SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 12950 SW Pacific Highway; southeast of SW Pacific Highway,northeast of SW
Frewing Street,and west of SW Walnut Place. The subject tenant space (Suite 215) is 634 square feet in
size,and is located within an existing shopping center.The 1.37-acre development site is made up of two
tax lots (WCTM 2S102BD,Tax Lot 1900;WCTM 2S102CB,Tax Lot 3101),and contains two commercial
buildings, one freestanding fast-food eating and drinking establishment (Morning Rush), landscaping,
and 63 parking spaces.The site is zoned General Commercial (C-G).
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.780 Site Development Review:
18.780.050 Minor Modifications
C. Approval criteria. The approval authority shall approve or approve with conditions an
application for a minor modification when all of the following are met:
1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant is proposing a change of use to a tenant space at 12950 SW Pacific Highway, Suite 215.
The 634-square-foot tenant space will be changing from an office use to a motor vehicle sales use, Stout
Motors, LLC. The applicant also proposes to occupy four on-site parking spaces with vehicles that will
be available for purchase. Accordingly, the total on-site parking count for this development will be
reduced to 59 spaces.
The 1.37-acre development is a mixed-use, multi-tenant site, and is therefore subject to the required
minimum vehicle parking formula outlined in CDC 18.310.030.D. The table below calculates the
minimum off-street vehicle requirements based on this formula:

Staff finds that 52 parking spaces are required for the site, taking into consideration the change of use
discussed above. Based on the applicant's submitted materials,staff finds there is adequate parking at the
development site,with 59 parking spaces provided.

Upon review of the applicant's plans and narrative, staff finds that all other requirements of this title are
not applicable.This criterion is met.
2. The modification is not a major modification.
The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this
proposal is not a major modification. This criterion is met.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Tide.

My name is Wassim Ayoub and my partner's name is David Stout. Combined we have.6/ ars'°.'-iA, 0
experience of working in the customer service industry as a district manager for a reputable grocery �'cFONG
chain and as a service auto adviser for many known car dealerships in town (Sunset Porsche, Kuni
BMW). Our passion for cars and our families brought us together on this new journey of serving the
public by providing an honest and transparent car selling experience if possible. We both live in Tigard
and passionate about supporting local businesses. That is why, we felt very strong about finding a
properly zoned location in Tigard in order to spend it where we earn it. The operation will be a side
project in addition to our regular demanding job (50-60 hrs/wk on avg). We are leasing 4 car spots in
addition to the office space in order to be compliant with all DMV and city regulations. However, we will
most likely be able to afford buying and selling 1-2 cars at a time. The business will be by appointment
only since we won't be in the office unless we have to meet clients. I hope you approve our application
and I hope you don't hesitate to contact us if you have any additional questions or concerns in order to
make our dreams of supporting our families a true reality.

B. Evaluation criteria: The director shall determine that a major modification will result if one more of
the following changes are proposed. There will be:
1- No change in dwelling unit density or lot coverage for residential development.
2- No change in the ratio or number of different types of dwelling units.
3- No change that requires additional on-site parking in compliance with chapter 18.310. Off site
parking and loading because we there won't be any car deliveries to the assigned location.
4- No change in the type of commercial or industrial structures as defined by the state building
code.
5- No increase in the height of the business.
6- No change in the type or location of accessways and parking areas where off site traffic would
be affected.
7- No increase in vehicular traffic whatsoever.
8- No increase in the floor area proposed.
9- No reductions in the area reserved for common open space or usable open space.
10- No reduction of project amenities below the min required by this title. Recreational
facilities/screening/landscaping provisions.
11- No modification to the conditions imposed at the time of site developments review approval
that are not the subject of Paragraphs 18.780.40B.1-10.
