The above-entitled matter came before the Hearings Officer at
the regularly scheduled meeting of August 23 , 1984 , at the Durham
Waste Treatment Plant, in Tigard, Oregon; and
The applicant requests a sensitive land permit to allow the de-
velopment of a portion of the Fanno Creek Downtown Park between Hall
Blvd. and Ash Street within the 100-year flood plain on ol-operty zoned
CBD (Central Business District) , property more specifically described
0 as Tax Map 251 2DB, Tax Lot 400 and 500 and 2S1 2DA, Tax Lot 702 , City
of Tigard, County of Washington, State of Oregon; and
The Hearings Officer conducted a public hearing on August 23, 1984 ,
at which time testimony, evidence, and the Planning Department Staff
Report were received; and
The Hearings Officer adopted the findings , the facts and conclusions
contained in the Staff Report, a copy of which is attached hereto, marked
"Exhibit A" and incorporated by reference herein;
NOW THEREFORE IT IS HEREBY ORDERED THAT SL 8-84 is approved subject
to the following conditions :

1. The City shall comply with all conditions of the permit issued
by the Division of State Lands.
2. The City shall follow the "Management Practices" described in
the April 19, 1984 , letter received from G.A. Newgard of the U.S. Army
Corps of Engineers.
3. This approval is valid if exercised within one year of the
fnal decision date.

A. FINDING OF FACT
1. General Information
CASE: Sensitive Lands Fermi', SL 8-84
REQUEST: Permit to develop a protion of the Fanno Creek Downtown Park
between Hall Blvd. and Ash St. within :h, 100 year flood
plain. The property is zoned CBD (Central Business
District) and is located on both side of Fanno Creek ( Wash.
Co. Tax Map 2S1 2DB, Tax Lot 400 and 500 and 251 2DA, Tax
• Lot 702).

2. Background
The property has been identified in the Tigard Comprehensive Plan as a
downtown park. A park master plan for this segment of Fanno Creek vas
prepared in 1980 (see enclosed site plan).
3. Vicinity Information
The properties to the north and west are zoned CBD including the future
City Hall site adjacent to Hall Blvd. The land to the south is zoned
CBD and R-12(PD) Residential, 12 units/acre,plann.ed development) and it
includes the Tigard Senior Center.
4. Site Information
The property is owned by the City and it is almost exclusively within
the 100 year flood plain of kenno Creek. The property is undeveloped
and the City proposes to open the area for recreational use. A trail
from Hall Blvd. to Ash Street Is proposed along the north side of the
creek with a foot bridge to provide access to the Senior Center south of
the creek. Several benches and picnic tables will be located along the
trail. An interpretive center is to be built south of the creek with
exhibits that will explain the natural features of the area.

In addition to the recreational facilities, a flood overflow channel is
intended to improve water carrying capacity during high water. This
improvement will extend through most of the property.
5. Agency and NPO Comments
The Building Inspection Office, US Army Corps of Engireers, and the
State Highway Division have no objection to the proposal.
\17)O Number 1 and the Tualatin Rural Fire Protection District have not
ra+ponded at this time.
".he Division of State Land has issued a permit subject to conditions.
B. ANALYSIS AND CONCLUSION
The proposal is consistent with the park master plan which envisioned
the proposed trail system, interpretive center, and other improvements.
The US Army Corps of Engineers and the Division of state Lands have no
objections to the request, provided certain conditions are met .
C. RECOMMENDATION
The Planning staff recommends approval of SL 8-84 subject to the
following conditions:
1. The City ,hall comply with all conditions of the permit issued by
the Division of state Lands.
2. The City shall follow the "Management Practices" described in the
April 19, 1984, letter received from G.A. Newgard of the U.S. Army
Corps of Engineers.
3. This approval is valid if exercised within one year of the final
decision date.
