The C-G zone is designed to accommodate a full range of retail, office,and civic uses with a citywide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. The findings and conclusions on which the decision is based are noted in Section IV. MMD2018-00040 Boost Mobile Page 1 of 3 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located within a shopping center located on the northwest side of Pacific Highway, north of SW Gaarde Street, and south of SW Fairhaven Street. The Gaarde Pacific shopping center is located on a 1.11-acre tax lot,and contains two (2) commercial buildings,78 total parking spaces,and associated landscaping. The applicant proposes to change the use of Suite #30 from a personal services use to a sales-oriented retail use. No changes to the building footprint or on-site landscaping are proposed. The property is located in the General Commercial (C-G) Zone, and is not within a plan district. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is only proposing a change of use for 13815 SW Pacific Highway, Suite #30, and so the primary issue will be the impact to the off-street parking requirement.The subject 424 square-foot tenant space will be changing from a personal services use to a sales-oriented retail use.The tenant space is part of the overall Gaarde Pacific shopping center,which is a multi-tenant site,and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D. Upon review of the applicant's plans and narrative, staff finds this proposal is in compliance with all other applicable requirements of this title. This criterion has been met. MMD2018-00040 Boost Mobile Page 2 of 3 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion has been met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title.
