This easement is located jUst south of S.W. bawn,s ct. which is off S.W. 113th Plade (See attached map) . construction of the trunk sewer is now complete and minor modifications of its routing Were required. Changes in the prior easement areas are now needed as a result of the routing changes. USA has submitted new easement forms with the corrected legal descriptions (attached) , The City Attorney has also reviewed these • document (attached) and is recommending aPproVal. 00 0 ALTEMATIvEs CONSIDERED 1. HOYT STREET PORTLAND, OREGON 97209 FROM Ken Fox (503) 222-4402 RE Standard Corporate Sewer Easement Forms . , This memorandum memorializes my telephone conversation of March 10, 1986, with Randy Clarno of the City of Tigard. In our conversation, I advised Mr. Clarno that I had reviewed and compared the City of Tigard's "Permanent Sanitary Sewer Easement' with the proposed "Cor- porate Sewer Easement" that was submitted to the City by the Unified Sewerage Agency of Washington. County. MY review of the two easement forms revealed them to be substantially the same. However, the easement forms do differ in the following respects: . ! 1. The USA Corporate Sewer Easement expressly provides that it shall run with the land. In contrast, the City of Tigard Permanent Sanitary Sewer Easement provides that it is • ; "perpetual" and states: "TO HAVE AND TO HOLD the above- described and granted premises unto said Grantee, its suc- - cessors and assigns forever. " The Tigard Easement does not expressly state that it runs with the land. However, by its language, the easement is binding on the grantee, his successors and assigns forever. I conclude that the practical effect is essentially the same as with the USA Eagement- , 2. The USA Corporate Sewer Easement provides that no structure shall be erected upon the easement without the written consent of the USA. In contrast, the Tigard Easement provides that it does tot convey and right, title or interest to the City except those expressly stated in the Easement, nor otherwise prevents grantors from the full use and dominion thereover. However, such use shall not interfere with the uses and purposes of the easement. As a practital matter, any structure built upon an easement Would "interfere with the use and purposes of the easement. fi Thus, the Tigard Easement would also require a property owner to obtain City approval before a structure could be erected. 3. The USA Eaement allows each individual easement form to Contain additional special conditions. No such provision is made in the Tigard Easement, The particular USA easement submitted to us for review has • attached a set of special •conditions. Hee ERhibit ne. While I conclude that these special conditions raise no concerns from a legal standpoint, they may raise engineering questions. Agency and NPO Comments • The Building Inspection Office, US Army Corps of Engineers, and the State Highway Division have no objection to the proposal. NPO Number 1 and the Tualatin Rural Fire Protection District have not responded at this time. The bivision of State Land has issueda permit subject to conditions. • B. ANALYSIS AND CONCLUSION • •, : The proposal is consistent with the park master plan which envisioned the proposed trail system, interpretive center, and other improvements. • The US Army Corps of Engineers and the Division of state Lands have no objections to the request, provided certain conditions are met. This permit authorizes the removal of 5,000 cubic yards of material and the placement of 50 cubic yards of riprap in Section 2, T2S, R1W (Fanno . 'Creek) to provide public access and sufficient drainage in the 100 year floodplain as outlined in the attached permit application, map and drawings. 2. Turbidity increase shall be limited to 10% increase above background as measured 100 feet below project. 3. Waste materials and spoils shall be placed above the Ordinary High Water line. 4. There shall be no operation of equipment in the active flowing stream between October 1 and June 1. 5. Material shall not be removed to a depth greater than the water surface level at time of operation. 6. There shall be no operation of equipment in the active flowing stream . except to connect the newly dug overflow channel into the existing stream. 7. Riprap shall be placed under these conditions: a. Only clean, erosion resistant rock from an upland source shall be used as riprap. No broken concrete or asphalt shall be used as riprap. b. Riprap shall be placed at the upstream end of the overflow channel and at the point where channel re-enters Fanno Creek. 8. Areas of streambank disturbance not covered by riprap shall be seeded or planted with grass and/or legumes and be planted no later than September 15. 9. Removal of existing woody vegetation shall be minimal, ;. 1O The Division of State Lands retains the authority to temporarily halt or modify the project in case of excessive turbidity or damage to natural resources.
