APPLICATION SUMMARY FILE NAME: WCCCA CASE NO.: Minor Modification (MMD) CUP2018-00006 PROPOSAL: The applicant requests a minor modification to a previously approved conditional use (Case No. CUP2003-00010) for an existing wireless communications facility at 10310 SW Canterbury Lane. The site contains an existing monopole tower, an approximately 200-square-foot equipment shelter,and related accessory equipment. The applicant proposes to remove and replace antennas,a generator,a sound barrier wall,a propane tank,and two concrete pads.The applicant also proposes to remove and replace two wall-mounted HVAC units,and roofing and siding materials on the existing equipment shelter. As a result of these modifications, the existing fenced area for the facility's accessory equipment will be expanded, as the new equipment will be larger in size than the existing equipment.Existing trees and landscaping will be removed and replaced in order to accommodate this expanded fenced area. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located on the south side of SW Canterbury Lane,west of SW 103` Avenue,and east of SW 106th Avenue. The property is also located directly adjacent to East Butte Heritage Park. The property is owned by the Intergovernmental Water Board (which includes the City of Durham,City of King City,City of Tigard,and Tigard Water District),and contains two water reservoirs and associated structures. In 2003, the City of Tigard Hearings Officer approved a Conditional Use Permit(Case No.CUP2003-00010) on this property for a wireless communications facility operated by the Washington County Consolidated Communications Agency(WCCCA).This approval was for a monopole tower,a 200-square-foot equipment shelter,and related accessory equipment.The property is zoned Low-Density Residential (R-3.5). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.740 Conditional Use: 18.740.020 Approval Process C. Minor modification of approved or existing conditional use. 2. An application for a minor modification shall be processed through a Type I procedure, as provided in Section 18.710.050The approval authority shall approve or approve with conditions the minor modification application when all of the following are met: a. The proposed development is in compliance with all applicable requirements of this title;and The previously approved conditional use (Case No. CUP2003-00010)was for a wireless communications facility in support of an Emergency Services use—Washington County emergency communications. In addition to the approval criteria for minor modification to a conditional use,the proposal is also subject to the approval criteria for wireless communication facilities that are subject to conditional use review. These additional criteria are addressed below.As demonstrated through the findings in this decision,this proposal complies with all applicable requirements of this Title.This criterion is met. b. The modification is not a major modification as defined in subsection A of this section. The applicant is not proposing any of the changes outlined in CDC 18.740.020.B.2. Therefore, this proposal is not a major modification. This criterion is met. 18.450 Wireless Communications Facilities 18.450.050 Uses Permitted Subject to Conditional Use Review A. Uses permitted.The approval authority shall review the uses subject to conditional use review, using approval criteria provided in Subsection 18.450.050.B. The following uses are subject to CUP2018-00006 WCCCA 2 approval under this section: 1. Towers in residential zones. A tower, including antennas, other support equipment or accessory equipment buildings,in any residential zone; The existing tower was previously approved through a conditional use review process. The applicant now requests a minor modification to the approved conditional use for an existing wireless communications facility in a residential zone. Accordingly,this application is being processed through a Type I procedure. B. Review criteria.Any use subject to conditional use review,shall be reviewed using the following: 1. Protection of points of visual interest. a. Views from residential structures located within 250 feet of the proposed wireless communication facility to the following points of visual interest shall be protected to the greatest practical extent: i. Mountains; ii. Significant public open spaces; iii. Historic structures. b. The following standards, and only the following standards, shall be used to protect the above identified points of visual interest to the greatest practical extent if views from a residential structure located within 250 feet from a proposed wireless communication facility to a point of visual interest specifically identified above is significantly affected: i. Investigate other locations within the same lot where such visual impacts can be minimized overall; ii. Investigate alternative tower designs that can be used to minimize the interruption of views from the residence to the point of visual interest; iii. Minimize visual impacts to the point of visual interest referred to above, by demonstrating that collocation or the use of other structures within the applicant's service area is not feasible at this time; iv. Minimize visual impacts by varying the setbacks or landscaping standards that would otherwise be applicable,provided the overall impact of the proposed development is as good or better than that would otherwise be required without said variations. 