We have received a copy of the approval of CU 1 -84 with its
conditions
Based on discussions with the City Engineer ' s office ( Randy Clarno)
arid the State Highway Dept. ( Terry Funk) , we understand that
• Condition 4 requires a total of 35ft. from center line for right
of way on Hall Blvd .
} On Tax lots 1000 and 900 ; SDR 1 -81 provided for the dedication of
36ft of right of way.

On Tax lot 800, right of way to 35ft was deeded to the State in

Sept. 1958.

Waiver of Remonstrance has already been signed on Tax lot 900 for

The above-entitled matter came before the Hearings Officer
at the regularly scheduled meeting of May 24 , 1984, at the Durham
Waste Treatment Plant, Tigard, Oregon, at which time testimony,
evidence and the Planning Department' s Staff Report were received;
and
The Hearings Officer adopts the findings and conclusions
contained within the Staff Report, a copy of which is attached
hereto and incorporated by reference herein and marked Exhibit "A" ;
and
The Hearings Officer further finds that Tax Lots 800 , 900

and 1000 are operated by these applicants as a single business,
even though there is a separate dwelling unit on each tax lot.
Therefore, the Hearings Officer finds jurisdiction over all of the

of approval of this application as follows :

CU 1. 84 is approved subject to the following conditions :
1. An access permit shan be obtained from the State Iigh; ay

APPLICATION: Request by Start Right, Inc. for conditional use approval to
separateeaa children's day care facility on property zoned R-4.5 (Residential,
4.5 units/acre) located at 12340 SW Hall Blvd. (Wash. Co. Tax Map 2S1 1BC, Tax
Lot 800).
° A. FINDING OF FACT
1. Background
A Conditional Use permit for the parcel on the corner of Hall
Blvd. and Hunziker Street (Tax Lot 1000) was granted in 1967 and
1968 (CU 13-67 and CU 16-68) for a day care center and an
expansion was approved in 1975 (CU 15-75) . Conditional Use
approval was granted in 1980 (CU 15-80) to allow the expansion of
the business to the adjoining lot on the north (Tax Lot 900).
Site Development Review approval was subsequently granted in 1981
(SDR 1-81) for Tax Lot 900 subject to the following conditions:

a. All conditions of Conditional Use, CU 15-80 shall be met.
b. The fence along the eastern edge of Tax Lot 900 shall be '
eight (81 ) feet in height and site obscuring. The remaining ; '
fence around Tax Lot 900 shall be six (61 ) feet high.

non-remonstrance agreement be signed for, future improvements along
the Tax Lot 900 frontage.

2. Vicinity Information
The properties east of Hall Blvd. are zoned R-4.5 (Residential,
4.5 units/acre) and the CBD (Central Business District) zone is on
the west side. Knoll Drive is a one-way local street which has an
entrance from Hall Blvd. on the north side of the subject property.
3. Site Information and Proposal Description
•
The property contains a single family residence which has a
driveway onto Hall Blvd. and Knoll Drive. The applicant proposes
to convert the house into a children's day care facility that will
be open from 6:30 A.M. to 6:00 P.M. on weekdays. A one-way
driveway with an entrance on Knoll Drive and an exit on Hall Blvd.
will be installed as part of the renovation. Five parking spaces
will be provided on the east side of the building.
4. Agency and NPO Comments
The Engineering Division concurs with the State Highway Division
on street improvement requirements.
The State Highway Division recommends half street improvements
including 2.5 foot wide pavement cont centerline,no ccess curb, and is neadedxo(6)
foot wide sidewalk along Hall Blvd.
Hall Blvd. street improvements are not required.
The Building Inspection Office and NPO #5 have no objection to the
proposal.
Comments have not been received from Tualatin Rural Fire
Protection District.
B. ANALYSIS AND CONCLUSION
`" " , This proposal will expand the day care center to include the three
a residences located between Hunziker Street and Knoll Drive.
This
facility should act as a suitable buffer between Hall. Blvd. and the
remaining residences to the east. The traffic generated by the day care
..' center is only directed towards Hall Blvd. and Hunziker Street and
,a' therefore Knoll Drive should be unaffected by this request.
, The previous Site Development Review approval (SDR 1-81) required an
8-foot tall sight obscuring fence along the eastern boundary of Tax Lot
f 900. This apparently was not done and should remain as a condition of
approval. A continuation of this fence north along the eastern boundary
of the subject property (Tax Lot 800). Section 18.120,180 A.5. of the
Code provides the authority for a buffering requirement.

