SECTION III. BACKGROUND INFORMATION
Site Information:
The 3.88 acre site is located east of SW 72nd Avenue,west of SW Sequoia Avenue, south of SW Bonita
Road, and north of SW Cardinal Lane. The site includes one building, an on-site parking lot, and
associated landscaping. In December 2012, the City of Tigard Planning Division approved a Zone
Change (ZON2012-00002) for 14830 SW 72nd Avenue, changing the zoning from Industrial Park (I-P)
to Light Industrial (I-L).
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.780 Site Development Review:
18.780.050 Minor Modifications
C. Approval criteria. The approval authority shall approve or approve with conditions an
application for a minor modification when all of the following are met:
1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant is proposing a minor modification to an existing development at 14830 SW 72"d Avenue.The
relevant requirements of this Title that apply specifically to this proposal are the development standards
of the Industrial Zones Chapter. Based on the applicant's submitted site plan,staff finds that the proposal
meets all applicable development standards,as outlined in CDC Table 18.130.2.The applicant is proposing
to convert 697 square feet of existing warehouse space into new offices and storage space.The applicant
will also add one window on the north facade and two windows on the west facade to accommodate the
new office space. Each window will also have one adjacent thru-wall air conditioning unit that is located
to the right of each window. No changes to the landscaping, parking, building height, or site plan are
proposed. No change of use is proposed, therefore the parking requirements are not affected.
Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are
met. This criterion has been met.
2. The modification is not a major modification.
The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this
proposal is not a major modification.This criterion has been met.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Title.

SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A minor modification is a Type I procedure. As such, this decision is final for purposes of appeal on the
date it is mailed or otherwise provided to the applicant, whichever occurs first. This decision is not
appealable locally,and is the final decision of the City.
THIS DECISION IS FINAL ON OCTOBER 4, 2018,
AND BECOMES EFFECTIVE ON OCTOBER 5, 2018.

SUMMARY OF PROPOSED CHANGES

portion of the existing warehouse building. Having the same footprint as the new offices below, the open
mezzanine storage with railings will be constructed aligned to the adjacent existing warehouse mezzanine
level.This new mezzanine will be of wood construction. New exterior aluminum windows will be provided at
the existing north and west walls of the existing warehouse building.
EVALUATION CRITERIA (Based on TDC 18.780.040.B)
1. An increase in dwelling unit density, or lot coverage for residential development
Response: Not applicable. The project is not a residential development.
2. A change in ratio or number of different types of dwelling units
Response: Not applicable. The project is not a residential development.
3. A change requires additional on-site parking in compliance with Chapter 18.310, Off-Street Parking
and Loading
Response: No additional on-site parking is required.
• The floor area of the new offices and storage room is 4.45% of the Level 1 floor area
(15,674 square feet) of existing warehouse. Being less than 10% of Level 1 floor area, this
new offices and storage area can be considered an incidental use and maintain the same S-
2 occupancy classification (OSSC 2014 Section 509.3).
• Offices can be an accessory use of the Warehouse/Freight Movement (TDC 18.60.070.G.2)
and the accessory use are subject to the same regulations are the primary use (TDC
18.060.020.C).
• No change of use therefore no additional parking is required (TDC 18.310.020.C.1).
4. A change in the type of commercial or industrial structures as defined by the building code.
Response: There is no proposed change in the structure of the buildings. The existing Type of

Response: Except for the new exterior windows, there will be no change on the exterior shell of the

Response: The new offices will be occupied by current employees. At the moment, some of these
employees do not have their own office and some employees are cramped together in a small space

expansion under 5,000 square feet.
Response: With the proposed new offices and storage, the floor area will increase by 3.8% of the
total floor area of the existing warehouse building (18,264 square feet, including mezzanine). This is
less than the 10% criteria.
9. A reduction in the area reserved for common space or usable open space that reduces the open
space area below the minimum required by this title or reduces the open space area by more than
10 percent.

STATUTORY BARGAIN AND SALE DEED
United Pipe & Supply Co. Inc., an Oregon corporation, Grantor, conveys to Crawfish, LLC, an
Oregon limited liability company, Grantee, the following described real property:
See Legal Description attached hereto as Exhibit A and by this reference incorporated herein.
The true consideration for this conveyance is$1,675,000.00. (here comply wth requirements of ORS 93.030)
The foregoing real property is conveyed free and dear of any and all hens, interests, encumbrances, and
other Interests, including rights or claims based on any successor or transferee liability pursuant to that
certain Order Authorizing Sale of Portland, Oregon Real Property to Crawfish, LLC, an Oregon limited
liability company, Free and Clear of all Liens, Claims, Interests and Encumbrances issued by the United
States District Court for the District of Oregon on December 21, 2012 attached hereto as Exhibit B.
Notwithstanding the foregoing, the real property conveyed hereby shall continue to be subject to the
matters set forth in Exhibit C attached hereto.
