When the subdivision was platted, the applicant' s lot was ' virtually identical to the other lots along the golf course. However; f' that platting configuration did not take into consideration the larger 1 side yard setbacks required for a corner lot, which thereby reduced the iseable. btiilding apace of the subject lot, to a long, narrow building Site. The authorization of the variance shall not be materially detrimental to the purposes of this title, be injurious to the property in the same zone or vicinity in which the property is located, or be otherwise detrimental to the objective of any city development plan or policy: By allowing the applicant a variance; • he may construct a larger home more in keeping with the neighboring homes: The larger home shall, compliment the property in the same zone or vicinity rather than beinjtrious to it, whidh a smaller home might be. The extraordinary conditions in this case are of the applicants own doing and not a result of physical features or size of the .lot. The s'. lot is larger than required in the R-7 zone. It appearsas though the applicant could choose a house plan better suited to the: lot or build the home he desire on a different lot. 2. The applicant is not being denied any property rights. The smaller setbacks in Summerfield are allowed as a result of the Planned• . Development designation and approvals under the PD process. The 7. applicant's property is part of an approved subdivision which is, subject to different approval standards than Summerfield: However, the applicant enjoys the same rights as othersbuilding in the same • subdivision or any other R-7 subdivision approved in conformance with R-7 standards and subdivision regulations. 3. The authorization of the variance could be detrimental to the zoning code in that the zoning code clearly outlines specific dimensional ;•; requirements related to setbacks in all residential zones. The setback requirements should be respected or the ordinance should be $ , amended if different setback requirements are deemed more appropriate. Issuance of this variance, however, would not violate visual clearance requirements. 4. The variance requested is the minimum to allow the applicant to build the: home proposed, however, a different orientation of that home or construction of a different home may eliminate the need for a variance. Ash St. Tigard, Oregon 97223 CITY OF TIGARD PLANNING DEPT. Dear Sir: Recently I purchased the lot on S.W. 98th Ave,, just north of Kimberly Dr. and bordering the Summerfield golf course. The lot is 150' long by 70' 4" wade. It is a corner lot, and adjoins the James McCoy residence on the west but no others. This area is zoned -7, which calls for a 20' setback both front and side. I propose to build a contemporary, one-story house. It is56' long and 53' bride. It is my intention that this house will be an improvement, both as to size and quality of construction, to the immediate neighborhood. Enclosed is a preliminary sketch of the house and lot. It is a one-family residence. First I contacted a member of the city planning commission. I was told that a preliminary hearing (cost $300) was called for, and that denial of the application would be automatic.. I was then supposed to request a hearing before the city council (cost $250). The outcome of this hearing to be uncertain. The $300 was • paid, anda date for the hearing set. At this point another member of the planning commission introduded, saying the building codes were going to be revised, and they were going to be made mare flexible.- This was supposed to occur 5.n Hay. .'. I then asked for and was granted a cancellation of the original hearing. $250 of • the $300 was refunded to me. I now find out the entire situation is up in the air so to speak, and nobody knows when anything is going to be done. First I would like to take up the legality of the situation insofar as the city of Tigard is concerned: (1) The Tigard city charter,''. says othe city shall have all powers which the Constitution, statutes and common law of the United States, and of this state expressly or impliedly grant or allow municipalities as fully` as though this charter specifically enumerated each of those powers. The impression I get from this wording is that the person who drafted this charter is saying to the effect, "I will eat the frosting and ignore the cake." This. I assure you. cannot be done. The cite of Tigard is under the complete jurisdiction of the United States constitution as .ell as the constitution 4 the State Of Oregon and the common laws of both. Article 14 of the U.S. constitution says, NNo state shall make or enforce any law which shall abridge the privileges of its citicons. ' This is also repeated in the Oregon state constitution. A privilege, according to Websberis dictionary, is a right held by a: certain individual, group of class, and withheld from certain ethers or all others. The privilege of building expensive homes to Within 10+ of the property line . has been extensively granted to the comtriunity of Summerfield, which surrounds the area in which I propose to build. It is being denied to me contrary to the mandate of the U.S. constitution. The granting of this privilege on suoh an, eittensive basis constitutes a defacto acknowledgement by the city' of Tigard that they approve of this amount of sok under proper conditions. Considering the size of Summerfield, it comes as dose to establishing a comprehensive plan as anyone could ask without attaching the specific label to it.