2. Color.Towers shall have a non-reflective surface and a neutral color that is the same or similar color as the supporting structure to make the antennas and related equipment as visually unobtrusive as possible,or, if required by the FAA, be painted pursuant to the FAA's requirements; 3. Setbacks. Towers shall be set back from the property line by a distance equal to the height of the tower. An adjustment may be obtained to reduce this setback, using the approval criteria in 18.790.030.B.7; 4. Tower spacing.No new tower in a residential zone shall be allowed within 2,000 feet of an existing tower.No new tower in nonresidential zones shall be allowed within 500 feet of an existing tower. If, having completed the collocation protocol outlined in Section 18.450.060 without success, the provider will be required to build a tower less than the distances specified above, an adjustment shall be obtained in compliance with 18.790.030.B.7. The applicant is proposing to remove and replace antennas and related equipment on an existing monopole tower at the subject site. Staff reviewed the applicant's elevation drawing to confirm this modification will not create a significant change in visual impact.The applicant is not proposing to modify the height,design, or color of the existing monopole tower.Additionally,the applicant is not proposing to move or relocate the existing monopole tower.Therefore,these criteria do not apply. CUP2018-00006 WCCCA 3 5. Lighting.No lighting shall be permitted on a tower except as required by the FAA; The applicant is not proposing any lighting with this project.Additionally,a condition of approval from Case No. CUP2003-00010 prohibits lighting on the existing monopole tower.This criterion is met. 6. Fencing and security. For security purposes, towers and ancillary facilities shall be enclosed by a 6-foot fence; The applicant proposes to expand an existing fenced area for accessory equipment from 30 feet by 44 feet to 30 feet by 50 feet. Staff reviewed the applicant's elevation drawing to confirm that the expanded area will be enclosed by a six-foot-tall fence.This criterion is met. 7. Landscaping and screening. a. Landscaping shall be placed outside the fence and shall consist of evergreen shrubs that will reach 6 feet in height and 95 percent opacity within 3 years of planting. b. When adjacent to or within residentially-zoned property,freestanding towers and accessory equipment facilities shall be screened by the planting of a minimum of 4 evergreen trees at least 15 feet in height at the time of planting.The planting of trees shall be prescribed in number by a plan prepared by a certified arborist in locations that(i) most effectively screen the wireless facilities from residential uses and(ii)promote the future survival of the trees while limiting adverse effects of the trees on abutting properties. Existing evergreen trees at least 15 feet in height may be used to meet the screening requirement of this section if the arborist demonstrates that they provide screening for abutting residential uses. The applicant proposes to remove two trees and landscaping,in order to accommodate an expanded fenced area for the facility's accessory equipment. These trees and landscaping were originally required under Case No. CUP2003-00010.Accordingly, the applicant proposes to replace any trees and landscaping that will be removed with those of equivalent quantity, type, and species,in a manner to achieve the original intent of the approved landscaping and screening plan from Case No. CUP2003-00010.These criteria are met. 8. Noise. Noise-generating equipment shall be sound-buffered by means of baffling, barriers or other suitable means to reduce the sound level measured at the property line to 50 dBA(day)/40 dBA(night)when adjacent to a noise-sensitive land use and 75 dBA (day)/60 dBA(night)when adjacent to other uses. The subject property is located in a residential zone (R-3.5 Low-Density Residential).The adjacent property to the east is occupied by a detached, single-family home,and the adjacent property to the west is occupied by multifamily housing units.These homes are considered noise-sensitive land uses.The applicant proposes to remove and replace two wall-mounted HVAC units and a generator.The applicant provided sound level estimates to the nearest noise-sensitive land uses. The sound level estimate for the HVAC units is 40 dBA, which meets the sound level restrictions adjacent to noise-sensitive land uses for both day (50 dBA) and night(40 dBA).The sound level estimate for the generator is 43 dBA,which meets the daytime sound level restriction, but exceeds the nighttime sound level restriction. However, the applicant's materials state the generator is intended for emergency purposes only, and will run once a week for a maximum of one hour during daytime hours,for maintenance and testing purposes only. Since the generator is not intended to run at night, staff finds it acceptable that the generator only meets the daytime sound level restriction. Additionally, the applicant intends to install a wooden sound barrier wall around the generator,which will further reduce the sound levels from the estimates provided above.This criterion is met. CUP2018-00006 WCCCA 4 CONCLUSION: The proposal is a minor modification of an approved conditional use and is in compliance with the applicable requirements of this Title. SECTION V. Parcel Size: 2.06 Acres 3 Application for Minor Modification—Type I Application Project Title: WCCCA Canterbury II. DESCRIPTION OF PROJECT A. SITE AT PRESENT The present site (fenced compound) is within a City property. The subject site is used solely as an unmanned E911 wireless facility. The map and tax lot for the subject property is 2S111BCO2600. The site exists at an elevation of approx. 