Permit. 4. ,The Fire Marshall shall approve the project relative to fire-life: safety. All concerns of the Fire Marshall shall be satisfied prior to the issuance of Building Permits. 5. The proposal is to construct an 84 unit, 3 storey, Senior Citizen Living Facility on a i.6 acre park-like parcel fronting on Hall Blvd, adjacent to the planned Senior Citizen Recreation Center end the dedicated Tigard City Park. Since the property is currently being utilized as single family residential, thEEe is a need for a Conditional Use { Permit to allow this project to proceed. 2. In conformance with the comprehensive plan we are proposing to place a residential use in an area which is already residential. The impact of the higher density is minimized by the placement of the facility between a church, fauility and the large open space dedicated for city park. No single family uses are contiguous to the property: It' 16-16 aced geographically to produce an optimum living environment for this age group. The existing trees and plants materials do a beautiful job of buffering Zrom Hall Blvd. and surrounding properties On site recreation facilities plus adjacency relationship to the Senior Citizen Recreation Center and park, bus transportation • shopping center and proposed civic center, plus geographic relationship to two major hospitals, Meridean Park, and St. V±cients, make this a super desirable location for the intended use. The structure, utilizing brick, stuca'o and wood siding will make the faclity most compatible with the surrounding neighborhood. Access to this facility will be from Hall Blvd. and ( consequently no traffic will 'fie generated through residential aroas. I have met with the neighborhood asssciation and a group irom the adjacent church. By and large I received what I felt was a positive response from both groups. ") ' 3. The need for this type of facilty is widely known and well documented. I have heard, as you well may have, of elderly persons on waiting lists to become residents in such facilities for in excess of 3 years. He considered each finding of fact in the staff report in turn: he asserted this parcel is above the 100 year flood level and should be properly considered as buildable; hay had applied for a sensitive lands permit earlier in the day; there is an apparent error in the staff's calculation of parking spaces , outside of the floodplain; and he had had a conversation with Joe Greulich, and he indicated no serious objection by the fire district to the plan outlined. He described the vertical distances, asserting the building area is seven feet above the flood stage. John Butler, secretary of NPO #1, told of two NPO meetings and a neighborhood meeting which were held to consider this project. Norman Lee, an associate of the applicant and an owner of two small facilities of the type contemplated, explained in some detail the type of tenants which would occupy the facility. Re told than 'econom- ion of such facilities, stating he felt the optimum size would be about 100 tenants. Since the residents would be ambulatory and not nursing cases, there could be a minimum staff. Nevertheless the state requires at least a licensed practical nurse to administer such a facility, and 'these are very difficult to hire. There was discussion with staff on how to bring this back after the concerns of the commission had been properly addressed, and Howard suggested tabling. In conformance with the comprehensive plan we are proposing to place a residential use in an area which is already residential. I have met with the neighborhood association and a group from theadjacent church. By and large I received what I felt was a positive response from both groups. 3. The proposal is to construct an 84, unit, 3 storey, Senior Citizen Living Facility on a 1.6 acre park-like parcel fronting on Hall Blvd, adjacent to the planned Senior Citizen Recreation Center and the dedicated Tigard City Park. •�' Since the property is currently being utilized as single family residential, the is a need for a Conditional Use Permit to allow this project to proceed. 2, In conformance with the comprehensive plan we are proposing to place a residential use in an area which is already residential. The impact of the higher density is minimized by the placement of the facility between a church facility and the large open space dedicated for city park. No single family uses are contiguous to the property. It is located geographicallyto , produce an optimum living environment for this age group. The existing trees and plants materials do a beautiful job of buffering from Hall Blvd. and surrounding properties On site recreation facilities plus adjacency relationship to the Senior Citizen Recreation Center and park, bus transportation shopping center and proposed civic center, plus geographic relationship to two major hospitals, Merldean Park, and St. yilcients, make this a super desirable location for the intended use. The structure, utilizing brick, stucdo and wood siding will make the faclity most compatible with the surrounding neighborhood. Access to this facility will be from Hall Blvd, and consequently no traffic will be generated through residential areas. I have met with the neighborhood association and a group from the adjacent church, By and large I received what I felt was a positive response from both groups. 3. The need for this type of facilty is widely known and well documented. I have heard, as you well may have, of elderly persons on waiting lists to become residents in such facilities for in excess o ` 3 years. I have already, without any solicitation had a number of people express interest. Providing for our Senior Citizens is most certainly a form of public benefit, 4. This project ties in beautifully with the commitment this community has already addressed in providing a Recreation Center for Senior Citizens, S.
