APPLICATION SUMMARY FILE NAME: Hop Jack's CASE NO.: Minor Modification(MMD) MMD2018-00048 PROPOSAL: The applicant is proposing a change of use to an existing tenant space at 12180 SW Scholls Ferry Road. The 4,500-square-foot tenant space will be changing from a sales-oriented retail use to an eating and drinking establishment (Hop Jack's). No changes to the building footprint, on-site parking, or on-site landscaping are proposed. The C-G zone is designed to accommodate a full range of retail,office,and civic uses with a citywide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment,automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2018-00048 Hop Jack's 1 THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 12180 SW Scholls Ferry Road; south of SW Scholls Ferry Road, west of SW 121"Avenue and east of SW North Dakota Street.The subject property(WCTM 1S134BC,Tax Lot 200) and adjacent two (2) properties to the north (WCTM 1S134BC, Tax Lots 100 and 101) are owned by Atlas Greenway, LLC. The adjacent property to the west (WCTM 1S134BC, Tax Lots 300) is the Greenway Town Center,which is under separate property ownership. However, all four (4) properties share parking,access,and egress,as outlined in deed and easement documents provided by the applicant. The subject property is zoned General Commercial (C-G) and is located within a Planned Development. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and Because the applicant has only proposed a change of use to an existing tenant space, which primarily affects off-street parking regulations, that is the main focus of this review. The 4,500-square-foot tenant space will be changing from a sales-oriented retail use to an eating and drinking establishment.The subject property(WCTM 1S134BC,Tax Lot 200)and adjacent two(2)properties to the north(WCTM 1S134BC, Tax Lots 100 and 101) are owned by Atlas Greenway,LLC. The adjacent property to the west (WCTM 1S134BC, Tax Lots 300) is the Greenway Town Center, which is under separate property ownership. However, all four (4) properties share parking, access, and egress, as outlined in deed and easement documents provided by the applicant. Accordingly, the combined four (4) properties make up a multi- tenant development,which is subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D. Based on the applicant's submitted materials,staff finds there is adequate parking at the development,with 456 parking spaces provided. Upon review of the applicant's plans and narrative,staff finds this proposal is in compliance with all other applicable requirements of this title. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title. SECTION V. Hop Jack's has no drive through, so they don't have offsite single use customers visiting via drive through and then departing. Also, most customers come with other customers like friends and family so it would be common to have 4 customers arrive via one vehicle. Overall vehicle traffic generation is expected to be well under 100 vehicles per day. 8.
