The above-entitled matter came before the Hearings Officer at the regularly scheduled meeting of January 8 , 1987 , which hearing had been continued to January 15 , 1987 , at the Tigard Civic Center Town Hall Room, in Ticjard, Oregon; and The applicant requests approval of a sensitive lands permit to allow the construction of a sewer line within the 108th/113th Avenue ravine, property zoned R-25 , and located immediatly south of S.W. Durham Road and west of S .W. 108th Ave. , City of Tigard, County of Washington, State of Oregon; and The Hearings Offi_er conducted a public hearing on January 15, 1987 , at which time -_esti_mony, evidence and the Planning Department Staff Report were received; and The Hearings Officer adopts the findings of fact and conclusions contained in the Staff Report, a copy of which is attached hereto, marked "Exhibit A" and incorporated by reference herein. NOW THEREFORE IT IS HEREBY ORDERED THAT SL 9-86 be and hereby is approved subject to the following conditions : Page 1 - SL 9-86 4 1. That construction of the proposed sanitary sewerage improvement shall not commence prior to the execution of (and • City acceptance of) a construction compliance agreement. 2. TIGARD, OREGON 97223 A. FACTS 1 . General Information CASE: Sensitive Lands Permit (SL 9 -86) REQUEST: To allow construction of a sewer line within the 108th/113th Avenue ravine. COMPREHENE' "r: 7'1_AN DESIGNATION: Medium High and Low Density Residential ZONING DESIGNATION; R-25 (Residential 25 units/acres APPLICANT: Unified Sewerage Agency OWNER: See Application 150 N. 1st Avenue Hillsboro, OR 97214 LOCATION: Immediately south of SW Durham Road and west of SW 108th Avenue. 2. Background Information A previous application was approved in 1985 (File No. SL 2-85) to construct the southern portion of their sewer line. 3. Vicinity Information The area involved in this application is within the City near Durham Road and the southern section of the proposed line is within Washington County . The property within the City is zoned R-25 and the County properties are designated in the Tigard Comprehensive Plan for Low and Medium-High Density Residential development. 4. Site Information and Proposal Description The Sensitive Lands Permit is required for the sewer line proposed below the 140 elevation or within a drainageway. The area between 128 and 140 feet in elevation is identified as a significant wetlands area in the Comprehensive Plan. The and above 140 feet is within a drainageway. STAFF REPORT -- SL 9--86 - PAGE 1 The Unified Sewerage Agency is proposing to install a 12 inch, public sewer line between the existing pump station on the north side of Durham Road (which will be removed after completion of this line) to the existing portion of the line that is approximately 1,900 feet to the south. The elevation of the line will range from 130 to 175 feet. This line was contemplated in conjunction with the Summerfield development and the pump station is viewed as an interim solution for sewerage disposal. The northern section of they line will be within the City and the remainder will traverse County properties. During construction, a 50 foot wide area will be cleared of brush but larger trees are to be avoided to the greatest extent possible. The construction area will be reseeded immediately following construction. 5. (Agency and NPO Comments The Engineering Division has no objection to the proposal, provided the recommended conditions of approval are met. The Building Inspection Office, NPO #6, and Washington County Department of Land Use and Transportation have no objection the request. No other comments have been received . B. FINDINGS AND CONCLUSIONS Development in the ravine area between 120 and 140 feet is subject to the following standards in Section 18 .84.045 of the Code: Exception for Development in the 108th/113th Ravine Significant Wetlands Areas . (a) Under the Sensitive Lands Permit process, the Hearings Officer may allow portions of the Ravine at 108th and 113th designated as a significant wetlands area to develop provided that all of the following criteria are met. (1) All of the land (within the ravine) being considered for development is at less than 25% slope. (2) There are no unstable soil conditions on the land being considered for development. (3) The provisions of Chapter 18 . 150— TREE REMOVAL shall be met. Development in the northern remainder of the drainageway is subject to the following requirements that are found in Section 18.84.040 of the Code: (c) The Hearings Officer shall make findings that all of the following criteria are satisfied when approving, approving with conditions or denying an application request for a Sensitive Lands Permit within drainageways: STAFF REPORT - SL 9--86 -- PAGE 2 (1) The extent and nature of the propo.nd land form alteration or development will not create site disturbances to the extent greater than that required for the uses; (2) The proposed land form alteration or development will not result in erosion, stream sedimentation, ground stability or other adverse on—site and off—site effects or hazards to life or property; (3) The water flow capacity of the drainageway is not decreased; and (4) Where natural vegetation has been removed due to land form alteration or the development, the areas not covered by structures or impervious surfaces will be replanted to present erosion in accordance with Section 18 . 100 (LANDSCAPING AND SCREENING) . The proposed sewer line installation can satisfy the above criteria because of the factors below: 1. The bottom portion of the drainageway has a slope of less than 25 percent and the steeper side slope areas will be avoided. 2. There is no evidence of slope instability and replanting and soil stabilization measures will be taken. 3 . The cutting trees over 6 inches in diameter will be avoided to i-ne maximum extent possible as required by Chapter 18 , 150 of the Code. 4 , The area of work and soil disturbance will be held to a minimum and will be limited by the width of the easement. 5. The terrain will be virtually unchanged before and after construction and the present water carrying capacity of the drainageway will retained . C. RECOMMENDATION The Planning staff recommends approval of CSE 9- 86 subject to the following conditions: 1 . That construction of the proposed sanitary sewerage improvement shall not commence until posting of a 100% performance bond, payment of public improvement plan check and inspection fees and execution of (and City acceptance of) a construction compliance agreement . 