The above-entitled matter came before the Hearings Officer
at the regularly scheduled meeting of October. 16 , 1986 , at the
Tigard Civic Center Towr Hall Room, in Tigard, Oregon; and
The applicant requests a conditional use permit to allow
the sales of heavy equipment on property z ,ned General Commercial,
more specifically described as Tax Lots 901 and 1000, Map 1S1
36DA, City of Tigard, County of Washington, State of Oregon; and
The Hearings Officer conducted a public hearing on October 16 ,
1986 , at which time testimony, evidence and the Planning Depart-
• ment Staff Report were received; and
The Hearings Officer - rlopts the findings of fact and conclusions
contained in the Staff Report, a copy of which is attached hereto,
marked "Exhibit A" and incorporated by reference herein.
NOW THEREFORE IT IS HEREBY ORDERED that CU 6-86 be and hereby
is approved subject to the following conditions :
1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR
TO OCCUPANCY OF THE NEW BUSINESS .
2 . The applicant shall obtain a permit from the State of
Oregon Highway Division, if any work is to be performed within

the right of way of SW Villa Ridge Way. A copy of said permit
shall be provided to the City Engineering Office.
3. The applicant shall provide for connection of proposed
buildings/facilites to the public sanitary sewerage system. A
connection permit is required.
4 . Sanitary and storm sewer details shall be provided as
necessary as part of the Building Permit plans. Calculations and
topographic service area basin map shall be provided as a supple-
ment, to demonstrate evidence of area basin full development
serviceability. The location and capacity of existing and pro-
posed (or future) lines shall be addressed.
5. A revised landscaping plan shall be submitted for Planning
Director approval which notes a buffer (five foot hedge or equivalent)
along the eastern boundary of the paved area south of the parking

6. This approval shall remain valid if exercised within one
' year of the final approval date.

2. Background Information
No previous applications have been reviewed by the City regarding this
property .
3. Vicinity Information
All of the surrounding properties are also zoned C–G. The Fred Meyer
shopping center lies on the north side of Pacific Highway and a variety
of developed and undeveloped parcels are immediately adjacent to tie
subject property. Villa Ridge Way, which lies between the property to
Pacific Highway and the property, acts as a frontage road and also links
72nd Avenue to Pacific Highway . A natural drainageway is to the south.
4. Site Information and Proposal Description
The property contains two one–story buildings of approximately 8,500 and
4,500 square feet that are presently used for a combination of
commercial and nonconforming industrial activities . The new tenant
proposes to use the property for selling heavy construction equipment .
It is also intended that the property will alsq be cleaned up including
removal of the material stored outside, improvement of the existing
landscaping, striping the parking lots, and repairing the building.

5. Agency and NPO Comments
The Engineering Division has the following comments:
a. Villa Ridge Way is within State Highway right-of-way .
b. The street is narrow and in relatively poor condition.
c. Modifications to the linkage between 72nd Avenue and Pacific
Highway will be necessary and this in turn will effect the future
design and function of Villa Ridge Way. Since the nature of these
future improvements is not known, half street improvements are not
advised at this time.
d . The applicant should execute a non-remonstrance agreement to
participate in a future local improvement district to help correct
the traffic circulation and drainage deficiencies that exist in
the area.
e. City Code requires that the property be connected to public
sanitary sewer if such a facility is within 300 feet.
• The Building Inspection Division notes that because of the relatively
steep terrain at the south end of the property, any future development

will require an engineered cut and fill as well as a storm drainage plan
The State Highway Division, Tualatin Rural Fire Protection District, and
NPO #4 have no objection to the proposal .
B. FINDINGS AND CONCLUSIONS
The application deals only with the proposed use for a buildincc of
approximately 8,500 square feet. A second building occupies the
property which is in the neighborhood of 4,500 square feet. The
proposed use of the entire property should be clarified during the
hearing.
The present use of the property does not conform with present City
requirements because out'1oor storage of material, as well as fabrication
or assembly are regarded as industrial activities that are not permitted
in the C-G zone. The sale of heavy equipment is permitted as a
conditional use.
The proposal conforms with Community Development Code standards for
building height and setback, landscaping, parking, access and the
Conditional Use criteria contained in Section 18 . 130 150(c)(4) of the
Code also applies to the request. This section states that a five foot
"perimeter setback shall be used for landscaping and screening
purposes" . Staff concludes that this should be interpreted to apply
only to the areas where vehicles and equipment ar,a ::cored or parked
outside and not to the entire perimeter of the property .

The western side of the buildings abut or are very close to the western
property line. The parking area is located east of the buildings and a
hedge is immediately east of the parking lot. No screening exists on
the east side south of the parking lot. A mini-storage facility is
immediately east. Staff recommends that the existing vegetation along
the eastern side of the parking lot be extended to the southern edge of
the existing paved storage area.
C. RECOMMENDATION
Based upon the discussion above, the Planning staff recommends approval
of CU 6-06 subject to the following conditions:
1 . UNLESS OTHERWISE NOTED, ALL. CONDITIONS SHALL. BE MET PRIOR TO
OCCUPANCY OF THE NEW BUSINESS.
2 . The applicant shall obtain a permit from the State of Oregon

The attached represents a request for a conditional use
permit to occupy the facility at 11564 SW Pacific Highway.
The sellers of the property will be making the following
repairs prior to the close of escrow of the subject
transaction:
1 . They will be repairing the main roof by adding an
additional layer of roofing and tar to the existing
roof.
2 . They will repair the flashing on the barrel roof
portion and the eaves at the two lowest. ends.
3 . They will be replacing two overhead doors which are
currently in disrepair, as well as three man doors.
4 . There are two windowsills, one on the east side of the
building and one on the north side, which will be
repaired.
5. The electrical service to the build' ng has been
inspected, and there are several bees which need
covers installed and several wires which need to be
tied off.
6. They will do a generalclean-up of the facility and
yard area and remove all equipment.
In addition, the purchaser will be performing a general
reconditioning of the subject property after closing,
including striping of the parking lot, additional
landscaping, and painting the building.

Villa Ridge and Frontage Road at the Pacific Highway

Description. Villa Ridge is a portion of the old Pacific High-

way and connects with SW 72nd Avenue south of the highway.
Traffic using 72nd must use one of two 15 degree intersections
at Pacific Highway. Villa Ridge presently serves as a frontage II
road less than 1500 feet long.

The improvement depends upon the Haines-Pfaffle connection
shown on the Comprehensive Plan. III
As a first phase, expand and improve the Villa Ridge frontage

road from Highway 217 to SW 71st Avenue. Provide for one-way
northbound traffic on the frontage road where rights-of-way are

111 Traffic Volumes . Traffic on Pacific Highway is approximately
29 ,000 vehicles per day; 2400 VPD on 72nd, and 1100 VPD use
I SW 71st Avenue. A 1968 turning movement count recorded 4500
vehicles per day using the signalized Fred Meyer entrance . One
thousand four hundred (1400) VPD were recorded on the north end
ill of Villa Ridge.
liIntersection Control. Villa Ridge , 72nd, and 71st Avenue are
controlled by stop signs . The Fred Meyer entrance is signalized.

Accidents . Twelve accidents were recorded at this location dur-
Uing 1970. One rear end accident at 72nd and Villa Ridge, 1 angle
accident at the Fred Meyer entrance , and 9 rear end and 1 angle
accident at the south end of Villa Ridge and Pacific Highway.
Six accidents were recorded at 79th and Pacific Highway . These
included 4 rear end, 1 turning, and 1 sideswipe meeting accidents .
