The above-entitled matter came before the Hearings Officer
at the regularly scheduled meeting of February 26 , 1987 , at the
Tigard Civic Center Town Hall Room, in Tigard, Oregon; and
•
The applicant requests approval of a 16-lot subdivision
on property zoned R-12 (Multi-family Residential) , more specifi-
cally described as Tax Lots 1800 and 1802, Map 2S1 12CC and a
portion of Tax Lot 100 , Map 2S1 Section 12CC, City of Tigard,
County of Washington, State of Oregon; and
The Hearings Officer conducted a public hearing on
February 26 , 1987 , at which time testimony, evidence and the
Planning Department Staff Report were received; and
The Hearings Officer adopts the findings of fact and con-
clusions contained in the Staff Report, a copy of which is
attached hereto, marked "Exhibit A" and incorporated by reference
herein.
NOW THEREFORE IT IS HEREBY ORDERED THAT S 87-01 be and hereby
is approved subject to the following conditions;
1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET OR
ASSURED PRIOR TO THE RECORDING OF THE FINAL PLAT.

2. Seven (7) sets of plan--profile public improvement
construction plans and one (1) itemized construction cost
estimate, stamped by a Registered Professional Civil Engineer,
detailing all proposed public improvements shall be subilitted
to the Engineering Section for approval.
3. Sanitary sewer rilan-profile details shall be provided
as part of the public improvement plans.
4. Construction of proposed public improvements shall
not commence until after the Engineering Section has issued
approved public improvement plans. The Section will require
posting of a 100% Performance Bond, the payment of a permit
fee and a sign installation/streetlight fee. Also, the execution
of a street opening permit or construction compliance agreement
shall occur prior to, or concurrently with the issuance of
approved public improvement plans. SEE THE ENCLOSED HANDOUT
GIVING MORE SPECIFIC INFORMATION REGARDING FEE SCHEDULES, BONDING,
AND AGREEMENTS .
5. A fifteen foot wide easement for sanitary sewer purposes
• shall be conveyed to the public, adjacent to, west of , and parallel
with the east boundary line of proposed Lot #81. The intent here
'1' is to allow Tax Lot 1900 access to the public sewer system. The r
/ applicant may propose an alternative that accomplishes this. 1
Any alternative must be approved by the Engineering Division.
.l` 6. Additional right-of-way shall be dedicated to the Public
Ialong the SW Durham Poad frontage to increase the right-of-way
• to 45 feet from centerline. The description for said dedication

shall be tied to the existing right-of-way centerline as established
by Washington County. The dedication document shall be on City
forms and approved by the Engineering Section .
7. Street Centerline Monumentation
A. In accordance with ORS 92. 060 subsection (2) , the
centerlines of all street and roadway right-of-ways shall be
monumented before the City shall accept a street improvement.
B. All centerline monuments shall be placed in a monument
box conforming to City standards, and the top of all monument
boxes sh. l1 be set at design finish grade of said street or roadway.
C. The following centerline monuments shall be set:
i. All centerline-centerline intersections. Inter-
sections created with "collector" or other existing streets shall
be set when the centerline alignment of said "collector" or other
street has been established by or for the City;
ii. Center of all cul-de-sacs;
iii . Curve points. Point of intersection (P. I . when
their position falls inside the limits of the pavement otherwise
beginning and ending points (B.C. and E.C. ) .
iv. All sanitary and storm locations shall be placed
in positions that do not interfere with centerline monumentation.
8. The applicatn shall provide for roof drainage to the
public stormwater system.
9. The applicant shall provide for connection to proposed
buildings to the public sanitary sewerage system. A connection
permit is required.

10. Standard half-street improvements includinc; concrete
sidewalk (s) , driveway aprons , curbs, asphalt-concrete pavement
and utilities including sanitary and storm sewer (s) , streetlight(s) ,
shall be :installed along the SW Bond Street (Lots #82-95) frontage.
Said improvements shall be designed and constructed to City local
street standards indicated on the preliminary plat and shall conform
to the alighmant of existing adjacent improvements. All other
segments of roadway shall be constructed to a full local street
standard, including the proposed cul-de-sac.
11. The applicant shall sign a non-remonstrance agreement
for the future improvement of SW Durham Road on City forms which
shall be reviewed and approved by the City prior to recording or,
in the alternative, the applicant may make the necessary road
improvements to SW Durham Road along the property frontage, which
improvement shall meet the design standards adopted by the City.
12. Prior to final plat :approval , the applicant shall
obtain the signature or written authorization of all property
owners of record for this application.
13. If the pending lot line adjustment appeal is denied ,
confirmation of legal access to the northern remnant parcel (tax
lot 100) will be required.
14 . After review and approval by the Director of Community
Development and City Engineer, the Final Plat shall be recorded
with Washington County.

15. This approval is valid if exercised within one yeEr
of the final approval date.
16. Building permits cannot be issued to any lots in
Bond IV that are encumbered by the septic drainfield easement
granted to the owner of tax lot 1801 until the drainfield has
been terminated.
17. The removal permits shall be obtained from the City
Planning Division for all trees with a caliper of 6 inches or
greater at a height of 4 feet.
18. There shall he no access between the lowest point of
the cul-de-sac SW 81st Place and Tax Lot 1801. The applicant
shall redesign the bulb of SW 81st Place so only the lowest
point of the cul-de-sac right-of-way touches Tax Lot 1801.

NARRATIVE

EXISTING CONDITION;
•
1 . The site is presently vacant , with field grasses ,scattered Ash
and Alder trees and a smal. shed that will be removed .
2. The site slopes from south to north at an overage grade of
7. 50:, with the primary drainage coilectrJ in the existing
drainage way along the north property line.
3 . Theublic facilities s that will serve the site are existing at
the end of S.W. Bond st . as shown on the plans .
4 . The comprehensive plan shows this area as residential with the
zoning being R-12 .
PROPOSED DEVELOPMENT
1 . The public facilities at the end of S . W. Bond st . will be
extended to serve this project and will be stubbed out to the
north for future extension .
2 . The southerly half of S.W. Bond st will transition from 25
feet of right of way to 30 feet at the west line of lot 82 as
shown , the improvement width through this area will transition
from 17 feet to 22 feet in width to provide an over width half
street improvement of • .W. Bond st to the intersection of S.W.
81st Place as shown the balance of the project will be H
constructed to normal city standards .
2 . All work shall be done to the City of Tigards construction
standards . ,
4 . The "adjacer.t area possible development plan" is included as
part of this preliminary plat submission, the 1"=30 ' scale
plan is provided to more clearly show the half street
transition improvement and hcw the various utilities will be
located therein.
5 . This development will contain 16 lots that range in size from
4855 to 9200 sq . ft. which is with in the R-12 zoning
requirements . The total site area is 2 . 80 acres , the area in
the streets is . 56 area giving a net area of 2 . 24 acres which
gives a density of 7 . i. lots per net acre.