2. That construction of the proposed sanitary sewerage improvement shall occur between April 30th and October 1st, 1985, unless written permission is received from the City Engineer. 11 STAFF REPORT SL 9--86 PAGE 3 3 . Erosion control shall be applied through the course of construction and, further, a temporary (before and during construction) and permanent (after construction) erosion control plan be submitted as part of the public improvement plans to be approved by the City Engineer. 4. TIGARD, OREGON 972.23 A. FACTS 1 . General Information CASE: Sensitive Lands Permit (SL 9 -86) REQUEST: To allow construction of a sewer line within the 108th/113th Avenue ravine. COMPREHEN:'','7_ ''i_AN DESIGNATION: Medium High and Low Density Residential ZONING Dr_SIGNATION: R-25 (Residential 25 units/acres APPLICANT: Unified Sewerage Agency OWNER: See Application 150 N. 1st Avenue Hillsboro, OR 97214 LOCATION: Immediately south of SW Durham Road and west of SW 108th Avenue. 2. Background Information A previous application was approved in 1985 (File No. SL 2-85) to construct the southern portion of their sewer line. 3. Vicinity Information The area involved in this application is within the City near Durham Road and the southern section of the proposed line is within Washington County . The property within the City is zoned R- 7.5 and the County properties are designated in the Tigard Comprehensive Plan for Low and Medium—High Density Residential development . 4 . Site Information and Proposal Description The Sensitive Lands Permit is required for the sewer line proposed below the 140 elevation or within a drainageway. The area between 128 and 140 feet in elevation is identified as a significant wetlands area in the Comprehensive Plan. The land above 140 feet is within a drainageway. STAFF REPORT -- ;L 9-86 -- PAGI 1 The Unified Sewerage Agency is proposing to install a 12 inch, public sewer line between the existing pump station on the north side of Durham Road (which will be removed after completion of this line) to the existing portion of the line that is approximately 1,900 feet to the south. The elevation of the line will range from 130 to 175 feet. This line was contemplated in conjunction with the Summerfield development and the pump station is viewed as an interim solution for sewerage disposal. The northern section of tho line will be within the City and the remainder will traverse County properties. During construction, a 50 foot wide area will be cleared of brush but larger trees are to be avoided to the greatest: extent possible. The construction area will be reseeded immediately following construction. 5. Agency and NPO Comments The Engineering Division has no objection to the proposal, provided the recommended conditions of approval are met. The Building Inspection Office, NPO #6, and Washington County Department of Land Use and Transportation have no objection the request. No other comments have been received. B. FINDINGS AND CONCLUSIONS Development in the ravine area between 128 and 140 feet is subject to the following standards in Section 18 .84.045 of the Code: Exception for Development in the 108th/113th Ravine Significant Wetlands Areas . (a) Under the Sensitive Lands Permit process, the Hearings Officer may allow portions of the Ravine at 108th and 113th designated as a significant wetlands area to develop provided that all of the following criteria are met. (1) All of the land (within the ravine) being considered for development is at less than 25% slope. (2) There are no unstable soil conditions on the land being considered for development. (3) The provisions of Chapter 18 . 150- TREE REMOVAL shall be met. Development in the northern remainder of the drainageway is subject to the following requirements that are found in Section 18.84.040 of the Code: (c) The Hearings Officer shall make findings that all of the following criteria are satisfied when approving, approving with conditions or denying an application request for a Sensitive lands Permit within drainageways: STAFF REPORT - SL 9--86 - PAGE 2 • (1) The extent and nature of the propo*nd land form alteration or development will not create site disturbances to the extent greater than that required for the uses; (2) The proposed land form alteration or development will not result in erosion, stream sedimentation, ground stability or other adverse on-sits and off-site effects or hazards to life or property; (3) The water flow capacity of the drainageway is not decreased; and (4) Where natural vegetation has been removed due to land form alteration or the development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Section 18. 100 (LANDSCAPING AND SCREENING) . The proposed sewer line installation can satisfy the above criteria because of the factors below: 1 . The bottom portion of the drainageway has a slope of less than 25 percent and the steeper side slope areas will be avoided. 2. There is no evidence of slope instability and replanting and soil stabilization measures will be taken. 3 . The cutting trees over 6 inches in diameter will be avoided to i-ne. maximum extent possible as required by Chapter 18 . 150 of the Code. 4 , The area of work and soil disturbance will be held to a minimum and will be limited by the width of the easement. 5. The terrain will be virtually unchanged before and after construction and the present water carrying capacity of the drainageway will retained . C. RECOMMENDATION The Planning staff recommends approval of SL. 9- 86 subject to the following conditions: 1 . That construction of the proposed sanitary sewerage improvement shall not commence until posting of a 100% performance bond, payment of public improvement plan check and inspection fees and execution of (and City acceptance of) a construction compliance agreement . 2. That construction of the proposed sanitary sewerage improvement shall occur between April 30th and October 1st, 1985, unless written permission is received from the City Engineer. STAFF REPORT SL 9-86 -- PA(;I1 3 . Erosion control shall be applied through the course of construction and, further, a temporary (before and during construction) and permanent (after construction) erosion control plan be submitted as part of the public improvement plans to be approved by the City Engineer. 4. Three (3) sets of plan—profile public improvement construction plans and one (1) copy of construction agreement, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Section for approval . 5. A plan showing the location of all trees over 6 inches in diam±ter that are to be removed shall be approved by the Planning Director. 6.
