CONDITIONS OF APPROVAL
PRIOR TO BUILDING PERMIT ISSUANCE THE FOLLOWING CONDITIONS SHALL BE
SATISFIED:
1. The applicant shall submit an Address and Commercial Suite Application to consolidate 12160
SW Scholls Ferry Road, Suite #100 and 12160 SW Scholls Ferry Road, Suite #200 into one
tenant space with one address.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located within a shopping center located south of SW Scholls Ferry Road,east of SW North
Dakota Street, north of SW Anton Drive, and west of SW 121 St Avenue. The two tenant spaces that are
proposed to be consolidated comprise a total of 3,800 square feet and are both located within this
shopping center.The 11.02 acre development site is located on four tax lots,contains four(4)commercial
buildings,landscaping,and associated parking.The property is located in the General Commercial (C-G)
Zone and is located within a Planned Development (PD)
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.780 Site Development Review:
18.780.050 Minor Modifications
C. Approval criteria. The approval authority shall approve or approve with conditions an
application for a minor modification when all of the following are met:
1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant is only proposing a change of use from Eating and Drinking Establishment to Bulk Sales
and a consolidation of office spaces for 12160 SW Scholls Ferry Road,Suite #100 and 12160 SW Scholls
Ferry Road, Suite #200. With a change of use, the potential issues are primarily related to the off-street
parking requirement. Both previous and proposed uses are allowed in the C-G Zone. The tenant space
is part of the overall Greenway Town Center, which is a multi-tenant shopping center, and is therefore
subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D.The table below
presents calculations of the minimum off-street parking requirements based on this formula:

Staff finds that 89 parking spaces are required for the shopping center. There are currently 103 parking
spaces available for the shopping center,therefore with the change of use, there are 14 additional parking
spaces above the required minimum at the Greenway Town Center shopping center. Upon review of the
applicant's plans and narrative, staff finds this proposal is in compliance with all other applicable
requirements of this title. This criterion has been met.
2. The modification is not a major modification.
The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this
proposal is not a major modification. This criterion has been met.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Title.

Final Decision:
A minor modification is a Type I procedure.As such, this decision is final for purposes of appeal on the

appealable locally, and is the final decision of the City.
THIS DECISION IS FINAL ON SEPTEMBER 12, 2018,
AND BECOMES EFFECTIVE ON SEPTEMBER 13, 2018.

BILL OF SALE PLANNINUr ENGINEERING
For good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, Greenway Center LLC, a Washington limited liability company ("Seller"),
hereby grants, bargains, sells, conveys, assigns and transfers to Atlas Greenway LLC, an Oregon
limited liability company, ("Buyer"), all of Seller's right, title and interest in and to any tangible
personal property located on the land described on the attached Exhibit A(the "Land") or within
the improvements located on the Land, including without limitation, all furniture, fixtures,
equipment, building materials,tools, supplies, goods and any other items of personalty owned by
Seller and used in connection with the operation of the Land and the improvements located
thereon (collectively, the "Personal Property"). The Personal Property specifically excludes any
and all personal property owned by tenants or otherwise considered the property of tenants under
any leases affecting the Land or the improvements located thereon.
Seller represents and warrants to Buyer that the Personal Property is free and clear of all
liens, security interests, charges and encumbrances. Seller further represents and warrants to
Buyer that Seller has full power and authority to transfer all right, title and interest of Seller in
and to the Personal Property to Buyer, and Seller shall warrant and forever defend title to the
Personal Property against all persons claiming any interest therein. Seller shall indemnify, hold
harmless and defend Buyer from and against all costs and liabilities, including attorneys' fees,
which Buyer incurs because of any act or cause of action occurring or accruing with respect to
the Personal Property prior to the execution date of this Bill of Sale set forth below. Except as
expressly stated herein, Seller is conveying the Personal Property to Buyer on an "AS IS,
WHERE IS"basis.

fast food restaurant tenant spaces into one mercantile tenant space in "Building B" at (12160) 12198
SW Scholls Ferry Road, Tigard, Oregon
B. Evaluation criteria. The director shall determine that a major modification(s) will result if one or
more of the following changes are proposed. There will be:
1. An increase in dwelling unit density, or lot coverage for residential development;
Not applicable, no dwelling units exist or are proposed.
2. A change in the ratio or number of different types of dwelling units;
Not applicable, no dwelling units exist or are proposed.
3. A change that requires additional on-site parking in accordance with Chapter 18.765
Not applicable, please see the attached spreadsheet which provides a breakdown of the parking
available based on the various tenant spaces and uses.
4. A change in the type of commercial or industrial structures as defined by the Uniform Building
Code;
Not applicable, changes to the types of structures are not part of the project scope.
5. An increase in the height of the building(s) by more than 20%;
Not applicable, no changes to the existing building shall occur.
6. A change in the type and location of accessways and parking areas where off-site traffic would be
affected;
Not applicable, no changes to accessways or parking areas shall occur.
7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed
100 vehicles per day;
A significant decrease in traffic is expected. The 2 fast food tenant spaces are decreasing to one
sales-oriented tenant space. The former tenants were Subway and Berry Farm Yogurt. The new
tenant is Hunter Douglas Blinds & Shades. The two current spaces are 1250 sf and 520 sf. The
proposed tenant space will be the combined 1770 sf. Please see the existing and proposed plans for
reference. Please also see the attached spreadsheet which provides a breakdown of the parking
available based on the various tenant spaces and uses.
Currently the two fast food restaurants require 11 parking spaces. The new proposed sales-oriented
tenant space would only require 6 (see attached parking spreadsheet). There is a net decrease in the
parking stall requirements for this tenant space.
8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding
expansions under 5.000 square feet: Site Development Review 18.360-5 AP Update: 2/14
Not applicable, the overall area for the building shall remain the same.
9. A reduction in the area reserved for common open space and/or usable open space which
reduces the open space area below the minimum required by this code or reduces the open space
area by more than 10%;
Not applicable, there are no reductions to common open space in the proposed project.
10. A reduction of project amenities below the minimum established by this code or by more than
10% where specified in the site plan:

Thank you both for your prompt reply! I have discarded the previous narrative, and date stamped this new one to be
included with the land use file.
My final observation about this application is that Gary Gilbert signed the application as the owner, and I was unable to
find his name on any of the legal documents for Atlas Greenway LLC. Do you have his email/ phone number handy? I will
need something in writing from Gary to connect him with Atlas Greenway LLC,and then you should have a complete
application.Thank you!
