APPLICATION SUMMARY FILE NAME: Park 217 Business Center- Building 4 CASE NO: Minor Modification(MMD) MMD2018-00043 Sensitive Lands Review(SLR) SLR2018-00005 PROPOSAL: The applicant is proposing exterior modifications to the façade of Building 4 of the Park 217 Business Center. The proposed modifications include replacing a storefront window with a door, replacing a storefront door with a window, and replacing a section of storefront windows with standard double entry doors. No changes to the landscaping, parking, or site plan are proposed. The applicant also requests a Type 1 Sensitive Lands Review, as the subject property is located within the Special Flood Hazard Area. The C-G zone is designed to accommodate a full range of retail, office, and civic uses with a citywide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapters 18.120, 18.510,and 18.780 MMD2018-00043 and SLR2018-00005 Park 217 Business Center-Building 4 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The 13.24 acre site is located on the southwest side of OR-217, east of SW Garden Place and north of SW Hunziker Road. The business park is currently developed and includes eight (8) buildings, an on-site parking lot,and associated landscaping.The proposed exterior modifications would only impact Building 4,which is located at the southeastern corner of the business park. Building 4 is also located in the Special Flood Hazard Area. The property is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Staff has reviewed the proposal for consistency with the applicable criteria in the following Tigard Development Code chapters. Findings for these code sections are found below. 18.510 Sensitive Lands 18.780 Site Development Review 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification to an existing development at 12100 SW Garden Place.The relevant requirements of this Title that apply specifically to this proposal are the development standards of the Commercial Zone and parking requirements. The applicant is proposing minor modifications to the northeast and southeast facades of Building 4 of the Park 217 Business Center. This request includes three exterior modifications mainly involving the switching out of windows and doors.Additionally,the concrete pathway immediately in front of the proposed double entry doors will be ground down approximately six inches to be level with the entrance doors. All of the proposed doors and windows will match the existing building style.The applicant is not proposing to change any existing landscaping,parking,or building height. Based on the applicant's submitted site plan, staff finds that the proposal meets all applicable development standards, as outlined in CDC Table 18.120.3. No change of use is proposed, therefore the parking requirements are not affected. Upon review of the applicant's plans and narrative, staff finds that all of the applicable requirements of this title are met. MMD2018-00043 and SLR2018-00005 Park 217 Business Center-Building 4 2 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification.This criterion has been met. 18.510 Sensitive Lands: 18.510.040 General Provisions for Special Flood Hazard Areas M. Nonresidential construction. New construction and substantial improvement of any commercial,industrial,or other nonresidential structure shall either have the lowest floor,including basement, elevated to the level of the base flood elevation, or together with attendant utility and sanitary facilities,shall: 1. Be floodproofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water; The applicant is proposing exterior modifications to an existing structure at 12100 to 12120 SW Garden Pl. The subject building is completely located within the Special Flood Hazard Area. Based off of information from Washington County,the subject site is located three feet above the base flood elevation, and the applicant is not proposing to flood proof the structure. Therefore, this criterion is met. 2.Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; The applicant's proposal will be reviewed for compliance with the provision outlined above by the Building Official, at the time of the building permit submittal. This provision has been met. 3. Be certified by a registered professional engineer or architect that the design and methods of construction are in compliance with accepted standards of practice for meeting provisions of this subsection based on their development or review of the structural design, specifications and plans. Such certifications shall be provided to the building official as provided in 18.510.030.E.2; and The applicant's proposal will be reviewed for compliance with the provision outlined above by the Building Official, at the time of the building permit submittal. This provision has been met. 4. Nonresidential structures that are elevated, not floodproofed, shall meet the same standards for space below the lowest floor as described in Paragraph 18.510.040.L.2. Applicants flood-proofing nonresidential buildings shall be notified that flood insurance premiums will be based