'WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to instal ' streets, sidewalks, street lights, storm sewers, sanitary sewers, under- ground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement which stipulates that: "Upon receipt of certification by the Department of Public Warks that all requirements have been met and a One Year Maintenance Bond, the City Counc;.l agrees to accept the public improvements, subject to the re- gtii.rFments for correction of deficiencies and maintenance for a period of one year. . . ."; and WHEREAS, said Certification has now b-ea received; :-• I WHEREAS, the required performance bond has remained in full force and effect throukhout the normally required maintenance period of one year, and WHEREAS, no deficiencies remain to be corrected therein, NOW, 'THEREFORE, BE 1T RESOLVED that the City Council of the City of Tigard, Oregon hereby accepts the public improvements constructed within Wilderness Subdivision, said subdivision being recorded in Book 40 on Page 48 in Washington County, Oregon, Flat Records. AND FURTHER, the City Council herewith authorizes release of the aforsaid bond. W I T N E S S E T H : WHEREAS, Petitioner has applied to the City for approval for filing in Washington County, a subdivision plat known as located X11 , Tp • ,n v.,�L _ Williamette Meridian, Washington County, Oregon; and WHEREAS, the City of Tigard Subdivision Ordinance requires the subdivider to I stre.rts, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities and other public facilitiej for the development and requires the payment of fees; and WHE1%9AS, the City has approved and adopted the standard specifications for Public Works construction by APWA Oregon Chapter and the Unified Sewerage specifications for the -3anitary sEwers prepared by professional engineers for subdivision development; and WHEREAS, the public improvements required to 6!? constructed or placed in petitioner's development are incomplete, but petitioner has nonetheless requested the City to permit progressive occupancy and use of property in the subdivision, and the parties desire hereby to protect the public interest generally and prospective purchasers of lots in said subdivision by legally enforceable assurances that the public improvements will be Lnstalled as required and completed within the time hereinafter set forth. Tigard) Dear Bud: I have reviewed the plans for this subdivision as they concern Fonner Street, which is a county road within the City of Tigard. My comments are as follows: The storm drain in Fonner and to the south must be designed for 25 year runoff as per county standards. The utility easement south of Fonner should be acquired prior to construction. Our standard section for a 36 foot street, as Fonner Is, requires 8 inches of 2 inch minus crushed rock rather than the 6 that you show. Fonner and S .W. Errol Streets (Wash . Co . Tax Map 2S1 3AD, Tax Lot 500) APPLICANT: Larry Jackson I . FINDINGS OF FACT: 1 . The applicant is rt-questing permission to create a 13 lot subdivision in accordance with Section 17 . 16 . 100 of the Ti- gard Municipal Code for a 4 . 37 acre parcel in a R-10 zone. 2 . The site is designated "Suburban Density Residential" on NP III . The applicable policies are as follows : Policy 4 . Protect the existing suburban character of this portion of the neighborhood from encroachment by higher density developments. The maximum over- all density of development will be three dwelling units or nine persona per gross acre . A higher density of four units or 12 persons per gross acre is a possibility within an approved planned unit development . Policy 5. Residential. subdivisions will be developed with paved streets, curbs and gutters , street lights , and walkways according to City or County stand- ards . All utilities will be placed underground . Policy 6 . Development will coincide with the provision of public streets, water, and sewage facilities . These facilities shall be (a) capable of ade- quately serving development and (b) designed to meet City or County standards . 3. S .W . Fonner Street is designated a local street on NP III , which requires• a 50 foot right-of-way . 4 . The site is zoned R-10. Single Family Residential . Section 18 . 20 of the Tigard Municipal Code requires that all lots in 'he R-10 zone be a minimum of 10, 000 square feet . Streets and roads are laid ont so as to conform to the plats of subdivision or maps of major partitions already approved for adjoining property as to width, general di- rection , a.nd in all other respects, unless the City de- termines it to be in the public interest to modify the street or roa.d pattern b. Streets and roads held for private use are clearly indi- cated on the tentative plan , and all r3servations or re- strictions relating to such private roads and streets are set forth C. The tentative plan complies with the comprehensive plan and applicable zoning :regulations of the City then in effect d. No tentative plat of a subdivision or map of a major partition shall be approved unless there will exist ade- quate quantity and quality of water and an adequate sew- age disposal system to support the proposed use of the land described in the proposed plat . II . STAFF OBSERVATIONS : The parcel is a heavily vegetated site, easterly sloping, and surrounded by single family residences on large lots with septic tanks. The parcel is an island connected to the city by a 50 foot wide lot to the south . The general character of the surrounding area is somewhat rural with large lots, open drainage, etc . S.W. Fonner Street is a 22 foot paved street without curbs , gut- ters, sidewalks, etc . on a 40 foot right-of-way . The proposed preliminary plat shows the ten foot dedication and half street improvement to Fonner Street , as required by the recent zone cl: nge (ZC 13-77) .- A six inch water line is in S .W . Fonner Street with adequate capacity to service the proposed develepmpnt . Sewer is available to t1 e property from a trunk line in the drainage swale 500 feet to the south . The sewerage serl-J.ce is
