DESIGNATION: I-P: Industrial Park Zone. The I-P zone provides appropriate locations for
combining light manufacturing, office and small-scale commercial uses, e.g.,
restaurants, personal services and fitness centers, in a campus-like setting. Only
those light industrial uses with no off-site impacts, e.g., noise, glare, odor,
vibration, are permitted in the I-P zone. In addition to mandatory site
development review,design and development standards in the I-P zone have been
adopted to ensure that developments will be well-integrated, attractively
landscaped, and pedestrian-friendly.

APPROVED the above request,subject to a condition of approval. The findings and conclusions on which
the decision is based are noted in Section IV.
CONDITION OF APPROVAL

1. This location is approved for a wholesale sales use only. The storage and/or display of any type of
vehicle for sale and/or rent is strictly prohibited at this location.

FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 9442 SW Tigard Street;on the southwest side of SW Tigard Street,north of SW
Pacific Highway, and southeast of SW Grant Avenue. Fanno Creek borders the property to the
southwest. AITPI, LLC owns the subject property (WCTM 2S102AB, Tax Lot 1900) and the adjacent
property (WCTM 2S102AB,Tax Lot 1902); accordingly, the two tax lots make up a single development
site,with shared parking and access.Tax Lots 1900 and 1902 are located in the Industrial Park(I-P) Zone,
and are partially located in the Clean Water Services Vegetated Corridor and the Federal Emergency
Management Agency Special Flood Hazard Area.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.780 Site Development Review:
18.780.050 Minor Modifications
C. Approval criteria. The approval authority shall approve or approve with conditions an
application for a minor modification when all of the following are met:
1. The proposed development is in compliance with all applicable requirements of this
title; and
Because the applicant has only proposed a change of use to an existing tenant space, which primarily
affects off-street parking regulations, that is the main focus of this review. The 1,500-square-foot tenant
space will be changing to a wholesale sales use.No changes to the building footprint,the existing parking
lot,or landscaping are proposed.The subject property (Tax Lot 1900) shares parking and access with the
adjacent property (Tax Lot 1902). Together, the two tax lots make up a single multi-tenant development
site, which is subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D.
The table below calculates the minimum off-street vehicle requirements for this development site:

Staff finds that 49 parking spaces are required for the development site, taking into consideration the
change of use discussed above. Based on the applicant's submitted site plan, staff finds there is adequate
parking at the development site,with 87 parking spaces provided.
Upon review of the applicant's plans and narrative, staff finds that all other requirements of this Title are
not applicable. This criterion is met.
2. The modification is not a major modification.
The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this
proposal is not a major modification. This criterion is met.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Title.

9442 is a unit within formerly named Allred Industrial Park (which was
recently sold to Transpacific dK Investments, LLC.) — See Attachment A —
Site Map.
Metro Office Furniture is submitting a Type I Minor Modification
application and respectfully requests to change whatever
classification existed for the machine shop that 9442 was part of for
the last 42 years (most likely Light Industrial) to a classification of
Misc Business Services or Wholesale Sales (we do not care which) for
Metro Office Furniture.
History of the Address
The above mentioned address was part of a larger unit that was a machine
shop tenant at the industrial park for 42 years. It is assumed the machine
shop was classified by the City as Light Industrial for all those years. The
tenant moved out, and the spaces were vacant for over a year while the
property owner cleaned out equipment and other items left behind.
Metro Office Furniture moved into 9442 in February 2018. The first attempt
to obtain a business license resulted in failure as the above mentioned
address was not in the City Planning database and we referred the issue to
the owners to resolve.
The industrial park was then in negotiation for a sale, so the broker with
Macadam Forbes, Inc., Tyler Dean, submitted site and tenant information
with his Minor Modification application on behalf of another tenant. (Refer
to MM D2018-0018 dated May 2018.)
There was confusion around Metro Office Furniture's business model and
assumptions were made based on the company name that the business
was Bulk Sales (which is not allowed at that address.)
Tyler Dean worked with Agnes Lindor and Lina Smith (both with City of
Tigard) to resolve the classification issue for Metro Office Furniture while
submitting the Minor Modification MMD2018-0018 dated May 2018 on
behalf of another tenant, but the missing address in the Planning database
and minor modification from the previous machine shop classification to
Metro Office Furniture - Wholesale Sales/Misc Business Services was not
ever done.
Per the most recent email message from Lina Smith to Tyler Dean dated
October 10, 2018: Basically, when there's a new tenant, the required steps are to
contact the Planning Division to determine if the business is allowed the zone, apply for
any necessary land use approvals (like a minor modification), get an address/suite
created (if it's not already existing), obtain any necessary building permits (for example,
if the tenant is doing any remodeling), and then obtain a business license. In this
situation, it sounds like these steps weren't taken when Metro Office Furniture first
moved in, so we're processing the necessary approvals retroactively.
Metro Office Furniture has since applied for a business license on October

Metro Office Furniture's business is three-fold. First, consultations are
