The above-entitled matter came before the Hearings Officer
at the regularly scheduled meeting of May 14 , 1987 , at the
Tigard Civic Center Town Hall Room, in Tigard, Oregon; and
The applicant requests a conditional use approval to
construct a 4 , 200 square foot addition to an existing church
on property located 14.245 SW Hall Blvd. , and more property
described as Map 2S1 11AA, Tax Lot 401, City of Tigard, County
of Washington, State of Oregon; and
The Hearings Officer conduced a public hearing on May 14 ,
1987, at which time testimony, evidence and the Planning Depart-
ment Staff Report were received; and
The Hearings Officer adopts the findings of fact and conclu-
sions contained in the Staff Report, a copy of which is attached
hereto, marked "Exhibit A" and incorporated by reference herein;
NOW THEREFORE IT IS HEREBY ORDERED THAT CU 87-01 be and
hereby is approved subject to the following conditions.
1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE

system, prior to City issuance of building and/or grading permits.
A copy of said letter shall be provided to the City.

The site grading plan shall include provisions for erosion control,
including temporary control during construction.
4 . The applicant shall provide for positive control of
parking lot and roof drainage to the public stormwat.er drainage
system.
5. A revised landscaping plan shall be submitted for Planning

2. Background Information
On July 24, 1984, the Hearings Officer approved a proposal for a
Conditional Use (CU 2-84) to allow a church on the subject property.
Site Development Review approval (SDR 16-84) was obtained on August 3,
1984. Since this approval the Community Development Code has been
amended so that Site Development Review applications are no longer
necessary in conjunction with a Conditional Use.

• 3 . Vicinity Information
Single family residential development on lots ranging from 7,500 square
feet to three acres in size surrounds the subject property. The R-4.5
zone lies to the north, west, and south. The R-7 zone applies to
properties on the east side of Hall Boulevard.
' , 4. Site Information and Proposal Description
The property is on the west side of Hall Boulevard, between McDonald
Street and Greenward Lane and an 8, 100 square foot church is situated
in the northwest corner of the parcel with access to Hall Boulevard.
The applicant proposes to construct a 4,200 square foot, two story
addition on the south side of the existing building. A 39 space
parking lot along Hall Boulevard and a softball diamond are also
contemplated.

5. Agency and NPO Comments
The Engineering Division has the following comments:
1 . The applicant shall obtain written permission from the State of
Oregon for stc.rm runoff into the State's system, prior to City
issuance of building and/or grading permits . A copy of said
letter shall be provided to the City .
2. Site grading shall only occur from June 1 to August 31 . The site
grading plan shall include provisions for erosion control,
including temporary control during construction.
3 . The applicant shall provide for positive control of parking lot
and roof rain drainage to the public stormwater drainage system.
The Building Inspection Division and Tigard Water District have no
objection to the request.
The Tualatin Rural Fire Protection District states that access for fire
equipment and water flow availability must meet District requirements .
The State Highway Division notes that a storm drainage problem exists
on the property and adjoining street right-of-way. A system for storm

water detention is advised.
No other comments have been received .
B. FINDINGS AND CONCLUSIONS
Section 18 . 130.040 of the Code contains the following general approval
criteria for a conditional use:
1 . The site size and dimensions provide:
•
a. Adequate area for the needs of the proposed use; and
b. Adequate area for aesthetic design treatment to mitigate
possible adverse effect from the use on surrounding
properties and uses.
2 . The characteristics of the site are suitable for the proposed use
considering size, shape, location, topography, and natural
features.
3 . All required public facilities have adequate capacity to serve
the proposal.
4 . The applicable requirements of the zoning district are met except
as modified by this Chapter.
J 5. The supplementary requirements set forth in Chapter 13. 114
(SIGNS) and Section 18 , 120. 180 (APPROVAL STANDARDS) Site
Development Review, if applicable, are met.

6. The use will comply with the applicable policies of the
Comprehensive Plan.
Section 18. 130. 150(x)(10) contains the following additional criteria
for religious assembly (church) .
1. Lot Size: The minimum lot size shall be 20,000 square feet.
2. Setbacks:
a. The front yard setback shall be a minimum of 2.5 feet.
b. On corner lots and through lots, the setback shall be a
minimum of 20 feet plus meeting visual clearance areas
(Chapter 18. 102) .
c. The side yard setback shall be a minimum of 20 feet:.
d. The rear yard setback shall be a minimum of 20 feet.
e. Each setback shall be increased 5 feet for every 10 feet of
building height over 45 feet.
The proposed addition is consistent with the above criteria that
were also met by the original proposal. The addition and the
parking lot expansion will not encroach upon any abutting
properties. Driveway location, street improvements, and most of
the landscaping was approved and installed as part of the earlier
application. The stormwater concerns mentioned by the
Engineering Division and the State Highway Division can be
addressed as a condition of approval .
The proposed additional landscaping is consistent with Code
requirements except for the southern end of the new driveway.
Additional information should be submitted prior to construction
which shows how visual buffering will be provided between the
parking lot and the house on Tax Lot 400.
C. RECOMMENDATION
The Planning staff recommends approval of CU 87-01 subject to the
following conditions:
1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE SATISFIED PRIOR
TO ISSUANCE OF BUILDING PERMITS.
2. The applicant shall obtain written permission from the state of
