DESIGNATION: R-7: medium-density residential zone. The R-7 zone is designed to accommodate
attached single-family homes, detached single-family homes with or without
accessory dwelling units,at a minimum lot size of 5,000 square feet, and duplexes,
at a minimum lot size of 10,000 square feet. Mobile home parks are permitted
outright. Some civic and institutional uses are permitted conditionally.

SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. This Temporary Use Permit is valid from October 3rd,2018 to October
3rd,2019.The findings and conclusions on which the decision is based are noted in Section IV.
THIS APPROVAL IS VALID FOR 12 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.

SECTION III. BACKGROUND INFORMATION
Site Information:
The subject property is proposed Lot 21 of the Elderberry Ridge Subdivision (PDR2016-00009). The
granted approval was for a 40 lot Subdivision, Planned Development Review, and Sensitive Lands
Review. The subdivision is located south of SW Bonita Road, east of SW 79th Ave, and west of SW 74th
Ave. All lots are zoned R-7 (PD),which is a medium-density residential zone.At the time of this writing,
the final plat for the Elderberry Ridge has not been submitted to the City of Tigard. A demolition permit
was issued for the single-family house at 14830 SW 76th Avenue (BUP2018-00116), and the applicant is
proposing to construct this model home/temporary sales office on the vacant lot. The applicant is
proposing to build the model home/temporary sales office in the exact location that will become lot 21
of the Elderberry Ridge Subdivision.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
CHAPTER 18.440 TEMPORARY USES:
18.440.050 Approval Criteria
C. Temporary sales office or model home. The approval authority shall approve or approve with
conditions a temporary sales office or model home,when all of the following are met:
1.Temporary sales office.
a. The temporary sales office shall be located within the boundaries of the subdivision or
property in which the real property is to be sold;and
The proposed temporary sales office is to be located within the boundaries of the Elderberry Ridge
Subdivision on proposed Lot 21. The real property to be sold includes the subject property.This criterion
is met.
b.The property to be used for a temporary sales office shall not be permanently improved
for that purpose.
The applicant proposes to establish a sales office within the single-family residential house, and no
commercial modifications have been requested. Once the temporary use expires, the commercial space
located within the single-family residential unit will be converted back into a residential space. This
criterion is met.
2. Model home.
a. The model home shall be located within the boundaries of the subdivision or property
where the real property to be sold is situated; and
The proposed house to be used as a temporary sales office will also serve as a model home.The house is to
be located within the boundaries of the Elderberry Ridge Subdivision on proposed Lot 21. The real
property to be sold includes the subject property.This criterion is met.
b. The property to be used for a model house shall be a permanently designed
dwelling structure.

The applicant proposes to utilize a single-family residential unit as a model home. Once the temporary
use expires,the single-family residential unit will be sold as a single-family residence.This criterion is met.
SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A Temporary Use Permit is a Type I procedure. As such,the Director's decision is final on the date it is
mailed or otherwise provided to the applicant,whichever occurs first. The Director's decision may not
be appealed locally and is the final decision of the City.
THIS DECISION IS FINAL ON OCTOBER 3, 2018
AND BECOMES EFFECTIVE ON OCTOBER 4, 2018

To whom it may concern,
Please accept this letter as Riverside Homes LLC's request to obtain four temporary use permits at the
upcoming Elderberry Ridge neighborhood prior to plat recording and improvement completion.
• Riverside would like to construct three model home on the future lots of record 21, 35 and 36, as
shown on the attached tentative plat.
• Plot plans have been attached to this request.
• The temporary sales office / model home, Lot 21, is located within the boundaries of the subdivision
and will be used for a temporary sales office. The garage will not be built out as a sales office. The
sales office will be located within the home.
• The two model homes, lot 35 and 36 are located within the boundaries of the subdivision where the
real property to be sold is situated and the property will be used for a model house and will be a
permanently designed dwelling structure.
• The fourth temporary use permit will be the location of a temporary construction trailer and will be
located within the boundaries of the property on which it is located.