398 feet. The surrounding area is comprised of a church and residential communities. The existing monopole is 120' in height. It is enclosed within a 30' x 44' fence. Along with the monopole, within the enclosure are a pre-fabricated shelter to house radio equipment, along with a generator, propane tank and ancillary equipment. B. PROPOSAL Washington County Consolidated Communications Agency (WCCCA) proposes to add and upgrade antennas on the existing monopole. No increase in height to the monopole is proposed. WCCCA proposes to remove an existing generator and its pad, along with the removal of an existing propane tank and its pad. New concrete pads will be constructed for both the new generator and propane tank. WCCCA proposes to remove existing HVAC units on the pre-fab shelter and install new ones. WCCCA proposes to replace the existing siding and roofing of the existing shelter. WCCCA proposes no change in height to the tower. WCCCA proposes to extend the east fence-line by 6'. This will increase the overall fenced compound from 30' x 44' to 30' x 50'. Application for Minor Modification—Type I Application Project Title: WCCCA Canterbury III. MAJOR MODIFICATION CRITERIA 1. An increase in dwelling unit density, or lot coverage for residential development; Applicants Response: No increase in dwelling unit density, or lot coverage for residential development is proposed. 2. A change in the ratio or number of different types of dwelling units; Applicants Response: No change is proposed. 3. A change that requires additional on-site parking in compliance with Chapter 18.310, Off-Street Parking and Loading; Applicants Response: No additional parking is required. 4. Due to the fact that none of the criteria are met for a Major Modification, a Minor Modification is being submitted for this proposal. APPLICANTS NOTE: Also being attached as part of this application is a standard noise study that has been completed for another C800/WCCCA site (C800 is Clackamas County's 911 system). The noise level of the new HVAC units and the new generators are noticeably lower than the existing ones being replaced and the noise study is being provided to the City as consideration to not have to rebuild the sound wall barrier that was an original condition of approval. We have modified the findings of the original noise study to show the noise levels if measured to the closest residence. There is an apartment complex approx. 205' to the west of the proposed new generator and a residence to the south approx. 205' away. The proposed project is to construct a new Emergency Public Communication Services facility consisting of a 180' lattice tower within a 50' by 50' fenced compound. The associated radio equipment will be placed within a 12' by 20', 9'tall prefab concrete shelter. There will be two air conditioning units mounted on the west wall of the shelter. A 35 KW generator for emergency power during electrical outages. The noise study is an evaluation of the noise levels from the proposed noise-generating equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient noise levels were measured on July 8, 2016 at around 11:00 A.M. at the site with a Svantek 971 sound level meter. Measurements were conducted in accordance with Oregon Administrative Rules (OAR) 340-35-035 subsection (3)(b). The average ambient noise level was 43 dBA primarily due to noise from local traffic. The weather during the measurements was clear. Code Requirements The site is located within the City of Lake Oswego Zoning jurisdiction on property with an EFU Exclusive Farm Use zoning. The receiving properties to the west are also zoned EFU. The properties to the east are zoned Residential, and to the north, across Bergis Road, are zoned Residential. The proposed new equipment includes an equipment shelter and emergency generator. The shelter will be served by two cooling HVAC units, which are expected to run 24 hours a day. The generator will run once a week for a maximum of one hour during daytime hours for maintenance and testing purposes only. 222 Etruria Street, Suite 100 Seattle,WA 98109 206.839.0819 P!/206.839.0824 F C800 Skytand Page 2 Oregon Administrative Rules (OAR) 340-35-035 requires the following for new commercial sources located on a previously used site: No person owning or controlling a new industrial or commercial noise source located on a previously unused industrial or commercial site shall cause or permit the operation of that noise source if the noise levels generated or indirectly caused by that wise source increase the ambient statistical noise levels, L10 or L50 by more than 10 dBA in any one hour, or exceed the levels specified in Table 8 [see table below], as measured at an appropriate measurement point, as specified in subsection (3)(b) of this rule. The generator must not exceed the L50 requirement of 55 dBA when operating during daytime hours for maintenance testing. The generator is exempt during emergency operation. Predicted Equipment Sound Levels 24-Hour Operation Equipment The equipment shelter is served by two Bard WA/L3S air conditioning units which each produce 67 dB(A) at 10 feet. The equipment will operate on a lead/lag cycle such that one unit will be in operation at a time. Methods established by ARI Standard 275-2010 and ASHRAE were used to predict equipment noise levels at the receiving properties. Application factors such as location, height, and reflective surfaces are accounted for in predicting the sound pressure level. The units are located on the west side of the shelter. The Residential property to the north, across SW Bergis Road, is approximately 90 feet from the units. The Residential property to the east is approximately 105 feet from the units, note that the equipment shelter blocks the units to the east receiving property and acts as a noise barrier. The EFU zoned property is approximately 260 feet west of the units. According to the manufacturer, the generator will produce a sound level of 64 dBA at 23 feet with a F173 Quiet Site Second Stage sound enclosure. The nearest Residential properties are to the north and east. The Residential property to the north, across SW Bergis Road, is approximately 90 feet from the generator. The Residential property to the east is approximately 70 feet from the generator. The EFU zoned property is approximately 295 feet west of the generator.