Section 18.106.030 of the Code requires that children's day care
facilities provide 5 parking spaces, plus one additional space for each
classroom. Information regarding the number of classrooms was not
submitted, however, it appears that at least 6 spaces should be provided.
C. RECOMMENDATION l
The Planning staff recommends that Conditional Use application CU 1-84
be approved subject to the following conditions:

1. An access permit shall be obtained from the State Highway Division
for the new driveway exit onto Hall Blvd.
2. The proposed site plan shall be modified to include an 8-foot tall ..
sight obscuring fence along the eastern boundary of the subject
property (TL 800) and a minimum of 6 parking spaces which conform
with the standards in the Code (Chapter 18.106). These revisions !',.

east boundary of TL 900 as per the condition of approval for SDR

Reference: Permits for Play Equipment
Dear Mrs. Levear:
At your request, I have reviewed Tigard's code provisions to determine if any
permits are required for your proposed play structure. Based on the
information which you provided to me, I have determined that no permits are
required from the City. The only code section which is closely related is •
Section 18.144, Accessory Uses and Structures. This section requires Director
review of buildings or structures which are incidental to the principal
"" structure on building lots.
My determination is based on the definition of Accessory Uses and Structures
found in 18.144.020. Examples given therein are almost exclusively enclosures
except for docks, wind generating devices, and antenna towers and TV dishes.
y Play equipment, unless it constitutes a play house or ehelter, is not, in my
opinion, governed by this section.
Nonetheless, in order that your neighbors are not adversely affected by the
structure, you may wish to comply with the standards normally applied to
• accessory structures, including:
1. Provide for rear yard setback of 5 feet.
2. Limit height to an average of 10 feet, but at no point exceed 12 feet iii
height.
3. Insure that the structure does not interfere with the use of any adjoining
property.
if you require further assurance of the non-applicability of the Code, you may
wish to provide more details pertaining to the size and area of the play
structure to my staff We would review them and promptly respond. 1

This is a request for' a conditional unc permit to operate
children ' s day care at 12340 S . W. Hall Boulevard , Tigard . This
existing house is located in an R4 . 5 residential zone. The
operation of children ' s day care is a use permitted under
Chapter 18-50, Section 040, Paragraph A of the City of Tigard
code .
1 , This property is located south of Pacific Highway on Hall Blvd.
adjacent to an existing day care center which is owned and
operated by the applicant.
The need for good quality day care for infants and toddlers
continues to increase in the Tigard area . Tnis can be substantiated
by the waiting list at the . x5 tin center and by the attaahed
letter from Children ' s Services Division.
This site is ideal for the proposed r i as it will be an expansion
of the existing day care and therefore the existing access
and egress can be used , thus not affecting traffic flow. Also
it is located conveniently to the growing industrial areas of
Tigard providing employers and employees the advantage of
reliable children' s day care close by or en route to the place
of work
The appearance of the neighborhood will remain unchanged as
day care can be conducted in a residential structure with minimal
alterations . in this location a fence will be added for the safety
of the children and additional parking will be added for parents ,
The hours of operation will be from 6 : 30am to 6 : 00pm , Monday
to Friday, the same as the existing center.
For the past six years the applicant has provided good quality
and reliable children ' s day care benefiting the children ,
parents and their employers in the Tigard community.

Mrs. Levear has indicated that she is particularly interested in expand-
ing services for infants and toddlers or those children under the age of

21/2 years. Care for this age group is particularly in demand in Washing-
ton County. TWo information and referral services that serve this coun-
ty reported that 63 and 58 of their calls last month were for care for
children under the age of 2 velrs. In September, 73 , of the calls wore
for this type of care. Mrs. Levear reports that she has a waiting list
H . of 17 Children, 11 of whom are infants and toddlers.
