APPLICATION SUMMARY FILE NAME: Casper CASE NO.: Minor Modification (MMD) MMD2018-00038 PROPOSAL: The applicant is proposing a change of use to a tenant space at 9685 SW Washington Square Road, Suite C07. The 2,400-square-foot tenant space will be changing from a sales-oriented retail use to a bulk sales use,Casper. APPLICANT: Casper, Inc. The MUC zone includes land around the Washington Square Mall and land immediately west of Highway 217.Primary uses permitted include office buildings, retail, and service uses. Also permitted are mixed-use developments and housing at densities of 50 units per acre. Larger buildings are encouraged in this area with parking under, behind or to the sides of buildings. In addition to the standards of this chapter,development within this zone is subject to the standards of Chapter 18.670. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2018-00038 Casper 1 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located inside Washington Square Mall;south of SW Hall Boulevard, east of Highway 217, and west of SW Greenburg Road. The property is located on a 46.24-acre tax lot (WCTM 1S126, Tax Lot 300), and is part of the larger Washington Square shopping center. The property is located in the Mixed Use Commercial (MUC) Zone, and the Washington Square Regional Center Plan District. In November 2017, the City of Tigard Planning Division approved a lot line adjustment (Case No. LLA2017-00010) between WCTM 1S135BA,Tax Lot 100 (which is occupied by the Thirsty Lion Pub& Grill) and WCTM 1S135BA, Tax Lot 101. Additionally, in April 2018, the City of Tigard Planning Division approved an approximately 64,000-square-foot automobile dealership with accessory uses on Tax Lot 101 (Case No. SDR2017-00005). As a result of these approvals, Tax Lot 101 is no longer considered part of the Washington Square shopping center (although it is owned by the same parent company, The Macerich Company), and is therefore not included in the parking count for the overall shopping center. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and Because the applicant has only proposed a change of use, which primarily affects off-street parking regulations, that is the main focus of this review. The subject 2,400-square-foot tenant space will be changing from a sales-oriented retail use to a bulk sales use. The tenant space is part of the overall Washington Square shopping center,which is a multi-tenant site, and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D. The attached table (Attachment 1) calculates the minimum off-street vehicle parking requirements based on this formula. Staff finds that 4,312 parking spaces are required for the site,taking into consideration the change of use discussed above. Based on the applicant's submitted materials, staff finds there is adequate parking at the development site,with 7,005 parking spaces provided. Upon review of the applicant's plans and narrative,staff finds this proposal is in compliance with all other applicable requirements of this title. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in MMD2018-00038 Casper 2 compliance with the applicable requirements of this Title.