on rates that are 1 foot below the floodproofed level(e.g.,a building constructed to the base flood level will be rated as 1 foot below that level). The applicant is not proposing to flood proof the building,because the building is located approximately three feet above the base flood elevation.The subject building is located at approximately 157 feet above sea level, and the base flood elevation is approximately 154 feet above sea level. This provision has been met. 18.510.070 Sensitive Lands Applications B. Within the special flood hazard area. The approval authority shall approve or approve with conditions an application for sensitive lands review within the special flood hazard area when all of the following criteria are met: 1. Compliance with all of the applicable requirements of this title; MMD2018-00043 and SI.R2018-00005 Park 217 Business Center-Building 4 3 Staff has reviewed the applicant's proposal for compliance with all applicable requirements of this title.This criterion has been met. 2. Land form alterations shall preserve or enhance the special flood hazard area storage function and maintenance of the zero-foot rise floodway shall not result in any encroachments, including fill, new construction, substantial improvements and other development unless certified by a registered professional engineer that the encroachment will not result in any increase in flood levels during the base flood discharge; The applicant is not proposing any landform alterations. This criterion is not applicable. 3. Land form alterations or developments within the special flood hazard area shall be allowed only in areas designated as commercial or industrial on the comprehensive plan land use map, except that alterations or developments associated with community service uses, utilities, or public support facilities shall be allowed on residentially zoned properties subject to applicable zoning standards; The development is proposed for Building 4 of the Park 217 Business Center.This site is zoned General Commercial (C-G),which is a commercial zone. This criterion has been met. 4.Where a land form alteration or development is permitted to occur within the special flood hazard area it will not result in any increase in the water surface elevation of the 100-year flood; The applicant is proposing modifications to the exterior façade of Building 4,and no changes to the site or ground levels are proposed. The development proposed will not result in any increase in the water surface elevation of the 100-year flood This criterion has been met. 5. The land form alteration or development plan includes a pedestrian/bicycle pathway in compliance with the adopted pedestrian/bicycle pathway plan, unless the construction of said pathway is deemed as untimely; 6. Pedestrian/bicycle pathway projects within the special flood hazard area shall include a wildlife habitat assessment that shows the proposed alignment minimizes impacts to significant wildlife habitat while balancing the community's recreation and environmental educational goals; The applicant is not proposing any new pedestrian/bicycle pathways because the proposal is only for exterior modifications to the existing facade of Building 4. These criteria are not applicable. 7.The necessary U.S.Army Corps of Engineers and State of Oregon Land Board,Division of State Lands, and CWS permits and approvals shall be obtained;and Clean Water Services (CWS)issued a Service Provider Letter (CWS file 18-002983) on September 21,2018. The agency determined that the proposal will not significantly impact the existing or potentially significant areas near the site. No U.S. Army Corps of Engineers, State of Oregon Land Board, or Division of State Lands permits are required.This criterion is met. 8.Where land form alterations or development are allowed within and adjacent to the special flood hazard area, the city shall require the consideration of dedication of sufficient open MMD2018-00043 and SI,R2018-00005 Park 217 Business Center-Building 4 4 land area within and adjacent to the special flood hazard area in compliance with the comprehensive plan. The applicant is proposing modifications to the exterior façade of Building 4,and no land form alterations are proposed. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development that is located in the Special Flood Hazard Area and is in compliance with the applicable requirements of this Title. SECTION V. AGENCY COMMENTS Clean Water Services (CWS) issued a Service Provider Letter (CWS file 18-002983) on September 21, 2018.The agency determined that the proposal will not significantly impact the existing or potentially significant areas near the site. PROCEDURE AND APPEAL INFORMATION Final Decision: The Minor Modification and Administrative Sensitive Lands Review have been processed through a Type I procedure. Sorry, our note was not as clear as it should have been. We noticed onsite that approximately 6" of the threshold will need to be ground down so the threshold is no higher than 1/2". It's currently closer to 1" high for that small section.
